5	5	1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
6	6	1.6 Section 1. Minnesota Statutes 2024, section 256I.04, subdivision 2b, is amended to read:
7	7	1.7 Subd. 2b.Housing support agreements.(a) Agreements between agencies and providers
8	8	1.8of housing support must be in writing on a form developed and approved by the commissioner
9	9	1.9and must specify the name and address under which the establishment subject to the
10	10	1.10agreement does business and under which the establishment, or service provider, if different
11	11	1.11from the establishment, is licensed by the Department of Health or the Department of Human
12	12	1.12Services; the specific license or registration from the Department of Health or the Department
13	13	1.13of Human Services held by the provider and the number of beds subject to that license; the
14	14	1.14address of the location or locations at which housing support is provided under this
15	15	1.15agreement; the per diem and monthly rates that are to be paid from housing support funds
16	16	1.16for each eligible resident at each location; the number of beds at each location which are
17	17	1.17subject to the agreement; whether the license holder is a not-for-profit corporation under
18	18	1.18section 501(c)(3) of the Internal Revenue Code; and a statement that the agreement is subject
19	19	1.19to the provisions of sections 256I.01 to 256I.06 and subject to any changes to those sections.
20	20	1.20 (b) Providers are required to verify the following minimum requirements in the
21	21	1.21agreement:
22	22	1.22 (1) current license or registration, including authorization if managing or monitoring
23	23	1.23medications;

32	32	Referred to Human Services 2.1 (2) all staff who have direct contact with recipients meet the staff qualifications;
33	33	2.2 (3) the provision of housing support;
34	34	2.3 (4) the provision of supplementary services, if applicable;
35	35	2.4 (5) reports of adverse events, including recipient death or serious injury;
36	36	2.5 (6) submission of residency requirements that could result in recipient eviction; and
37	37	2.6 (7) confirmation that the provider will not limit or restrict the number of hours an
38	38	2.7applicant or recipient chooses to be employed, as specified in subdivision 5.
39	39	2.8 (c) Agreements may be terminated with or without cause by the commissioner, the
40	40	2.9agency, or the provider with two calendar months prior notice. The commissioner may
41	41	2.10immediately terminate an agreement under subdivision 2d.
42	42	2.11 (d) Agencies must not refuse to enter into a housing support agreement with providers
43	43	2.12of housing support or limit the general availability of housing support agreements to providers
44	44	2.13of housing support solely on the basis of any of the following:
45	45	2.14 (1) the medical assistance or other publicly funded program under which a potential
46	46	2.15resident may receive services, regardless of whether those services are provided on site; or
47	47	2.16 (2) the size, capacity, location, zoning classification, or building type of an establishment
48	48	2.17not otherwise prohibited under subdivision 2a.
