SectionA.Section161.670,RSMo,isrepealedandonenewsectionenactedinlieu
2thereof,tobeknownassection161.670,toreadasfollows:
161.670.1.Notwithstandinganyotherlaw,priortoJuly1,2007,thestateboardof
2educationshallestablishthe"MissouriCourseAccessandVirtualSchoolProgram"toserve
3school-agestudentsresidinginthestate.TheMissouricourseaccessandvirtualschool
4programshalloffernonclassroom-basedinstructioninavirtualsettingusingtechnology,
5intranet,[and/or] orinternetmethodsofcommunication.Anystudentundertheageof
6twenty-oneingradeskindergartenthroughtwelvewhoresidesinthisstateshallbeeligibleto
7enrollintheMissouricourseaccessandvirtualschoolprogrampursuanttosubsection3of
8thissection.
9 2.Forpurposesofcalculationanddistributionofstateschoolaid,studentsenrolledin
10theMissouricourseaccessandvirtualschoolprogramshallbeincludedinthestudent
11enrollmentofthe[schooldistrict] localeducationagency(LEA)inwhichthestudent
12physicallyisenrolledundersubsection3ofthissection.TheMissouricourseaccessand
13virtualschoolprogramshallreporttothe[district] LEAofresidencethefollowing
14informationabouteachstudentservedbytheMissouricourseaccessandvirtualschool
15program:name,address,eligibilityforfreeorreduced-pricelunch,limitedEnglish
16proficiencystatus,specialeducationneeds,andthenumberofcoursesinwhichthestudentis
17enrolled.TheMissouricourseaccessandvirtualschoolprogramshallpromptlynotifythe
18resident[district] LEAwhen[a]anystudentdiscontinuesenrollment.A"full-time
EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis
intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 19equivalentstudent"isastudentwho[successfullyhascompleted] isenrolledinthe
20instructionalequivalentofsixcreditsperregularterm.EachMissouricourseaccessand
21virtualschoolprogramcourseshallcountasoneclassandshallgeneratethatportionofafull-
22timeequivalentthatacomparablecourseofferedbythe[schooldistrict] LEAwould
23generate.Full-timeequivalentstudentsshallnotberequiredbytheresidentLEAtobe
24presentatanyspecificphysicallocationforanyongoinginstructionalactivity.Innocase
25shallmorethanthefull-timeequivalencyofaregulartermofattendanceforasinglestudent
26beusedtoclaimstateaid.Full-timeequivalentstudentcreditcompletedshallbereportedto
27thedepartmentofelementaryandsecondaryeducationinthemannerprescribedbythe
28department.IfanLEAfailstomakeanypaymentrequiredundertheprovisionsofthis
29sectioninfullwithinsixtydaysofreceivinganinvoiceforsuchpaymentfroma
30provider,theprovidermaynotifythedepartment.Uponnoticeofsuchnonpayment,the
31departmentshallimmediatelypaytheMissouricourseaccessandvirtualschool
32programthetotalamountinvoiced.Anysuchdepartmentpaymentsshallbeoffsetby
33withholdingtheamountsopaidfromitsnextdisbursementoffundingtothenonpaying
34LEA.ByNovemberfirstannually,thedepartmentshallprovideawrittenreporttothe
35jointcommitteeoneducationdetailingeachoccasionduringthepriorschoolyearthata
36providernotifiedthedepartmentofanunpaidinvoiceunderthissubsection,including
37thenameoftheprovider,thenameoftheLEA,theamountdue,andhowquicklythe
38departmentmadefullpaymenttotheproviderafterreceivingtherequest.Nothingin
39thissectionshallprohibitstudentsfromenrollinginadditionalcoursesunderaseparate
40agreementthatincludestermsforpayingtuitionorcoursefees.Afull-timevirtualschool
41programservingfull-timeequivalentstudentsshallparticipateinthestatewide
42assessmentsystemasdefinedinsection160.518.Theacademicperformanceof
43studentsenrolledinafull-timevirtualschoolprogramshallbeassignedtothe
44designatedattendancecenterofthefull-timevirtualschoolprogramandsuchacademic
45performanceshallnotbeattributabletotheLEA.
46 3.(1)A[schooldistrictorcharterschool] LEAshallallowany[eligible] student
47whoiseligibletoenrollinaMissouripublicschoolandwhoresidesinsuch[district] LEA
48toenrollinMissouricourseaccessandvirtualschoolprogramcoursesof[hisorher]the
49student'schoiceasapartofthestudent'sannualcourseloadeachschoolyearorinafull-
50timevirtualschooloption[, withanycostsassociatedwithsuchcourseorcoursestobepaid
51bytheschooldistrictorcharterschoolif:
52 (a)Thestudentisenrolledfull-timeinandhasattended,foratleastonesemester
53immediatelypriortoenrollingintheMissouricourseaccessandvirtualschoolprogram,a
54publicschool,includinganycharterschool;exceptthat,nostudentseekingtoenrollin
55Missouricourseaccessandvirtualschoolprogramcoursesunderthissubdivisionshallbe

