4personswhomeettherequirementsofthisstateincluding,butnotlimitedto,sections
5334.031,334.035and334.040,andwhoholdcertificatesoflicensureinanystateorterritory
6oftheUnitedStatesortheDistrictofColumbiaauthorizingthemtopracticeinthesame

34 2.Anypersonwhoholdsavalidcurrentphysicianandsurgeonlicenseissuedby
35anotherstate,abranchorunitofthemilitary,aterritoryoftheUnitedStates,orthe
36DistrictofColumbia,andwhohasbeenlicensedforatleastoneyearinsuchother
37jurisdiction,maysubmittotheboardanapplicationforaphysicianandsurgeonlicense
38inMissourialongwithproofofcurrentlicensureandproofoflicensureforatleastone
39yearintheotherjurisdiction.
40 3.Theboardshall:
41 (1)Withinsixmonthsofreceivinganapplicationdescribedinsubsection2of
42thissection,waiveanyexamination,educational,orexperiencerequirementsfor
43licensureinthisstatefortheapplicantifitdeterminesthattherewereminimum
44educationrequirementsand,ifapplicable,workexperienceandclinicalsupervision
45requirementsineffectandtheotherjurisdictionverifiesthatthepersonmetthose
46requirementsinordertobelicensedorcertifiedinthatjurisdiction.Theboardmay
47requireanapplicanttotakeandpassanexaminationspecifictothelawsofthisstate;or
48 (2)Withinthirtydaysofreceivinganapplicationdescribedinsubsection2of
49thissectionfromanonresidentmilitaryspouseoraresidentmilitaryspouse,waiveany
50examination,educational,orexperiencerequirementsforlicensureinthisstateforthe

52otherwisemeetstherequirementsofthissection.
53 4.(1)Theboardshallnotwaiveanyexamination,educational,orexperience
54requirementsforanyapplicantwhohashadhisorherlicenserevokedbyanoversight
55bodyoutsidethestate;whoiscurrentlyunderinvestigation,whohasacomplaint
56pending,orwhoiscurrentlyunderdisciplinaryaction,exceptasprovidedinsubdivision
57(2)ofthissubsection,withanoversightbodyoutsidethestate;whodoesnotholda
58licenseingoodstandingwithanoversightbodyoutsidethestate;whohasacriminal
59recordthatwoulddisqualifyhimorherforlicensureinMissouri;orwhodoesnothold
60avalidcurrentlicenseintheotherjurisdictiononthedatetheboardreceiveshisorher
61applicationunderthissection.
62 (2)Ifanotherjurisdictionhastakendisciplinaryactionagainstanapplicant,the
63boardshalldetermineifthecausefortheactionwascorrectedandthematterresolved.
64Ifthematterhasnotbeenresolvedbythatjurisdiction,theboardmaydenyalicense
65untilthematterisresolved.
66 5.Nothinginthissectionshallprohibittheboardfromdenyingalicensetoan
67applicantunderthissectionforanyreasondescribedinsection334.100.
