Thisbillprohibitsanycounty,municipality,orpolitical
subdivisionfromimposingorenforcingamoratoriumoneviction
proceedingsunlessspecificallyauthorizedbystatelaw.
Thefollowingisasummaryofthepublictestimonyfromthe
committeehearing. Thetestimonywasbasedontheintroduced
versionofthebill.
PROPONENTS: Supporterssaythatthefederalgovernmentimplemented
anevictionmoratoriumandforaboutayearlandlordscouldnot
evictfornonpaymentofrent,whichisthecauseofmostevictions.
Thepurposeofowningarentalpropertyistoreceiverentandnot
allowingalandlordtoevictisaviolationofcontractlaw.Mom
andpopinvestorsconstitutealmosthalfofrentalownersinthe
U.S.Mostlandlordsdonothaveaccesstocreditandwould
struggleinanemergency. Peoplehaveamisconceptionthatmost
landlordsarecorporationsbutthatisnottrue.Thesearesmall
investorswhoplantousethisfortheirkids’collegetuition.
Manystateshaveenactedtheirownevictionmoratoriums. Whenthe
moratoriumwasputintoplaceoriginally,moneywassetasideto
helpwiththatbutalotofstatesdidn’tgetallthemoneyandit
didn’treachthelandlords.
