77 1.7BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:​
88 1.8 Section 1. Minnesota Statutes 2024, section 161.32, is amended by adding a subdivision​
99 1.9to read:​
1010 1.10 Subd. 8.Specifications; work zone flaggers.(a) For purposes of this subdivision, "live​
1111 1.11traffic contract" means a contract for trunk highway construction, reconstruction, or​
1212 1.12maintenance, in which it is anticipated that:​
1313 1.13 (1) work zone flaggers are present within the work zone, as defined in section 169.011,​
1414 1.14subdivision 95; and​
1515 1.15 (2) one or more lanes of traffic are open for vehicular travel and are adjacent to the​
1616 1.16location of any workers.​
1717 1.17 (b) The commissioner must include a bid item for flagging hours within the specifications​
1818 1.18for a live traffic contract.​
1919 1.19 EFFECTIVE DATE.This section is effective August 1, 2025, and applies for contracts​
2020 1.20advertised for bids on or after that date.​

2929 Referred to Transportation​ 2.1 Sec. 2. Minnesota Statutes 2024, section 171.055, subdivision 1, is amended to read:​
3030 2.2 Subdivision 1.Requirements for provisional license.(a) The department may issue a​
3131 2.3provisional license, which must be distinctive in appearance from a driver's license, to an​
3232 2.4applicant who:​
3333 2.5 (1) has reached the age of 16 years;​
3434 2.6 (2) during the six months immediately preceding the application for the provisional​
3535 2.7license has possessed an instruction permit and has incurred (i) no convictions for a violation​
3636 2.8of section 169A.20, 169A.33, 169A.35, sections 169A.50 to 169A.53, or section 171.177,​
3737 2.9(ii) no convictions for a crash-related moving violation, and (iii) no convictions for a moving​
3838 2.10violation that is not crash related;​
3939 2.11 (3) has successfully completed:​
4040 2.12 (i) a course of driver education in accordance with department rules; and​
4141 2.13 (ii) a course on work zone and first responder safety as provided under section 171.0701,​
4242 2.14subdivision 1c;​
4343 2.15 (4) completes the required application, which must be approved by (i) either parent when​
4444 2.16both reside in the same household as the minor applicant or, if otherwise, then (ii) the parent​
4545 2.17or spouse of the parent having custody or, in the event there is no court order for custody,​
4646 2.18then (iii) the parent or spouse of the parent with whom the minor is living or, if items (i) to​
4747 2.19(iii) do not apply, then (iv) the guardian having custody of the minor, (v) the foster parent​
4848 2.20or the director of the transitional living program in which the child resides or, in the event​
4949 2.21a person under the age of 18 has no living father, mother, or guardian, or is married or​
5050 2.22otherwise legally emancipated, then (vi) the applicant's adult spouse, adult close family​
5151 2.23member, or adult employer; provided, that the approval required by this clause contains a​
5252 2.24verification of the age of the applicant and the identity of the parent, guardian, adult spouse,​
5353 2.25adult close family member, or adult employer;​
5454 2.26 (5) submits a supervised driving log, in a format approved by the commissioner, that:​
5555 2.27 (i) states that the applicant has driven a motor vehicle accompanied by and under the​
5656 2.28supervision of a licensed driver at least 21 years of age, for no less than 40 total hours or​
5757 2.29as provided in clause (6), item (i), at least 15 of which were nighttime hours;​
5858 2.30 (ii) identifies dates and lengths of driving time for each supervised driving trip; and​
5959 2.31 (iii) is signed by the primary driving supervisor, attesting that the applicant has met the​
6060 2.32requirements under item (i);​
6161 2​Sec. 2.​

6363 3.2 (i) driven a motor vehicle in the manner required under clause (5) for no less than ten​
6464 3.3hours in addition to the total hours specified in clause (5), item (i); or​
6565 3.4 (ii) submitted a certification of supplemental parental curriculum under section 171.05,​
6666 3.5subdivision 2, paragraph (b), for the primary driving supervisor under clause (5), as part of​
6767 3.6an application for an instruction permit; and​
6868 3.7 (7) pays the fee required in section 171.06, subdivision 2.​
6969 3.8 (b) For purposes of this section, "moving violation" has the meaning given it in section​
7070 3.9171.04, subdivision 1.​
7171 3.10 (c) Notwithstanding paragraph (a), clause (2), the commissioner shall must not issue a​
7272 3.11provisional license to a person who has ever incurred a conviction for violation of section​
7373 3.12169A.20, 169A.33, or 169A.35; a violation of a provision of sections 169A.50 to 169A.53;​
7474 3.13a violation of section 171.177; or a crash-related moving violation, and at the time of the​
7575 3.14conviction the person did not possess an instruction permit.​
7676 3.15 EFFECTIVE DATE.This section is effective August 1, 2026, and applies to applications​
7777 3.16submitted on or after that date.​
7878 3.17 Sec. 3. Minnesota Statutes 2024, section 171.0701, is amended by adding a subdivision​
7979 3.18to read:​
8080 3.19 Subd. 1c.Work zone and first responder safety course.(a) The commissioner must​
8181 3.20establish procedures to approve one or more entities with experience on work zone safety​
8282 3.21to provide a course of instruction on work zone and first responder safety.​
8383 3.22 (b) At a minimum, the course must:​
8484 3.23 (1) be at least 30 minutes in length;​
8585 3.24 (2) be provided through online instruction; and​
8686 3.25 (3) include information on:​
8787 3.26 (i) best practices related to a work zone to minimize dangers and provide for the safety​
8888 3.27of workers, first responders, and vehicle operators;​
8989 3.28 (ii) the rights and responsibilities of a vehicle operator in a work zone, including but not​
9090 3.29limited to work zone speed limits under section 169.14 and the authority of a work zone​
9191 3.30flagger under section 169.06, subdivision 4a; and​
9292 3.31 (iii) penalties for violations related to work zones.​

9696 4.3 Subd. 12.Driver's manual; work zone safety.The commissioner must include in the​
9797 4.4driver's manual published by the department a section relating to safe operation in a work​
9898 4.5zone.​
9999 4.6 EFFECTIVE DATE.This section is effective the day following final enactment and​
100100 4.7applies to each edition of the manual published on or after that date.​
101101 4.8 Sec. 5. WORK ZONE SAFETY BILLBOARD DESIGN CONTEST.​
102102 4.9 Using existing resources, the commissioner of transportation must implement a billboard​
103103 4.10design contest for youth that provides for work zone safety education and awareness. The​
104104 4.11design contest must include:​
105105 4.12 (1) a process for youth to submit design proposals to be posted on billboard advertising​
106106 4.13devices;​
107107 4.14 (2) criteria for design proposal review, evaluation, and selection based on education and​
108108 4.15awareness of work zone safety issues that must include consideration of appeal, effectiveness,​
109109 4.16appropriateness, and any other criteria established by the commissioner;​
110110 4.17 (3) promotional activities about the contest; and​
111111 4.18 (4) arrangements as necessary for awarded designs to be installed on billboard advertising​
112112 4.19devices throughout the state.​
