77 1.7REIMBURSEMENT PROGRAM.​
88 1.8 Subdivision 1.Purpose.This section establishes a reimbursement program for​
99 1.9extraordinary law enforcement expenses incurred while responding to protests at the​
1010 1.10Minnesota State Capitol and governor's residence.​
1111 1.11 Subd. 2.Definitions.(a) For purposes of this section, the terms in this subdivision have​
1212 1.12the meanings given.​
1313 1.13 (b) "Applicant" means any municipal or state law enforcement agency providing services​
1414 1.14within the jurisdiction of the Minnesota State Capitol and governor's residence.​
1515 1.15 (c) "Commissioner" means the commissioner of public safety.​
1616 1.16 (d) "Department" means the Department of Public Safety.​
1717 1.17 (e) "Protest" means any public demonstration, march, rally, or gathering exercising first​
1818 1.18amendment rights.​
1919 1.19 Subd. 3.Eligible expenses.Eligible costs are limited to:​

3333 2.4 Subd. 4.Reimbursement process.(a) The commissioner must develop application​
3434 2.5materials for reimbursement and may update the materials as needed. Application materials​
3535 2.6must include instructions and requirements for assistance under this section. These application​
3636 2.7materials are not subject to the rulemaking requirements under Minnesota Statutes, chapter​
3737 2.814.​
3838 2.9 (b) An applicant has 60 days from the end of the protest to request reimbursement. The​
3939 2.10commissioner may deny a late request. The applicant's request must document:​
4040 2.11 (1) the size, location, and length of the protest;​
4141 2.12 (2) the role the agency played in responding to the protest; and​
4242 2.13 (3) a description of eligible expenses incurred by the agency.​
4343 2.14 (c) An applicant must submit to the commissioner completed claims for payment of​
4444 2.15eligible expenses on the forms provided by the commissioner. All eligible expenses claimed​
4545 2.16for payment must be documented and consistent with the eligibility provisions of this section.​
4646 2.17 (d) An applicant may submit additional supporting documentation for up to 60 days​
4747 2.18after the commissioner's acceptance of the initial request for reimbursement.​
4848 2.19 (e) The commissioner shall review the application and supporting documentation for​
4949 2.20completeness and may return the application with a request for more detailed information​
5050 2.21or correction of deficiencies. The commissioner may consult with appropriate governmental​
5151 2.22officials to ensure the application reflects the extent and magnitude of the protest and to​
5252 2.23reconcile any differences. The application is not complete until the commissioner receives​
5353 2.24all requested information.​
5454 2.25 (f) If the commissioner returns an application with a request for more detailed information​
5555 2.26or for correction of deficiencies, the applicant must resubmit the application with all required​
5656 2.27information within 30 days of the applicant's receipt of the commissioner's request. The​
5757 2.28applicant's failure to provide the requested information in a timely manner without a​
5858 2.29reasonable explanation may be cause for denial of the application.​
5959 2.30 (g) The commissioner must approve or deny an application within 30 days of receipt of​
6060 2.31a complete application or the application is deemed approved. If the commissioner approves​
6161 2.32an application or the application is automatically deemed approved after 60 days, the​

6464 3.2an application, the commissioner must provide written notice to the applicant of the denial.​
6565 3.3 Subd. 5.Appeal process.If the commissioner denies an applicant's claim for payment,​
6666 3.4the applicant has 30 days from receipt of the commissioner's determination to appeal in​
6767 3.5writing to the commissioner. The appeal must include the applicant's rationale for reversing​
6868 3.6the commissioner's determination. The commissioner has 30 days from receipt of the appeal​
6969 3.7to uphold or modify the commissioner's determination and formally respond to the applicant.​
7070 3.8If no written request for appeal is received, the determination is final. The applicant is​
7171 3.9entitled to judicial review under Minnesota Statutes, sections 14.63 to 14.68, in the same​
7272 3.10manner that a person aggrieved by a final decision in a contested case is entitled to judicial​
7373 3.11review. The commissioner's determination under this section shall be a final decision of the​
7474 3.12department for purposes of Minnesota Statutes, sections 14.63 to 14.68.​
7575 3.13 Subd. 6.Report.Beginning January 15, 2027, the commissioner shall submit an annual​
7676 3.14report to the chairs and ranking minority members of the legislative committees with​
7777 3.15jurisdiction over public safety policy and finance on the extraordinary law enforcement​
7878 3.16expense reimbursement program. The report must detail the reimbursements awarded,​
7979 3.17including the law enforcement agencies that received reimbursement funds and the amount​
8080 3.18of each reimbursement award.​
8181 3.19 Sec. 2. APPROPRIATION; EXTRAORDINAR Y LAW ENFORCEMENT EXPENSE​
8282 3.20REIMBURSEMENT PROGRAM.​
8383 3.21 $....... in fiscal year 2026 and $....... in fiscal year 2027 are appropriated from the general​
8484 3.22fund to the commissioner of public safety to fund the extraordinary law enforcement expense​
8585 3.23reimbursement program. This amount is added to the agency's base.​
8686 3.24 Sec. 3. EFFECTIVE DATE.​
8787 3.25 This act is effective July 1, 2025.​
