44 1.4BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:​
55 1.5 Section 1. RULEMAKING; LOSS OF VOLUNTARY CONTROL PROVISIONS​
66 1.6MODIFICATION.​
77 1.7 (a) By July 1, 2026, the commissioner of public safety must amend Minnesota Rules,​
88 1.8part 7410.2500, subpart 5, by adding an item F, to no longer require an annual physician's​
99 1.9statement from a driver if:​
1010 1.10 (1) a single nonepileptic seizure was responsible for the driver's loss of consciousness​
1111 1.11or voluntary control;​
1212 1.12 (2) the driver has been free from episodes of loss of consciousness or voluntary control​
1313 1.13for five years from the date of the incident under clause (1);​
1414 1.14 (3) the driver has not been prescribed or taking any antiseizure medication for five years​
1515 1.15from the date of the incident under clause (1); and​
1616 1.16 (4) a physician has indicated that no further review of the driver's condition is necessary​
1717 1.17due to the driver being in good health and the risk of reoccurrence for the condition​
1818 1.18responsible for causing a loss of consciousness or voluntary control is minimal.​
1919 1.19 (b) By July 1, 2026, the commissioner of public safety must amend Minnesota Rules,​

4543 2.13 (d) The commissioner may use the good cause exemption under Minnesota Statutes,​
4644 2.14section 14.388, subdivision 1, clause (3), to adopt rules under this section. Minnesota​
4745 2.15Statutes, section 14.386, does not apply except as provided under Minnesota Statutes, section​
4846 2.1614.388.​
4947 2.17 EFFECTIVE DATE.This section is effective the day following final enactment.​
50-2.18 Sec. 2. APPROPRIATION.​
51-2.19 $11,000 in fiscal year 2026 is appropriated from the driver and vehicle services operating​
52-2.20account under Minnesota Statutes, section 299A.705, to the commissioner of public safety​
53-2.21for the costs of rulemaking under section 1. This is a onetime appropriation.​
