5 | 5 | | 1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: |

6 | 6 | | 1.6 Section 1. FUND TRANSFERS FOR FISCAL YEARS 2025 THROUGH 2029. |

7 | 7 | | 1.7 Notwithstanding Minnesota Statutes, section 123B.80, subdivision 3, or any law to the |
---|
8 | 8 | | 1.8contrary, for fiscal years 2025 through 2029 only, a school district, charter school, or |
---|
9 | 9 | | 1.9cooperative unit may transfer any funds not already assigned to or encumbered by staff |
---|
10 | 10 | | 1.10salary and benefits, or otherwise encumbered by federal law, from any operating account |
---|
11 | 11 | | 1.11or operating fund to the undesignated balance in any other operating account or operating |
---|
12 | 12 | | 1.12fund. A fund or account transfer under this section must not increase state aid obligations |
---|
13 | 13 | | 1.13to the district or school, or result in additional property tax authority for the district. The |
---|
14 | 14 | | 1.14school board must adopt a written resolution outlining the purpose for and specifying the |
---|
15 | 15 | | 1.15amount of funds that are transferred under this section. A school board must post the |
---|
16 | 16 | | 1.16resolution for each approved transfer on its website and must transmit a timely, electronic |
---|
17 | 17 | | 1.17notice of each approved transfer to the commissioner. |

18 | 18 | | 1.18 EFFECTIVE DATE.This section is effective the day following final enactment. |
