55 1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:​
66 1.6 Section 1. FUND TRANSFERS FOR FISCAL YEARS 2025 THROUGH 2029.​
77 1.7 Notwithstanding Minnesota Statutes, section 123B.80, subdivision 3, or any law to the​
88 1.8contrary, for fiscal years 2025 through 2029 only, a school district, charter school, or​
99 1.9cooperative unit may transfer any funds not already assigned to or encumbered by staff​
1010 1.10salary and benefits, or otherwise encumbered by federal law, from any operating account​
1111 1.11or operating fund to the undesignated balance in any other operating account or operating​
1212 1.12fund. A fund or account transfer under this section must not increase state aid obligations​
1313 1.13to the district or school, or result in additional property tax authority for the district. The​
1414 1.14school board must adopt a written resolution outlining the purpose for and specifying the​
1515 1.15amount of funds that are transferred under this section. A school board must post the​
1616 1.16resolution for each approved transfer on its website and must transmit a timely, electronic​
1717 1.17notice of each approved transfer to the commissioner.​
1818 1.18 EFFECTIVE DATE.This section is effective the day following final enactment.​
1919 1.19 Sec. 2. RELIEF FROM STATE MANDATES FOR SCHOOL YEARS 2025-2026​

4242 2.12 (2) an amendment to a law under clause (1), enacted during the 2023 or 2024 legislative​
4343 2.13session.​
4444 2.14 (c) Upon a recorded vote, a school board that formally resolves not to comply with a​
4545 2.15newly enacted or newly amended state law or rule as defined in paragraph (b) must post a​
4646 2.16record of each decision to not comply on its website and transmit to the commissioner an​
4747 2.17electronic notice of each decision.​
4848 2.18 EFFECTIVE DATE.This section is effective the day following final enactment.​
