1.1 A bill for an act 1.2 relating to natural resources; authorizing sale or lease of boathouse sites at Soudan 1.3 Underground Mine State Park; amending Laws 2000, chapter 486, section 4, as 1.4 amended. 1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.6 Section 1. Laws 2000, chapter 486, section 4, as amended by Laws 2001, chapter 182, 1.7section 2, and Laws 2017, chapter 93, article 2, section 147, is amended to read: 1.8 Sec. 4. BOATHOUSE LEASES; SOUDAN UNDERGROUND MINE STATE PARK. 1.9 (a) In 1965, United States Steel Corporation conveyed land to the state of Minnesota 1.10that was included in the Soudan underground mine state park, with certain lands at Stuntz 1.11Bay subject to leases outstanding for employee boathouse sites. 1.12 (b) Notwithstanding Minnesota Statutes, sections 85.011, 85.012, subdivision 1, and 1.1386A.05, subdivision 2, upon the expiration of a boathouse lease described under paragraph 1.14(a), the commissioner of natural resources shall offer a new lease to the party in possession 1.15at the time of lease expiration, or, if there has been a miscellaneous lease issued by the 1.16Department of Natural Resources due to expiration of a lease described under paragraph 1.17(a), upon its expiration to the lessee. The new lease shall be issued under the terms and 1.18conditions of Minnesota Statutes, section 92.50, except as follows may: 1.19 (1) the term of the lease shall be for the lifetime of the party being issued a renewed 1.20lease and, if transferred, for the lifetime of the party to whom the lease is transferred; 1.21 (2) the new lease shall provide that the lease may be transferred only once and the transfer 1.22must be to a person within the third degree of kindred or first cousin according to civil law; 1Section 1. 25-02160 as introduced01/13/25 REVISOR CKM/KR SENATE STATE OF MINNESOTA S.F. No. 562NINETY-FOURTH SESSION (SENATE AUTHORS: HAUSCHILD) OFFICIAL STATUSD-PGDATE Introduction and first reading01/23/2025 Referred to Environment, Climate, and Legacy 2.1 (3) the commissioner shall limit the number of lessees per lease to no more than two 2.2persons who have attained legal age; and 2.3 (4) the lease amount must not exceed 50 percent of the average market rate, based on 2.4comparable private lease rates, as determined once every five years per lease. 2.5At the time of the new lease, the commissioner may offer, and after agreement with the 2.6leaseholder, lease equivalent alternative sites to the leaseholder. 2.7 (1) lease the property under the terms and conditions of Minnesota Statutes, section 2.892.50; or 2.9 (2) sell the property. 2.10 (c) The commissioner shall not cancel a boathouse lease described under paragraphs 2.11paragraph (a) and (b) except for noncompliance with the lease agreement. 2.12 (d) The commissioner must issue a written receipt to the lessee for each lease payment. 2.13 (e) The commissioner of natural resources shall contact U.S.X.