57documentedmedicalorpsychologicaldiagnosisorconditionthatpreventedthestudentfrom
58attendingaschoolinthecommunityduringtheprevioussemester;and
59 (b)PriortoenrollinginanyMissouricourseaccessandvirtualschoolprogram
60course,astudenthasreceivedapprovalfromhisorherschooldistrictorcharterschool
61throughtheproceduredescribedundersubdivision(2)ofthissubsection].
62 (2)[Eachschooldistrictorcharterschool] Forstudentsnotenrolledinafull-time
63virtualschool,theLEAshalladoptapolicythatdelineatestheprocessbywhichastudent
64mayenrollincoursesprovidedbytheMissouricourseaccessandvirtualschoolprogramthat
65issubstantiallysimilartothetypicalprocessbywhicha[district] studentwouldenrollin
66coursesofferedbythe[schooldistrictandacharterschoolstudentwouldenrollincourses
67offeredbythecharterschool] LEA.Thepolicyshallallowforcontinuousenrollment
68throughouttheschoolyear. Thepolicymayincludeconsultationwiththeschool's
69counselorandmayincludeparentalnotificationorauthorization.[Schoolcounselorsshall
70notberequiredtoapproveordisapproveastudent'senrollmentintheMissouricourseaccess
71andvirtualschoolprogram.] Forstudentsnotenrolledinafull-timevirtualschool,the
72policymayincludetherightfortheLEAtodisapprovetherequestedcourseenrollment
73orenrollmentsiftheLEAdeterminesenrollmentinthecourseorcoursesisnotinthe
74besteducationalinterestsofthespecificstudent.IfaLEAdisapprovesarequested
75enrollmentinacourseorcourses,theLEAshallpresenttothestudent'sparentor
76guardianthereasoninwritingspecifictothatstudentandthatstudent'seducational
77situation.Astudent'sparentorguardianshallhavetherighttoappealanysuchdenial
78totheschoolboardorgoverningboardofaLEAatthenextboardmeetingwherethe
79studentorthestudent'sparentorguardianshallbegiventheopportunitytopresent
80theirreasonsforseekingtheenrollment.Theparentorguardianmay,attheparent'sor
81guardian'soption,delaytheagendaitemtoasubsequentboardmeetingifthenext
82boardmeetingdoesnotprovideenoughnoticefortheparentorguardiantopreparefor
83suchappearance.TheresidentLEAshallnotbaseanyrecommendationuponfinancial
84considerationsortheofferingofvirtualcoursesorprogrammingbytheLEAora
85preferredprovider.Forstudentsenrollingintoafull-timeprogram,theLEAoperating
86theprogramshalladoptapolicythatdescribestheprocessbywhichastudentmay
87enrollthatissubstantiallysimilartothetypicalprocessbywhichtheLEAenrollsanew
88residentstudentoftheLEA.Ifthe[schooldistrictorcharterschooldisapproves] student's
89residentLEAbelievesastudent's[requesttoenrollinacourseorcoursesprovidedbythe
90Missouricourseaccessandvirtualschoolprogram,includingfull-timeenrollmentincourses
91providedbytheMissouricourseaccessandvirtualschoolprogram,] enrollmentintoafull-
92timevirtualschoolprogramisnotinthebesteducationalinterestofthestudent,the
HCSHB1903	3 93reasonshallbeprovidedinwriting[anditshallbeforgoodcause.Goodcausejustificationto
94disapproveastudent'srequestforenrollmentinacourseshallbeadeterminationthatdoing
95soisnotinthebesteducationalinterestofthestudent.Incasesofdenialbytheschooldistrict
96orcharterschool,localeducationagenciesshallinformthestudentandthestudent'sfamilyof
97theirrighttoappealanyenrollmentdenialintheMissouricourseaccessandvirtualschool
98programtothelocalschooldistrictboardorcharterschoolgoverningbodywherethefamily
99shallbegivenanopportunitytopresenttheirreasonsfortheirchildorchildrentoenrollinthe
100Missouricourseaccessandvirtualschoolprograminanofficialschoolboardmeeting.In
101addition,theschooldistrictorcharterschooladministrationshallprovideitsgoodcause
102justificationfordenialataschoolboardmeetingorgoverningbodymeeting.Boththefamily
103andschooladministrationshallalsoprovidetheirreasonsinwritingtothemembersofthe
104schoolboardorgoverningbodyandthedocumentsshallbeenteredintotheofficialboard
105minutes.Themembersoftheboardorgoverningbodyshallissuetheirdecisioninwriting
106withinthirtycalendardays,andthenanappealmaybemadetothedepartmentofelementary
107andsecondaryeducation,whichshallprovideafinalenrollmentdecisionwithinseven
108calendardays]tothestudent'sparentorguardianwhoshallhavefinaldecision-making
109authority.
110 (3)ForstudentsenrolledinanyMissouricourseaccessandvirtualschoolprogram
111courseinwhichcostsassociatedwithsuchcoursearetobepaidbythe[schooldistrictor
112charterschool] LEAasdescribedundersubdivision(1)ofthissubsection,the[schooldistrict
113orcharterschool] LEAorthedepartmentshallpaythecontentproviderdirectly[onapro
114ratamonthlybasisbasedonastudent'scompletionofassignmentsandassessments] atthe
115endofeachsemesteruponthereceiptofaninvoice. [Ifastudentdiscontinuesenrollment,
116thedistrictorcharterschoolmaystopmakingmonthlypaymentstothecontentprovider.]
117Eachsuchpaymentshallbemadeinfullwithinsixtydaysofreceivinganinvoicefrom
118theprovider.TheprovidershallinvoicetheLEAforthosedays,onaproratabasis,
119thatthestudentwasenrolledinthecourseorvirtualschoolprogram.No[schooldistrict
120orcharterschool] LEAshallpay,foranyonecourseforastudent,[morethanthemarket
121necessarycostsbutinnocaseshallpay]morethanfourteenpercentofthestateadequacy
122target,asdefinedundersection163.011,ascalculatedattheendofthemostrecentschool
123yearforanysingle,year-longcourseandnomorethansevenpercentofthestateadequacy
124targetasdescribedaboveforanysinglesemesterequivalentcourse.Paymentforafull-time
125virtualschoolstudentshallnotexceedthestateadequacytarget,unlessthestudentreceives
126additionalfederalorstateaid,whichshalladditionallybeincludedinthepayment.All
127paymentstovirtualeducationprovidersshallbederivedfromtheaggregateamountof
128statefundingprovidedtotheLEA.Nolocalfundingrevenueshallbeusedtoward
129paymentforastudentenrollinginafull-timeprogram. [Nothinginthissubdivisionshall

