1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
1.6 Section 1. Minnesota Statutes 2024, section 125A.81, is amended to read:
1.7 125A.81 SPECIAL EDUCATION SEPARATE SITES AND PROGRAMS AID.
1.8 Subdivision 1.Definition.For purposes of this section, "special education separate site
1.9and program" means a public separate day school facility attended by students with
1.10disabilities for 50 percent or more of their school day.
1.11 Subd. 2.Eligibility for special education separate sites and programs aid.An
1.12education cooperative under section 471.59, education district under section 123A.15,
1.13service cooperative under section 123A.21, or intermediate school district under section
1.14136D.01, or a school district site approved under subdivision 2a qualifies for additional
1.15state funding to special education separate sites and programs for every kindergarten through
1.16grade 12 child with a disability, as defined in section 125A.02, served in a special education
1.17separate site or program as defined in subdivision 1.
1.18 Subd. 2a.School district sites.A school district that operates a school site meeting the
1.19definition of a special education separate site and program under subdivision 1 may apply
1.20to the commissioner for funding eligibility. The district must provide information about its
1.21program in the form and manner specified by the commissioner.

2.8 EFFECTIVE DATE.This section is effective for aid for fiscal year 2026 and later.
2.9 Sec. 2. APPROPRIATIONS; SPECIAL EDUCATION.
2.10 Subdivision 1.Department of Education.The sums indicated in this section are
2.11appropriated from the general fund to the Department of Education in the fiscal years
2.12designated.
