| 4 | 4 | | 1.4BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: |

| 5 | 5 | | 1.5 Section 1. Minnesota Statutes 2024, section 297H.01, subdivision 8, is amended to read: |

| 6 | 6 | | 1.6 Subd. 8.Residential generator."Residential generator" means any of the following: |

| 7 | 7 | | 1.7 (1) a detached single family residence that generates mixed municipal solid waste or |
|---|
| 8 | 8 | | 1.8nonmixed municipal solid waste; |
|---|
| 9 | 9 | | 1.9 (2) a person residing in a building or site containing multiple residences that generates |
|---|
| 10 | 10 | | 1.10mixed municipal solid waste, including apartment buildings, common interest communities, |
|---|
| 11 | 11 | | 1.11or manufactured home parks, where each residence is separately billed by the waste service |
|---|
| 12 | 12 | | 1.12provider; |
|---|
| 13 | 13 | | 1.13 (3) an owner of a building or site containing multiple residences or an association |
|---|
| 14 | 14 | | 1.14representing residences that generate mixed municipal solid waste or nonmixed municipal |
|---|
| 15 | 15 | | 1.15solid waste, including apartment buildings, condominiums, manufactured home parks, or |
|---|
| 16 | 16 | | 1.16townhomes where no residence is separately billed for such service by the waste management |
|---|
| 17 | 17 | | 1.17service provider and the owner or association is billed directly for the waste management |
|---|
| 18 | 18 | | 1.18services. A residential generator does not include a self-hauler.; or |
|---|
| 19 | 19 | | 1.19 (4) an organization exempt under section 501(c)(3) of the Internal Revenue Code that |
|---|
| 20 | 20 | | 1.20receives donations for resale and salvage from an entity listed in clauses (1) to (3). |
|---|
| 21 | 21 | | 1.21 EFFECTIVE DATE.This section is effective July 1, 2025. |
