5 | 5 | | 1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: |

6 | 6 | | 1.6 Section 1. Minnesota Statutes 2024, section 97B.001, subdivision 4, is amended to read: |

7 | 7 | | 1.7 Subd. 4.Entering posted land prohibited; signs.(a) Except as provided in subdivision |
---|
8 | 8 | | 1.86, a person may not: |
---|
9 | 9 | | 1.9 (1) enter, for outdoor recreation purposes, any land that is posted under this subdivision |
---|
10 | 10 | | 1.10without first obtaining permission of the owner, occupant, or lessee; or |
---|
11 | 11 | | 1.11 (2) knowingly enter, for outdoor recreation purposes, any land that is posted under this |
---|
12 | 12 | | 1.12subdivision without first obtaining permission of the owner, occupant, or lessee. A person |
---|
13 | 13 | | 1.13who violates this clause is subject to the penalty provided in section 97A.315, subdivision |
---|
14 | 14 | | 1.141, paragraph (b). |
---|
15 | 15 | | 1.15 (b) The owner, occupant, or lessee of private land, or an authorized manager of public |
---|
16 | 16 | | 1.16land may prohibit outdoor recreation on the land by posting signs once each year that: |
---|
17 | 17 | | 1.17 (1) state "no trespassing" or similar terms; |
---|
18 | 18 | | 1.18 (2) display letters at least two inches high; |
---|
19 | 19 | | 1.19 (3) either: |
---|
20 | 20 | | 1.20 (i) are signed by the owner, occupant, lessee, or authorized manager; or |
---|

41 | 41 | | 2.13lessee of private land, or an authorized manager of public land, may prohibit outdoor |

42 | 42 | | 2.14recreation on the land by: |

43 | 43 | | 2.15 (1) applying purple paint to trees along the perimeter of the area to which the person |
---|
44 | 44 | | 2.16wants to prohibit entrance. Paint applied under this paragraph must be applied: |
---|
45 | 45 | | 2.17 (i) at least three feet off the ground; |
---|
46 | 46 | | 2.18 (ii) to trees that are at least one inch wide; and |
---|
47 | 47 | | 2.19 (iii) in a strip that is at least eight inches tall; and |
---|
48 | 48 | | 2.20 (2) posting signs once each year that mark the primary corners of the area to which the |
---|
49 | 49 | | 2.21person wants to prohibit entrance. |
