31	31	2.2state airports fund for system maintenance of
32	32	2.3critical airport safety systems, equipment, and
33	33	2.4essential airfield technology.
34	34	2.5Notwithstanding Minnesota Statutes, section
35	35	2.616A.28, subdivision 6, the appropriation from
36	36	2.7the state airports fund is available for five
37	37	2.8years after the year of the appropriation. If the
38	38	2.9appropriation for either year is insufficient,
39	39	2.10the appropriation for the other year is available
40	40	2.11for it.
41	41	2.12If the commissioner of transportation
42	42	2.13determines that a balance remains in the state
43	43	2.14airports fund following the appropriations
44	44	2.15made in this article and that the appropriations
45	45	2.16made are insufficient for advancing airport
46	46	2.17development and assistance projects, an
47	47	2.18amount necessary to advance the projects, not
48	48	2.19to exceed the balance in the state airports fund,
49	49	2.20is appropriated in each year to the
50	50	2.21commissioner and must be spent according to
51	51	2.22Minnesota Statutes, section 360.305,
52	52	2.23subdivision 4. Within two weeks of a
53	53	2.24determination under this contingent
54	54	2.25appropriation, the commissioner of
55	55	2.26transportation must notify the commissioner
56	56	2.27of management and budget and the chairs,
57	57	2.28ranking minority members, and staff of the
58	58	2.29legislative committees with jurisdiction over
59	59	2.30transportation finance concerning the funds
60	60	2.31appropriated. Funds appropriated under this
61	61	2.32contingent appropriation do not adjust the base
62	62	2.33for fiscal years 2026 and 2027.