68 6.Anypersonwhoislicensedundertheprovisionsofthissectionshallbesubject
69totheboard'sjurisdictionandallrulesandregulationspertainingtothepracticeasa
70physicianandsurgeoninthisstate.
71 7.Thissectionshallnotbeconstruedtowaiveanyrequirementforanapplicant
72topayanyfees.
334.1600.Sections334.1600to334.1720shallbeknownandmaybecitedasthe
2"InterstateMedicalLicensureCompact".
334.1605.Inordertostrengthenaccesstohealthcare,andinrecognitionofthe
2advancesinthedeliveryofhealthcare,thememberstatesoftheInterstateMedical
3LicensureCompacthavealliedincommonpurposetodevelopacomprehensiveprocess
4thatcomplementstheexistinglicensingandregulatoryauthorityofstatemedical
5boards,providesastreamlinedprocessthatallowsphysicianstobecomelicensedin
6multiplestates,therebyenhancingtheportabilityofamedicallicenseandensuringthe
7safetyofpatients.TheCompactcreatesanotherpathwayforlicensureanddoesnot
8otherwisechangeastate'sexistingMedicalPracticeAct.TheCompactalsoadoptsthe
9prevailingstandardforlicensureandaffirmsthatthepracticeofmedicineoccurswhere
10thepatientislocatedatthetimeofthephysician-patientencounter,andtherefore,
11requiresthephysiciantobeunderthejurisdictionofthestatemedicalboardwherethe
12patientislocated.StatemedicalboardsthatparticipateintheCompactretainthe
HB2004	3 13jurisdictiontoimposeanadverseactionagainstalicensetopracticemedicineinthat
14stateissuedtoaphysicianthroughtheproceduresintheCompact.
334.1610.Inthiscompact:
2 (1)"Bylaws"meansthosebylawsestablishedbytheInterstateCommission
3pursuanttosection334.1655.
4 (2)"Commissioner"meansthevotingrepresentativeappointedbyeachmember
5boardpursuanttosection334.1655.
6 (3)"Conviction"meansafindingbyacourtthatanindividualisguiltyofa
7criminaloffensethroughadjudication,orentryofapleaofguiltornocontesttothe
8chargebytheoffender.Evidenceofanentryofaconvictionofacriminaloffensebythe
9courtshallbeconsideredfinalforpurposesofdisciplinaryactionbyamemberboard.
10 (4)"ExpeditedLicense"meansafullandunrestrictedmedicallicensegranted
11byamemberstatetoaneligiblephysicianthroughtheprocesssetforthintheCompact.
12 (5)"InterstateCommission"meanstheinterstatecommissioncreatedpursuant
13tosection334.1655.
14 (6)"License"meansauthorizationbyamemberstateforaphysiciantoengage
15inthepracticeofmedicine,whichwouldbeunlawfulwithoutauthorization.
16 (7)"MedicalPracticeAct"meanslawsandregulationsgoverningthepracticeof
17allopathicandosteopathicmedicinewithinamemberstate.
18 (8)"MemberBoard"meansastateagencyinamemberstatethatactsinthe

