Torepealsection442.404,RSMo,andtoenactinlieuthereofthreenewsectionsrelatingto
regulationofrealproperty.
BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows:
SectionA.Section442.404,RSMo,isrepealedandthreenewsectionsenactedinlieu
2thereof,tobeknownassections436.337,442.404,and535.012,toreadasfollows:
436.337.Notwithstandinganyotherprovisionoflaw,nopoliticalsubdivision
2shallrequireapropertyownertohaveahomeinspectionconductedofaresidential
3propertyregardingthesaleoftheproperty.Thisprovisionshallnotapplytoany
4inspectionrequirementofnewconstructionoroccupancypermits.
442.404.1.Asusedinthissection,thefollowingtermsshallmean:
2 (1)"Homeowners'association",anonprofitcorporationorunincorporatedassociation
3ofhomeownerscreatedunderadeclarationtoownandoperateportionsofaplanned
4communityorotherresidentialsubdivisionthathasthepowerunderthedeclarationtoassess
5associationmemberstopaythecostsandexpensesincurredintheperformanceofthe
6association'sobligationsunderthedeclarationortenants-in-commonwithrespecttothe
7ownershipofcommongroundoramenitiesofaplannedcommunityorotherresidential
8subdivision.Thistermshallnotincludeacondominiumunitowners'associationasdefined
9andprovidedforinsubdivision(3)ofsection448.1-103oraresidentialcooperative;
10 (2)"Politicalsigns",anyfixed,ground-mounteddisplayinsupportoforinopposition
11toapersonseekingelectedofficeoraballotmeasureexcludinganymaterialsthatmaybe
12attached.
EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis
intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 13 2.(1)Nodeedrestrictions,covenants,orsimilarbindingagreementsrunningwith
14thelandshallprohibitorhavetheeffectofprohibitingthedisplayofpoliticalsigns.
15 [3.](2)Ahomeowners'associationhastheauthoritytoadoptreasonablerules,
16subjecttoanyapplicablestatutesorordinances,regardingthetime,size,place,number,and
17mannerofdisplayofpoliticalsigns.
18 [4.](3)Ahomeowners'associationmayremoveapoliticalsignwithoutliabilityif
19suchsignisplacedwithinthecommonground,threatensthepublichealthorsafety,violates
20anapplicablestatuteorordinance,isaccompaniedbysoundormusic,orifanyother
21materialsareattachedtothepoliticalsign.Subjecttotheforegoing,ahomeowners'
22associationshallnotremoveapoliticalsignfromthepropertyofahomeownerorimposeany
23fineorpenaltyuponthehomeownerunlessithasgivensuchhomeownerthreedaysafter
24providingwrittennoticetothehomeowner,whichnoticeshallspecificallyidentifytherule
25andthenatureoftheviolation.
26 3.(1)Nodeedrestrictions,covenants,orsimilarbindingagreementsrunning
27withthelandshallprohibitorhavetheeffectofprohibitingthedisplayofsalesignson
28thepropertyofahomeownerornearbystreetcorners.
29 (2)Ahomeowners'associationhastheauthoritytoadoptreasonablerules,
30subjecttoanyapplicablestatutesorordinances,regardingthetime,size,place,number,
31andmannerofdisplayofsalesigns.
32 (3)Ahomeowners'associationmayremoveasalesignwithoutliabilityifsuch
33signisplacedwithinthecommonground,threatensthepublichealthorsafety,violates
34anapplicablestatuteorordinance,isaccompaniedbysoundormusic,orifanyother
35materialsareattachedtothesalesign.Subjecttotheforegoing,ahomeowners'
36associationshallnotremoveasalesignfromthepropertyofahomeownerorimpose
37anyfineorpenaltyuponthehomeownerunlessithasgivensuchhomeownerthreedays
38afterprovidingwrittennoticetothehomeowner,whichnoticeshallspecificallyidentify
39theruleandthenatureoftheviolation.
535.012.Nocounty,municipality,orotherpoliticalsubdivisionshallimposeor
2enforceamoratoriumonevictionproceedingsunlessspecificallyauthorizedbystate
3law.