131full-timevirtualschoolproviders,particularlyincaseswhereseveralstudentsenrollina
132singlecourseorfull-timevirtualschool.]
133 (4)InthecaseofastudentwhoisacandidateforA+tuitionreimbursementand
134takingavirtualcourseunderthissection,theschoolshallattributenolessthanninety-five
135percentattendancetoanysuchstudentwhohascompletedsuchvirtualcourse.
136 (5)TheMissouricourseaccessandvirtualschoolprogramshallensurethat
137individuallearningplansdesignedbycertifiedteachersandprofessionalstaffaredeveloped
138forallstudentsenrolledinmorethantwofull-timecourseaccessprogramcoursesorafull-
139timevirtualschool.
140 (6)Thedepartmentshallmonitor[studentsuccessandengagementofstudents
141enrolledintheirprogramandreporttheinformationtotheschooldistrictorcharterschool.
142Providersandthedepartmentmaymakerecommendationstotheschooldistrictorcharter
143schoolregardingthestudent'scontinuedenrollmentintheprogram.Theschooldistrictor
144charterschoolshallconsidertherecommendationsandevaluatetheprogressandsuccessof
145enrolledstudentsthatareenrolledinanycourseorfull-timevirtualschoolofferedunderthis
146sectionandmayterminateoralterthecourseofferingifitisfoundthecourseorfull-time
147virtualschoolisnotmeetingtheeducationalneedsofthestudentsenrolledinthecourse] the
148aggregateperformanceofprovidersandmakesuchinformationavailabletothepublic