25 (11)"Physician"meansanypersonwho:
26 (a)IsagraduateofamedicalschoolaccreditedbytheLiaisonCommitteeon
27MedicalEducation,theCommissiononOsteopathicCollegeAccreditation,oramedical
28schoollistedintheInternationalMedicalEducationDirectoryoritsequivalent;
29 (b)PassedeachcomponentoftheUnitedStatesMedicalLicensingExamination
30(USMLE)ortheComprehensiveOsteopathicMedicalLicensingExamination
31(COMLEX-USA) withinthreeattempts,oranyofitspredecessorexaminations
32acceptedbyastatemedicalboardasanequivalentexaminationforlicensurepurposes;
33 (c)Successfullycompletedgraduatemedicaleducationapprovedbythe
34AccreditationCouncilforGraduateMedicalEducationortheAmericanOsteopathic
35Association;
HB2004	4 36 (d)Holdsspecialtycertificationoratime-unlimitedspecialtycertificate
37recognizedbytheAmericanBoardofMedicalSpecialtiesortheAmerican

334.1615.1.Aphysicianmustmeettheeligibilityrequirementsasdefinedin
2subdivision(11)ofsection334.1610toreceiveanexpeditedlicenseunderthetermsand
3provisionsoftheCompact.
4 2.Aphysicianwhodoesnotmeettherequirementsofsubdivision(11)ofsection
5334.1610mayobtainalicensetopracticemedicineinamemberstateiftheindividual
6complieswithalllawsandrequirements,otherthantheCompact,relatingtothe
7issuanceofalicensetopracticemedicineinthatstate.
334.1620.1.Aphysicianshalldesignateamemberstateasthestateofprincipal
2licenseforpurposesofregistrationforexpeditedlicensurethroughtheCompactifthe
HB2004	5 3physicianpossessesafullandunrestrictedlicensetopracticemedicineinthatstate,and
4thestateis:
5 (1)Thestateofprincipalresidenceforthephysician,or
6 (2)Thestatewhereatleast25%ofthepracticeofmedicineoccurs,or
7 (3)Thelocationofthephysician'semployer,or
8 (4)Ifnostatequalifiesundersubdivision(1),(2),or(3)ofthissubsection,the
9statedesignatedasstateofresidenceforpurposeoffederalincometax.
10 2.Aphysicianmayredesignateamemberstateasstateofprincipallicenseat
11anytime,aslongasthestatemeetstherequirementsofsubsection1ofthissection.
12 3.TheInterstateCommissionisauthorizedtodeveloprulestofacilitate
13redesignationofanothermemberstateasthestateofprincipallicense.
334.1625.1.AphysicianseekinglicensurethroughtheCompactshallfilean
2applicationforanexpeditedlicensewiththememberboardofthestateselectedbythe
3physicianasthestateofprincipallicense.
4 2.Uponreceiptofanapplicationforanexpeditedlicense,thememberboard
5withinthestateselectedasthestateofprincipallicenseshallevaluatewhetherthe
6physicianiseligibleforexpeditedlicensureandissuealetterofqualification,verifying
7ordenyingthephysician'seligibility,totheInterstateCommission.
8 (1)Staticqualifications,whichincludeverificationofmedicaleducation,
9graduatemedicaleducation,resultsofanymedicalorlicensingexamination,andother
10qualificationsasdeterminedbytheInterstateCommissionthroughrule,shallnotbe
11subjecttoadditionalprimarysourceverificationwherealreadyprimarysourceverified
12bythestateofprincipallicense.
13 (2)Thememberboardwithinthestateselectedasthestateofprincipallicense
14shall,inthecourseofverifyingeligibility,performacriminalbackgroundcheckofan
15applicant,includingtheuseoftheresultsoffingerprintorotherbiometricdatachecks
16compliantwiththerequirementsoftheFederalBureauofInvestigation,withthe
17exceptionoffederalemployeeswhohavesuitabilitydeterminationinaccordancewith5
18C.F.R.§731.202.
19 (3)Appealonthedeterminationofeligibilityshallbemadetothememberstate
20wheretheapplicationwasfiledandshallbesubjecttothelawofthatstate.
21 3.Uponverificationinsubsection2ofthissection,physicianseligibleforan
22expeditedlicenseshallcompletetheregistrationprocessestablishedbytheInterstate
23Commissiontoreceivealicenseinamemberstateselectedpursuanttosubsection1of
24thissection,includingthepaymentofanyapplicablefees.
