55 1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:​
66 1.6 Section 1. Minnesota Statutes 2024, section 37.16, is amended to read:​
77 1.7 37.16 RULES; VIOLATION.​
88 1.8 The society may make all bylaws, ordinances, and rules consistent with law which it​
99 1.9considers necessary or proper for the government of the fairgrounds and all fairs to be held​
1010 1.10on them, and for the protection, health, safety, and comfort of the public on the fairgrounds​
1111 1.11provided no bylaw, ordinance, or rule prohibits the lawful carry or possession of firearms​
1212 1.12consistent with section 624.714. The bylaws, ordinances, and rules are effective when filed​
1313 1.13with the secretary of the society. The violation of a bylaw, rule, or ordinance of the society​
1414 1.14is a misdemeanor.​
1515 1.15 EFFECTIVE DATE.This section is effective August 1, 2025.​
1616 1.16 Sec. 2. Minnesota Statutes 2024, section 624.714, subdivision 17, is amended to read:​
1717 1.17 Subd. 17.Posting; trespass.(a) A person carrying a firearm on or about his or her person​
1818 1.18or clothes under a permit or otherwise who remains at a private establishment knowing that​
1919 1.19the operator of the establishment or its agent has made a reasonable request that firearms​
2020 1.20not be brought into the establishment may be ordered to leave the premises. A person who​
2121 1.21fails to leave when so requested is guilty of a petty misdemeanor. The fine for a first offense​

3232 2.3 (b) As used in this subdivision, the terms in this paragraph have the meanings given.​
3333 2.4 (1) "Reasonable request" means a request made under the following circumstances:​
3434 2.5 (i) the requester has prominently posted a conspicuous sign at every entrance to the​
3535 2.6establishment containing the following language: "(INDICATE IDENTITY OF OPERATOR)​
3636 2.7BANS GUNS IN THESE PREMISES."; or​
3737 2.8 (ii) the requester or the requester's agent personally informs the person that guns are​
3838 2.9prohibited in the premises and demands compliance.​
3939 2.10 (2) "Prominently" means readily visible and within four feet laterally of the entrance​
4040 2.11with the bottom of the sign at a height of four to six feet above the floor.​
4141 2.12 (3) "Conspicuous" means lettering in black arial typeface at least 1-1/2 inches in height​
4242 2.13against a bright contrasting background that is at least 187 square inches in area.​
4343 2.14 (4) "Private establishment" means a building, structure, or portion thereof that is owned,​
4444 2.15leased, controlled, or operated by a nongovernmental entity for a nongovernmental purpose.​
4545 2.16 (5) "Governmental entity" includes but is not limited to the State Agricultural Society​
4646 2.17when it conducts activities on the State Fairgrounds consistent with the public purposes​
4747 2.18identified in section 37.01.​
4848 2.19 (c) The owner or operator of a private establishment may not prohibit the lawful carry​
4949 2.20or possession of firearms in a parking facility or parking area.​
5050 2.21 (d) The owner or operator of a private establishment may not prohibit the lawful carry​
5151 2.22or possession of firearms by a peace officer, as defined in section 626.84, subdivision 1,​
5252 2.23paragraph (c), within the private establishment or deny the officer access thereto, except​
5353 2.24when specifically authorized by statute. The owner or operator of the private establishment​
5454 2.25may require the display of official credentials issued by the agency that employs the peace​
5555 2.26officer prior to granting the officer entry into the private establishment.​
5656 2.27 (e) This subdivision does not apply to private residences. The lawful possessor of a​
5757 2.28private residence may prohibit firearms, and provide notice thereof, in any lawful manner.​
5858 2.29 (f) A landlord may not restrict the lawful carry or possession of firearms by tenants or​
5959 2.30their guests.​

6262 3.2forth the exclusive criteria to notify a permit holder when otherwise lawful firearm possession​
6363 3.3is not allowed in a private establishment and sets forth the exclusive penalty for such activity.​
6464 3.4 (h) This subdivision does not apply to a security guard acting in the course and scope​
6565 3.5of employment. The owner or operator of a private establishment may require the display​
6666 3.6of official credentials issued by the company, which must be licensed by the Private Detective​
6767 3.7and Protective Agent Services Board, that employs the security guard and the guard's permit​
6868 3.8card prior to granting the guard entrance into the private establishment.​
6969 3.9 EFFECTIVE DATE.This section is effective August 1, 2025.​
