6 | 6 | | 1.6 Section 1. Minnesota Statutes 2024, section 243.166, subdivision 1b, is amended to read: |

7 | 7 | | 1.7 Subd. 1b.Registration required.(a) A person shall register under this section if: |
---|
8 | 8 | | 1.8 (1) the person was charged with or petitioned for a felony violation of or attempt to |
---|
9 | 9 | | 1.9violate, or aiding, abetting, or conspiracy to commit, any of the following, and convicted |
---|
10 | 10 | | 1.10of or adjudicated delinquent for that offense or another offense arising out of the same set |
---|
11 | 11 | | 1.11of circumstances: |
---|
12 | 12 | | 1.12 (i) murder under section 609.185, paragraph (a), clause (2); |
---|
13 | 13 | | 1.13 (ii) kidnapping under section 609.25; |
---|
14 | 14 | | 1.14 (iii) criminal sexual conduct under section 609.342; 609.343; 609.344; 609.345; 609.3451, |
---|
15 | 15 | | 1.15subdivision 3, paragraph (b); or 609.3453; |
---|
16 | 16 | | 1.16 (iv) indecent exposure under section 617.23, subdivision 3; or |
---|
17 | 17 | | 1.17 (v) surreptitious intrusion under the circumstances described in section 609.746, |
---|
18 | 18 | | 1.18subdivision 1, paragraph (h); |
---|
19 | 19 | | 1.19 (2) the person was charged with or petitioned for a violation of, or attempt to violate, or |
---|
20 | 20 | | 1.20aiding, abetting, or conspiring to commit any of the following and convicted of or adjudicated |
---|
21 | 21 | | 1.21delinquent for that offense or another offense arising out of the same set of circumstances: |

---|
42 | 42 | | 2.13 (4) the person was charged with or petitioned for, including pursuant to a court martial, |
---|
43 | 43 | | 2.14violating a law of the United States, including the Uniform Code of Military Justice, similar |
---|
44 | 44 | | 2.15to an offense or involving similar circumstances to an offense described in clause (1), (2), |
---|
45 | 45 | | 2.16or (3), and convicted of or adjudicated delinquent for that offense or another offense arising |
---|
46 | 46 | | 2.17out of the same set of circumstances. |
---|
47 | 47 | | 2.18 (b) A person also shall register under this section if: |
---|
48 | 48 | | 2.19 (1) the person was charged with or petitioned for an offense in another state similar to |
---|
49 | 49 | | 2.20an offense or involving similar circumstances to an offense described in paragraph (a), |
---|
50 | 50 | | 2.21clause (1), (2), or (3), and convicted of or adjudicated delinquent for that offense or another |
---|
51 | 51 | | 2.22offense arising out of the same set of circumstances; |
---|
52 | 52 | | 2.23 (2) the person enters this state to reside, work, or attend school, or enters this state and |
---|
53 | 53 | | 2.24remains for 14 days or longer or for an aggregate period of time exceeding 30 days during |
---|
54 | 54 | | 2.25any calendar year; and |
---|
55 | 55 | | 2.26 (3) ten years have not elapsed since the person was released from confinement or, if the |
---|
56 | 56 | | 2.27person was not confined, since the person was convicted of or adjudicated delinquent for |
---|
57 | 57 | | 2.28the offense that triggers registration, unless the person is subject to a longer registration |
---|
58 | 58 | | 2.29period under the laws of another state in which the person has been convicted or adjudicated, |
---|
59 | 59 | | 2.30or is subject to lifetime registration. |
---|
60 | 60 | | 2.31 If a person described in this paragraph is subject to a longer registration period in another |
---|
61 | 61 | | 2.32state or is subject to lifetime registration, the person shall register for that time period |
---|

65 | 65 | | 3.3 (c) A person also shall register under this section if the person was committed pursuant |
---|
66 | 66 | | 3.4to a court commitment order under Minnesota Statutes 2012, section 253B.185, chapter |
---|
67 | 67 | | 3.5253D, Minnesota Statutes 1992, section 526.10, or a similar law of another state or the |
---|
68 | 68 | | 3.6United States, regardless of whether the person was convicted of any offense. |
---|
69 | 69 | | 3.7 (d) A person also shall register under this section if: |
---|
70 | 70 | | 3.8 (1) the person was charged with or petitioned for a felony violation or attempt to violate |
---|
71 | 71 | | 3.9any of the offenses listed in paragraph (a), clause (1), or a similar law of another state or |
---|
72 | 72 | | 3.10the United States, or the person was charged with or petitioned for a violation of any of the |
---|
73 | 73 | | 3.11offenses listed in paragraph (a), clause (2), or a similar law of another state or the United |
---|
74 | 74 | | 3.12States; |
---|
75 | 75 | | 3.13 (2) the person was found not guilty by reason of mental illness or mental deficiency |
---|
76 | 76 | | 3.14after a trial for that offense, or found guilty but mentally ill after a trial for that offense, in |
---|
77 | 77 | | 3.15states with a guilty but mentally ill verdict; and |
---|
78 | 78 | | 3.16 (3) the person was committed pursuant to a court commitment order under section |
---|
79 | 79 | | 3.17253B.18 or a similar law of another state or the United States. |
---|
80 | 80 | | 3.18 (e) A person also shall register under this section if the person received a stay of |
---|
81 | 81 | | 3.19adjudication under section 609.095, paragraph (b), for a charge of violating section 243.166; |
---|
82 | 82 | | 3.20609.342; 609.343; 609.344; 609.345; 609.3451, subdivision 3; 609.3453; 617.246; or |
---|
83 | 83 | | 3.21617.247, unless the offender is a juvenile and the court finds, on the record, that there is |
---|
84 | 84 | | 3.22good cause to waive the registration requirement. |
