5 | 5 | | 1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: |

6 | 6 | | 1.6 Section 1. Minnesota Statutes 2024, section 144.1222, subdivision 2d, is amended to read: |
---|
7 | 7 | | 1.7 Subd. 2d.Hot tubs on rental houseboats property.(a) Except as provided in paragraph |
---|
8 | 8 | | 1.8(b), a hot water pool intended for seated recreational use, including a hot tub or whirlpool, |
---|
9 | 9 | | 1.9that is located on a houseboat that is rented to the public the property of a stand-alone, |
---|
10 | 10 | | 1.10single-unit rental property, offered for rent by the property owner or through a resort, and |
---|
11 | 11 | | 1.11that is only intended to be used by the occupants of the rental property: |
---|
12 | 12 | | 1.12 (1) is not a public pool and; |
---|
13 | 13 | | 1.13 (2) is exempt from the requirements for public pools under subdivisions 1 to 2c, 4, and |
---|
14 | 14 | | 1.145 and Minnesota Rules, chapter 4717, except as otherwise provided in this paragraph; and |
---|
15 | 15 | | 1.15 (3) may be used by renters so long as: |
---|
16 | 16 | | 1.16 (i) the water temperature in the hot water pool does not exceed 106 degrees Fahrenheit; |
---|
17 | 17 | | 1.17 (ii) prior to check-in by each new rental party, the resort or property owner tests the |
---|
18 | 18 | | 1.18water in the hot water pool for the concentration of chlorine or bromine, pH, and alkalinity, |
---|
19 | 19 | | 1.19and the water in the hot water pool meets the requirements for disinfection residue, pH, and |
---|
20 | 20 | | 1.20alkalinity in Minnesota Rules, part 4717.1750, subparts 4, 5, and 6; and |
---|

36 | 36 | | 2.85 and Minnesota Rules, chapter 4717; and |

37 | 37 | | 2.9 (3) is exempt from the requirements under paragraph (a), clause (3). |

38 | 38 | | 2.10 (c) A political subdivision must not adopt a local law, rule, or ordinance that prohibits |
---|
39 | 39 | | 2.11the operation of, or establishes additional requirements for, a hot water pool that meets the |
---|
40 | 40 | | 2.12criteria in paragraph (a) or (b). |
---|
41 | 41 | | 2.13 (d) A hot water pool under this subdivision must be conspicuously posted with the |
---|
42 | 42 | | 2.14following notice to renters: |
---|
43 | 43 | | 2.15 "NOTICE |
---|
44 | 44 | | 2.16 This spa is exempt from certain state and local sanitary requirements that prevent disease |
---|
45 | 45 | | 2.17transmission. |
---|