25 4.Afterreceivingverificationofeligibilityundersubsection2ofthissectionand
26anyfeesundersubsection3ofthissection,amemberboardshallissueanexpedited
HB2004	6 27licensetothephysician.Thislicenseshallauthorizethephysiciantopracticemedicine
28intheissuingstateconsistentwiththeMedicalPracticeActandallapplicablelawsand
29regulationsoftheissuingmemberboardandmemberstate.
30 5.Anexpeditedlicenseshallbevalidforaperiodconsistentwiththelicensure
31periodinthememberstateandinthesamemannerasrequiredforotherphysicians
32holdingafullandunrestrictedlicensewithinthememberstate.
33 6.AnexpeditedlicenseobtainedthroughtheCompactshallbeterminatedifa
34physicianfailstomaintainalicenseinthestateofprincipallicensureforanon-
35disciplinaryreason,withoutredesignationofanewstateofprincipallicensure.
36 7.TheInterstateCommissionisauthorizedtodeveloprulesregardingthe
37applicationprocess,includingpaymentofanyapplicablefees,andtheissuanceofan
38expeditedlicense.
334.1630.1.Amemberstateissuinganexpeditedlicenseauthorizingthe
2practiceofmedicineinthatstatemayimposeafeeforalicenseissuedorrenewed
3throughtheCompact.
4 2.TheInterstateCommissionisauthorizedtodeveloprulesregardingfeesfor
5expeditedlicenses.
334.1635.1.Aphysicianseekingtorenewanexpeditedlicensegrantedina
2memberstateshallcompletearenewalprocesswiththeInterstateCommissionifthe
3physician:
4 (1)Maintainsafullandunrestrictedlicenseinastateofprincipallicense;
5 (2)Hasnotbeenconvicted,receivedadjudication,deferredadjudication,
6communitysupervision,ordeferreddispositionforanyoffensebyacourtof
7appropriatejurisdiction;
8 (3)Hasnothadalicenseauthorizingthepracticeofmedicinesubjectto
9disciplinebyalicensingagencyinanystate,federal,orforeignjurisdiction,excluding
10anyactionrelatedtonon-paymentoffeesrelatedtoalicense;and
11 (4)Hasnothadacontrolledsubstancelicenseorpermitsuspendedorrevoked
12byastateortheUnitedStatesDrugEnforcementAdministration.
13 2.Physiciansshallcomplywithallcontinuingprofessionaldevelopmentor
14continuingmedicaleducationrequirementsforrenewalofalicenseissuedbyamember
15state.
16 3.TheInterstateCommissionshallcollectanyrenewalfeeschargedforthe
17renewalofalicenseanddistributethefeestotheapplicablememberboard.
18 4.Uponreceiptofanyrenewalfeescollectedinsubsection3ofthissection,a
19memberboardshallrenewthephysician'slicense.
HB2004	7 20 5.PhysicianinformationcollectedbytheInterstateCommissionduringthe
21renewalprocesswillbedistributedtoallmemberboards.
22 6.TheInterstateCommissionisauthorizedtodeveloprulestoaddressrenewal
23oflicensesobtainedthroughtheCompact.
334.1640.1.TheInterstateCommissionshallestablishadatabaseofall
2physicianslicensed,orwhohaveappliedforlicensure,undersection334.1625.
3 2.Notwithstandinganyotherprovisionoflaw,memberboardsshallreportto
4theInterstateCommissionanypublicactionorcomplaintsagainstalicensedphysician
5whohasappliedorreceivedanexpeditedlicensethroughtheCompact.
6 3.Memberboardsshallreportdisciplinaryorinvestigatoryinformation
7determinedasnecessaryandproperbyruleoftheInterstateCommission.
8 4.Memberboardsmayreportanynon-publiccomplaint,disciplinary,or
9investigatoryinformationnotrequiredbysubsection3ofthissectiontotheInterstate
10Commission.
11 5.Memberboardsshallsharecomplaintordisciplinaryinformationabouta
12physicianuponrequestofanothermemberboard.
13 6.AllinformationprovidedtotheInterstateCommissionordistributedby
14memberboardsshallbeconfidential,filedunderseal,andusedonlyforinvestigatoryor
15disciplinarymatters.
16 7.TheInterstateCommissionisauthorizedtodeveloprulesformandatedor
17discretionarysharingofinformationbymemberboards.
334.1645.1.Licensureanddisciplinaryrecordsofphysiciansaredeemed
2investigative.
3 2.Inadditiontotheauthoritygrantedtoamemberboardbyitsrespective
