4 | 4 | | 1.4BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: |

5 | 5 | | 1.5 Section 1. [609.73] RESIDENTIAL PROTESTING. |
---|
6 | 6 | | 1.6 Subdivision 1.Residential protesting.A person who protests before or about the |
---|
7 | 7 | | 1.7residence or dwelling of any person, except when the residence or dwelling is used as a |
---|
8 | 8 | | 1.8place of business, commits residential protesting and may be sentenced as provided in |
---|
9 | 9 | | 1.9subdivision 2. This section does not prohibit the peaceful protesting of the place of holding |
---|
10 | 10 | | 1.10a meeting or assembly on premises commonly used to discuss subjects of general public |
---|
11 | 11 | | 1.11interest. |
---|
12 | 12 | | 1.12 Subd. 2.Penalty.(a) Except as otherwise provided in paragraph (b), a person who |
---|
13 | 13 | | 1.13violates this section is guilty of a misdemeanor. |
---|
14 | 14 | | 1.14 (b) A person is guilty of a gross misdemeanor if the person violates this section: |
---|
15 | 15 | | 1.15 (1) after a previous conviction under this section; or |
---|
16 | 16 | | 1.16 (2) when the person is the subject of any of the following court orders directing the |
---|
17 | 17 | | 1.17person to cease or avoid the harassment of an occupant of the residential building or to have |
---|
18 | 18 | | 1.18no contact with an occupant of the residential building, and the respondent knows of the |
---|
19 | 19 | | 1.19order: |

20 | 20 | | 1.20 (i) an order for protection issued under section 518B.01; |
---|
21 | 21 | | 1.21 (ii) a restraining order issued pursuant to section 609.748; |
---|
