1.4 section 363A.03, subdivision 48; proposing coding for new law in Minnesota
1.5 Statutes, chapter 363A.
1.6BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
1.7 Section 1. Minnesota Statutes 2024, section 363A.03, subdivision 48, is amended to read:
1.8 Subd. 48.Unfair discriminatory practice."Unfair discriminatory practice" means any
1.9act described in sections 363A.08 to 363A.19 363A.195 and 363A.28, subdivision 10.
1.10 EFFECTIVE DATE.This section is effective the day following final enactment.
1.11 Sec. 2. [363A.195] DISABILITY DISCRIMINATION PROHIBITED IN PROGRAMS
1.12RECEIVING STATE FINANCIAL ASSISTANCE.
1.13 (a) It is an unfair discriminatory practice for a program or activity receiving state financial
1.14assistance to exclude a qualified disabled person from participation in the program or activity,
1.15deny a qualified disabled person the full and equal enjoyment of any benefits, or otherwise
1.16discriminate against a qualified disabled person because of a disability.
1.17 (b) Each state agency that provides financial assistance to a program or activity shall
1.18ensure that the recipient of financial assistance complies with the requirements of this section
1.19and shall adopt rules as necessary to enforce compliance with this section.
1.20 (c) The provisions of this section shall remain in full force and effect regardless of any
1.21modification, repeal, or reduction in federal disability rights statutes, including but not