4MedicalPracticeActorotherapplicablestatelaw,amemberboardmayparticipate
5withothermemberboardsinjointinvestigationsofphysicianslicensedbythemember
6boards.
7 3.Asubpoenaissuedbyamemberstateshallbeenforceableinothermember
8states.
9 4.Memberboardsmayshareanyinvestigative,litigation,orcompliance
10materialsinfurtheranceofanyjointorindividualinvestigationinitiatedunderthe
11Compact.
12 5.Anymemberstatemayinvestigateactualorallegedviolationsofthestatutes
13authorizingthepracticeofmedicineinanyothermemberstateinwhichaphysician
14holdsalicensetopracticemedicine.
334.1650.1.Anydisciplinaryactiontakenbyanymemberboardagainsta
2physicianlicensedthroughtheCompactshallbedeemedunprofessionalconductwhich
HB2004	8 3maybesubjecttodisciplinebyothermemberboards,inadditiontoanyviolationofthe
4MedicalPracticeActorregulationsinthatstate.
5 2.Ifalicensegrantedtoaphysicianbythememberboardinthestateof
6principallicenseisrevoked,surrenderedorrelinquishedinlieuofdiscipline,or
7suspended,thenalllicensesissuedtothephysicianbymemberboardsshall
8automaticallybeplaced,withoutfurtheractionnecessarybyanymemberboard,on
9thesamestatus.Ifthememberboardinthestateofprincipallicensesubsequently
10reinstatesthephysician'slicense,alicenseissuedtothephysicianbyanyothermember
11boardshallremainencumbereduntilthatrespectivememberboardtakesactionto
12reinstatethelicenseinamannerconsistentwiththeMedicalPracticeActofthatstate.
13 3.Ifdisciplinaryactionistakenagainstaphysicianbyamemberboardnotin
14thestateofprincipallicense,anyothermemberboardmaydeemtheactionconclusive
15astomatteroflawandfactdecided,and:
16 (1)Imposethesameorlessersanction(s)againstthephysiciansolongassuch
17sanctionsareconsistentwiththeMedicalPracticeActofthatstate;or
18 (2)Pursueseparatedisciplinaryactionagainstthephysicianunderitsrespective
19MedicalPracticeAct,regardlessoftheactiontakeninothermemberstates.
20 4.Ifalicensegrantedtoaphysicianbyamemberboardisrevoked,surrendered
21orrelinquishedinlieuofdiscipline,orsuspended,thenanylicense(s)issuedtothe
22physicianbyanyothermemberboard(s)shallbesuspended,automaticallyand
23immediatelywithoutfurtheractionnecessarybytheothermemberboard(s),forninety
24(90)daysuponentryoftheorderbythediscipliningboard,topermitthememberboard
25(s)toinvestigatethebasisfortheactionundertheMedicalPracticeActofthatstate.A
26memberboardmayterminatetheautomaticsuspensionofthelicenseitissuedpriorto
27thecompletionoftheninety(90)daysuspensionperiodinamannerconsistentwiththe
28MedicalPracticeActofthatstate.
334.1655.1.Thememberstatesherebycreatethe"InterstateMedicalLicensure
2CompactCommission".
3 2.ThepurposeoftheInterstateCommissionistheadministrationofthe
4InterstateMedicalLicensureCompact,whichisadiscretionarystatefunction.
5 3.TheInterstateCommissionshallbeabodycorporateandjointagencyofthe
6memberstatesandshallhavealltheresponsibilities,powers,anddutiessetforthinthe
7Compact,andsuchadditionalpowersasmaybeconferreduponitbyasubsequent
8concurrentactionoftherespectivelegislaturesofthememberstatesinaccordancewith
9thetermsoftheCompact.
10 4.TheInterstateCommissionshallconsistoftwovotingrepresentatives
11appointedbyeachmemberstatewhoshallserveasCommissioners.Instateswhere
HB2004	9 12allopathicandosteopathicphysiciansareregulatedbyseparatememberboards,orif
13thelicensinganddisciplinaryauthorityissplitbetweenseparatememberboards,orif
14thelicensinganddisciplinaryauthorityissplitbetweenmultiplememberboardswithin
15amemberstate,thememberstateshallappointonerepresentativefromeachmember
16board.ACommissionershallbea(n):
17 (1)Allopathicorosteopathicphysicianappointedtoamemberboard;
18 (2)Executivedirector,executivesecretary,orsimilarexecutiveofamember
19board;or
20 (3)Memberofthepublicappointedtoamemberboard.