150 (7)[Schooldistrictsandcharterschools] Virtualschoolprovidersshallmonitor
151individualstudentprogressandsuccess[, andcourseorfull-timevirtualschoolquality,and
152annuallyprovide] byprovidingfeedbacktothedepartmentofelementaryandsecondary
153education[regardingcoursequality] onaregularbasisandmayremoveastudentunder
154subsection4ofthissectioniftheproviderbelievesittobeinthebesteducationalinterest
155ofthestudent.
156 (8)Pursuanttorulestobepromulgatedbythedepartmentofelementaryand
157secondaryeducation,whenastudenttransfersintoa[schooldistrictorcharterschool] LEA,
158creditspreviouslygainedthroughsuccessfulpassageofapprovedcoursesundertheMissouri
159courseaccessandvirtualschoolprogramshallbeacceptedbythe[schooldistrictorcharter

161 (9)Pursuanttorulestobepromulgatedbythedepartmentofelementaryand

164school], thestudentshallcontinuetobeenrolledinsuchcourseorschool.
165 (10)Nothinginthissectionshallprohibithomeschoolstudents,privateschool

169 (11)Nothinginthissubsectionshallrequireany[schooldistrict,charterschool,]
170LEAorthestatetoprovidecomputers,equipment,orinternetaccesstoanystudentunless
171requiredbyaneligiblestudentwithadisabilitytocomplywithfederallaw.
172 (12)Theauthorizationprocessshallprovideforcontinuousmonitoringofapproved
173providersandcourses.Thedepartmentshallrevokeorsuspendortakeothercorrectiveaction
174regardingtheauthorizationofanycourseorprovidernolongermeetingtherequirementsof
175theprogram.Unlessimmediateactionisnecessary,priortorevocationorsuspension,the
176departmentshallnotifytheproviderandgivetheproviderareasonabletimeperiodtotake

195 (e)Face-to-facecommunicationsormeetingswithschoolstaff;
196 (f)Telephoneorvideoconferenceswithschoolstaff;
197 (g)School-sanctionedfieldtrips;or
198 (h)Orientation.
199 (2)Afull-timevirtualschoolshallsubmitanotificationtotheparentor
200guardianofanystudentwhoisnotconsistentlyengagedininstructionalactivities.
201 (3)Eachfull-timevirtualschoolshalldevelop,adopt,andpostontheschool's
202websiteapolicysettingforththeconsequencesforastudentwhofailstocompletethe
203requiredinstructionalactivities.Suchpolicyshallstate,ataminimum,thatifastudent

205subdivision(2)ofthissubsection,andafterreasonableinterventionstrategieshavebeen
206implemented,thestudentshallbesubjecttocertainconsequencesthatmayinclude
207disenrollmentfromtheschool.Priortoanydisenrollment,theparentorguardianshall
208havetheopportunitytopresentanyinformationthattheparentorguardiandeems
209relevantandsuchinformationshallbeconsideredpriortoanyfinaldecision.
210 (4)Ifafull-timevirtualschooldisenrollsastudentundersubdivision(3)ofthis
211subsection,theschoolshallimmediatelyprovidewrittennotificationtosuchstudent's
212LEAofresidence.Thestudent'sLEAofresidenceshallprovidetotheparentor
213guardianofthestudentawrittenlistofavailableeducationaloptionsandpromptly
214enrollthestudentintheselectedoption.Anystudentdisenrolledfromafull-time
215virtualschoolshallbeprohibitedfromre-enrollinginthesamevirtualschoolforthe

