39 | 39 | | 2.9 Subd. 3.Retention and disposal of recordings.(a) A licensed child care center must |

40 | 40 | | 2.10retain video security camera recordings required under this section for 90 calendar days |
---|
41 | 41 | | 2.11after the date of the recording. Except as provided under paragraph (b), a licensed child care |
---|
42 | 42 | | 2.12center must dispose of video security camera recordings required under this section after |

43 | 43 | | 2.1390 calendar days. |

44 | 44 | | 2.14 (b) A licensed child care center that receives notice from a law enforcement official of |

45 | 45 | | 2.15a suspected crime committed against a child at the center may not dispose of any video |

46 | 46 | | 2.16security camera recordings required under this section until the law enforcement investigation |

47 | 47 | | 2.17of the suspected crime is complete. |

48 | 48 | | 2.18 (c) A licensed child care center must adhere to additional requirements issued by the |

49 | 49 | | 2.19commissioner regarding the retention and disposal of video security camera recordings |

51 | 51 | | 2.21 Subd. 4.Dissemination of recordings.(a) A licensed child care center may not sell, |
---|
52 | 52 | | 2.22share, transmit, or disseminate a video security camera recording required under this section |
---|
53 | 53 | | 2.23to any person except as authorized by this section. |
---|
54 | 54 | | 2.24 (b) A child care center may disseminate a video security camera recording required |
---|
55 | 55 | | 2.25under this section pursuant to a valid court order, search warrant, or subpoena in a civil, |
---|
56 | 56 | | 2.26criminal, or administrative proceeding, including an investigation by the commissioner. |
---|
57 | 57 | | 2.27 (c) A licensed child care center must establish a process by which a parent or legal |
---|
58 | 58 | | 2.28guardian may review, but not obtain a copy of, a video security camera recording required |
---|
59 | 59 | | 2.29under this section if the parent or legal guardian receives a daily written report from the |
---|
60 | 60 | | 2.30center indicating that the child was physically injured while in the facility. |
---|
61 | 61 | | 2.31 (d) An employee of a licensed child care center who is the subject of proposed disciplinary |
---|
62 | 62 | | 2.32action by the center based upon evidence obtained by a video security camera must be given |
---|
63 | 63 | | 2Sec. 2. |

65 | 65 | | 3.2who obtains a recording or a copy of the recording must treat the recording or copy |

66 | 66 | | 3.3confidentially and must not further disseminate it to any other person except as required |

67 | 67 | | 3.4under law. The employee must not keep the recording or copy or a portion of the recording |

68 | 68 | | 3.5or copy after it is no longer needed for purposes of defending against a proposed action. |

69 | 69 | | 3.6 Subd. 5.Written policy required.A licensed child care center must have a written |
---|
70 | 70 | | 3.7policy on the center's use of video security cameras that includes the following: |

71 | 71 | | 3.8 (1) the days and times the video security cameras in the facility are in use; |

72 | 72 | | 3.9 (2) the locations of all video security cameras in the facility; |

73 | 73 | | 3.10 (3) the center's retention and disposal policies and procedures for the video security |

74 | 74 | | 3.11camera recordings required under this section; and |
---|
75 | 75 | | 3.12 (4) the center's policies governing access to the video security camera recordings required |
---|
76 | 76 | | 3.13under this section. |

77 | 77 | | 3.14 Subd. 6.Notices.(a) A licensed child care center must notify all parents and legal |
---|
78 | 78 | | 3.15guardians who apply for placement or enroll a child in the center about the use of video |
---|
79 | 79 | | 3.16security cameras in the facility. At the time of a child's enrollment, the center must provide |
---|
80 | 80 | | 3.17parents and legal guardians with the video security camera policy required under subdivision |

82 | 82 | | 3.19 (b) A licensed child care center must post a sign at each facility entrance accessible to |
---|
83 | 83 | | 3.20visitors that states: "Video security cameras are present to record persons and activities." |

84 | 84 | | 3.21 Subd. 7.Commissioner's duties.By October 1, 2025, the commissioner must issue |

85 | 85 | | 3.22templates for the written policy required under subdivision 5 and the notice to parents and |
