Thisbillestablishesthe"KratomConsumerProtectionAct",which
requiresdealerswhoprepare,distribute,sell,orexposeforsale
afoodthatisrepresentedtobeakratomproducttodiscloseon
theproductlabelthebasisonwhichthisrepresentation ismade.
Adealerisprohibitedfrompreparing,distributing,selling,or
exposingforsaleakratomproductthatdoesnotconformtothese
labelingrequirements.
Adealermaynotprepare,distribute,sellorexposeforsalea
kratomproductthatisadulteratedorcontaminatedwithadangerous
non-kratomsubstance,containsalevelof7-hydroxymitragynine in
thealkaloidfractionthatisgreaterthan2%compositionofthe
product,containinganysyntheticalkaloids,ordoesnotincludeon
itspackageorlabeltheamountofmitragynine,7-
hydroxymitragynine, orothersyntheticallyderivedcompoundsofthe
plantMitragynaspeciosa.
Adealermaynotdistribute,sellorexposeforsaleakratom
producttoanyoneunder18yearsofage.Thebillspecifies
penaltiesforaviolationofthelabelingrequirementsandallows
forapersonwhoisaggrievedbyaviolationofthelabeling
requirementstobringacauseofactionfordamagesresultingfrom
theviolation.

PROPONENTS: Supporterssaythatkratomproductshavebeenshownto
havebeneficialeffects,includingpainrelief.Kratomproducts
canbeasaferalternativetoopioiddrugs.However,thereare
currentlynodirectstateregulationsofkratomproducts. Thiscan
resultindishonestorotherwisemisleadingbusinesspractices.
Productsmaybeinappropriately labeledorsoldaskratomproducts
whentheyarecontaminatedoroflowquality. Thisbillprovidesa
simpleregulatoryframeworktoensuretheproductionandsaleof
kratomproductsmeetsminimumstandardstoensuresafetyand
honestyinthesaleandofferingoftheseproducts.