217 [Schooldistrictsorcharterschools] 5.LEAsshall[inform] annuallyissuea
218separatenotificationinformingparentsorguardiansof[their] thechild'srightto
219participateintheprogram.Availabilityoftheprogramshallalsobe[madeclear] providedin
220aclearandconspicuousmannerintheparenthandbook,registrationdocuments,and
221featuredonthehomepageofthe[schooldistrictorcharterschool's] LEA'swebsite.Such
222noticesshallprovideinformationontheprograminanimpartialmannerwithoutany
223favortowardoneproviderorprogramoveranother.AnyLEAthatfailstofullycomply
224withanyprovisionofthissubsectionshallbesubjecttocivilpenaltiesinanamount
225equaltoonehundreddollarsforeachcalendardaytheLEAisnotincompliancewith
226thissubsection,includingreasonableattorney'sfees.
227 [5.]6.Thedepartmentshall:
228 (1)Establishanauthorizationprocessforcourseorfull-timevirtualschoolproviders
229thatincludesmultipleopportunitiesforsubmissioneachyear;
230 (2)Pursuanttothetimelineestablishedbythedepartment,authorizecourseorfull-
231timevirtualschoolprovidersthat:
232 (a)Submitallnecessaryinformationpursuanttotherequirementsoftheprocess;and
233 (b)Meetthecriteriadescribedinsubdivision(3)ofthissubsection;
234 (3)Review,pursuanttotheauthorizationprocess,proposalsfromprovidersto
235provideacomprehensive,full-timeequivalentcourseofstudyforstudentsthroughthe
236Missouricourseaccessandvirtualschoolprogram.Thedepartmentshallensurethatthese
237comprehensivecoursesofstudyaligntostateacademicstandardsandthatthereis
238consistencyandcompatibilityinthecurriculumusedbyallprovidersfromonegradelevelto
239thenextgradelevel;

241anycourseorfull-timevirtualschoolprovidersthataredeniedauthorization.
242 [6.]7.Ifacourseorfull-timevirtualschoolproviderisdeniedauthorization,the
243courseprovidermayreapplyatanypointinthefuture.
244 [7.]8.Thedepartmentshallpublishtheprocessestablishedunderthissection,
245includinganydeadlinesandanyguidelinesapplicabletothesubmissionandauthorization
246processforcourseorfull-timevirtualschoolprovidersonitswebsite.
247 [8.]9.Ifthedepartmentdeterminesthatthereareinsufficientfundsavailablefor
248evaluatingandauthorizingcourseorfull-timevirtualschoolproviders,thedepartmentmay
249chargeapplicantcourseorfull-timevirtualschoolprovidersafeeupto,butnogreaterthan,
250theamountofthecostsinordertoensurethatevaluationoccurs.Thedepartmentshall
251establishandpublishafeescheduleforpurposesofthissubsection.
252 [9.]10.Exceptasspecifiedinthissectionandasmaybespecifiedbyruleofthestate
253boardofeducation,theMissouricourseaccessandvirtualschoolprogramshallcomplywith
254allstatelawsandregulationsapplicableto[schooldistricts] LEAs, includingbutnotlimited
255totheMissourischoolimprovementprogram(MSIP),annualperformancereport(APR),
256teachercertification,andcurriculumstandards.
257 [10.]11.Thedepartmentshallsubmitandpubliclypublishanannualreportonthe
258Missouricourseaccessandvirtualschoolprogramandtheparticipationofentitiestothe
259governor,thechairandrankingmemberofthesenateeducationcommittee,andthechairand
260rankingmemberofthehouseofrepresentativeselementaryandsecondaryeducation
261committee.Thereportshallataminimumincludethefollowinginformation:
262 (1)Theannualnumberofuniquestudentsparticipatingincoursesauthorizedunder
263thissectionandthetotalnumberofcoursesinwhichstudentsareenrolledin;
264 (2)Thenumberofauthorizedproviders;
265 (3)Thenumberofauthorizedcoursesandthenumberofstudentsenrolledineach
266course;
267 (4)Thenumberofcoursesavailablebysubjectandgradelevel;
268 (5)Thenumberofstudentsenrolledincoursesbrokendownbysubjectandgrade

270 (6)Studentoutcomedata,includingcompletionrates,studentlearninggains,student

280andvirtualschoolprogramcatalogprovidingalistingofallcoursesauthorizedandavailable
281tostudentsinthestate,detailedinformation,includingcostspercourse,aboutthecoursesto
282informstudentenrollmentdecisions,andtheabilityforstudentstosubmittheircourse
283enrollments.
284 [12.]13.Thestateboardofeducationthroughtherulemakingprocessandthe
285departmentofelementaryandsecondaryeducationinitspoliciesandproceduresshallensure
286thatmultiplecontentprovidersandlearningmanagementsystemsareallowed,ensuredigital
