6 | 6 | | 1.6 Section 1. Minnesota Statutes 2024, section 86B.501, subdivision 3, is amended to read: |

7 | 7 | | 1.7 Subd. 3.Grant Allen Law; life jacket required for children.(a) No person may operate |
---|
8 | 8 | | 1.8a watercraft under way with a child under ten years of age aboard unless the child is: |
---|
9 | 9 | | 1.9 (1) wearing an appropriate personal flotation device approved under subdivision 1; or |
---|
10 | 10 | | 1.10 (2) below the top deck or in an enclosed cabin. |
---|
11 | 11 | | 1.11 (b) Paragraph (a) does not apply to commercial watercraft where the child is a passenger |
---|
12 | 12 | | 1.12and the operator is licensed by the state of Minnesota or the United States Coast Guard to |
---|
13 | 13 | | 1.13carry passengers for hire. Paragraph (a) also does not apply if the watercraft is anchored for |
---|
14 | 14 | | 1.14the purpose of swimming or diving. |

15 | 15 | | 1.15 (c) A first violation of this subdivision prior to May 1, 2006, shall not result in a penalty, |

16 | 16 | | 1.16but is punishable only by a safety warning. |
