1.1 A bill for an act 1.2 relating to human services; modifying an agency's authority with respect to housing 1.3 support agreements; amending Minnesota Statutes 2024, section 256I.04, 1.4 subdivision 2b. 1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.6 Section 1. Minnesota Statutes 2024, section 256I.04, subdivision 2b, is amended to read: 1.7 Subd. 2b.Housing support agreements.(a) Agreements between agencies and providers 1.8of housing support must be in writing on a form developed and approved by the commissioner 1.9and must specify the name and address under which the establishment subject to the 1.10agreement does business and under which the establishment, or service provider, if different 1.11from the establishment, is licensed by the Department of Health or the Department of Human 1.12Services; the specific license or registration from the Department of Health or the Department 1.13of Human Services held by the provider and the number of beds subject to that license; the 1.14address of the location or locations at which housing support is provided under this 1.15agreement; the per diem and monthly rates that are to be paid from housing support funds 1.16for each eligible resident at each location; the number of beds at each location which are 1.17subject to the agreement; whether the license holder is a not-for-profit corporation under 1.18section 501(c)(3) of the Internal Revenue Code; and a statement that the agreement is subject 1.19to the provisions of sections 256I.01 to 256I.06 and subject to any changes to those sections. 1.20 (b) Providers are required to verify the following minimum requirements in the 1.21agreement: 1.22 (1) current license or registration, including authorization if managing or monitoring 1.23medications; 1Section 1. 25-02206 as introduced01/15/25 REVISOR DTT/LJ SENATE STATE OF MINNESOTA S.F. No. 814NINETY-FOURTH SESSION (SENATE AUTHORS: FATEH) OFFICIAL STATUSD-PGDATE Introduction and first reading01/30/2025 Referred to Human Services 2.1 (2) all staff who have direct contact with recipients meet the staff qualifications; 2.2 (3) the provision of housing support; 2.3 (4) the provision of supplementary services, if applicable; 2.4 (5) reports of adverse events, including recipient death or serious injury; 2.5 (6) submission of residency requirements that could result in recipient eviction; and 2.6 (7) confirmation that the provider will not limit or restrict the number of hours an 2.7applicant or recipient chooses to be employed, as specified in subdivision 5. 2.8 (c) Agreements may be terminated with or without cause by the commissioner, the 2.9agency, or the provider with two calendar months prior notice. The commissioner may 2.10immediately terminate an agreement under subdivision 2d. 2.11 (d) Agencies must not refuse to enter into a housing support agreement with providers 2.12of housing support or limit the general availability of housing support agreements to providers 2.13of housing support solely on the basis of any of the following: 2.14 (1) the medical assistance or other publicly funded program under which a potential 2.15resident may receive services, regardless of whether those services are provided on site; or 2.16 (2) the size, capacity, location, zoning classification, or building type of an establishment 2.17not otherwise prohibited under subdivision 2a. 2Section 1. 25-02206 as introduced01/15/25 REVISOR DTT/LJ
