44 1.4BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:​
55 1.5 Section 1. [117.80] ACTUAL NOTICE REQUIRED; EASEMENTS.​
66 1.6 Notwithstanding any law to the contrary, a local, state, or any other government entity​
77 1.7with an easement over private property must provide actual notice to an owner by mail,​
88 1.8email, or telephone before using the easement. A municipality or state agency failing to​
99 1.9provide actual notice under this section is subject to a civil penalty of $500 per violation.​
1010 1.10An owner aggrieved by a violation of this section may bring an action in district court to​
1111 1.11recover actual damages, any penalties under this section, costs, and reasonable attorney​
1212 1.12fees.​