28 7.EachCommissionerparticipatingatameetingoftheInterstateCommissionis
29entitledtoonevote.AmajorityofCommissionersshallconstituteaquorumforthe
30transactionofbusiness,unlessalargerquorumisrequiredbythebylawsofthe
31InterstateCommission.ACommissionershallnotdelegateavotetoanother
32Commissioner.IntheabsenceofitsCommissioner,amemberstatemaydelegate
33votingauthorityforaspecifiedmeetingtoanotherpersonfromthatstatewhoshall

35 8.TheInterstateCommissionshallprovidepublicnoticeofallmeetingsandall
36meetingsshallbeopentothepublic.TheInterstateCommissionmaycloseameeting,in
37fullorinportion,whereitdeterminesbyatwo-thirdsvoteoftheCommissionerspresent
38thatanopenmeetingwouldbelikelyto:

64 12.TheInterstateCommissionshallestablishothercommitteesforgovernance
65andadministrationoftheCompact.
334.1660.ThepowersanddutiesoftheInterstateCommissionshallbeto:
2 (1)OverseeandmaintaintheadministrationoftheCompact;
3 (2)Promulgateruleswhichshallbebindingtotheextentandinthemanner
4providedforintheCompact;
5 (3)Issue,upontherequestofamemberstateormemberboard,advisory
6opinionsconcerningthemeaningorinterpretationoftheCompact,itsbylaws,rules,

8 (4)EnforcecompliancewithCompactprovisions,therulespromulgatedbythe
9InterstateCommission,andthebylaws,usingallnecessaryandpropermeans,including
10butnotlimitedtotheuseofjudicialprocess;

334.1665.1.TheInterstateCommissionmaylevyonandcollectanannual
2assessmentfromeachmemberstatetocoverthecostoftheoperationsandactivitiesof
3theInterstateCommissionanditsstaff.Thetotalassessmentmustbesufficienttocover
4theannualbudgetapprovedeachyearforwhichrevenueisnotprovidedbyother
5sources.Theaggregateannualassessmentamountshallbeallocateduponaformulato
6bedeterminedbytheInterstateCommission,whichshallpromulgatearulebinding
7uponallmemberstates.
8 2.TheInterstateCommissionshallnotincurobligationsofanykindpriorto
9securingthefundsadequatetomeetthesame.
10 3.TheInterstateCommissionshallnotpledgethecreditofanyofthemember
11states,exceptby,andwiththeauthorityof,thememberstate.

10 3.Officersselectedinsubsection2ofthissectionshallservewithout
11remunerationfortheInterstateCommission.
12 4.TheofficersandemployeesoftheInterstateCommissionshallbeimmune
13fromsuitandliability,eitherpersonallyorintheirofficialcapacity,foraclaimfor
14damagetoorlossofpropertyorpersonalinjuryorothercivilliabilitycausedorarising
15outof,orrelatingto,anactualorallegedact,error,oromissionthatoccurred,orthat
16suchpersonhadareasonablebasisforbelievingoccurred,withinthescopeofInterstate
17Commissionemployment,duties,orresponsibilities;providedthatsuchpersonshallnot
18beprotectedfromsuitorliabilityfordamage,loss,injury,orliabilitycausedbythe
19intentionalorwillfulandwantonmisconductofsuchperson.
20 5.TheliabilityoftheexecutivedirectorandemployeesoftheInterstate
21CommissionorrepresentativesoftheInterstateCommission,actingwithinthescopeof
22suchperson'semploymentordutiesforacts,errors,oromissionsoccurringwithinsuch
23person'sstate,maynotexceedthelimitsofliabilitysetforthundertheconstitutionand
24lawsofthatstateforstateofficials,employees,andagents.TheInterstateCommission
25isconsideredtobeaninstrumentalityofthestatesforthepurposeofanysuchaction.
26Nothinginthissubsectionshallbeconstruedtoprotectsuchpersonfromsuitorliability
27fordamage,loss,injury,orliabilitycausedbytheintentionalorwillfulandwanton
28misconductofsuchperson.
29 6.TheInterstateCommissionshalldefendtheexecutivedirector,itsemployees,
30andsubjecttotheapprovaloftheattorneygeneralorotherappropriatelegalcounselof
31thememberstaterepresentedbyanInterstateCommissionrepresentative,shalldefend
32suchInterstateCommissionrepresentativeinanycivilactionseekingtoimposeliability
33arisingoutofanactualorallegedact,errororomissionthatoccurredwithinthescope
34ofInterstateCommissionemployment,dutiesorresponsibilities,orthatthedefendant

42costs,obtainedagainstsuchpersonsarisingoutofanactualorallegedact,error,or

334.1675.1.TheInterstateCommissionshallpromulgatereasonablerulesin
2ordertoeffectivelyandefficientlyachievethepurposeoftheCompact.
3Notwithstandingtheforegoing,intheeventtheInterstateCommissionexercisesits
4rulemakingauthorityinamannerthatisbeyondthescopeofthepurposesofthe
5Compact,orthepowersgrantedhereunder,thensuchanactionbytheInterstate
6Commissionshallbeinvalidandhavenoforceoreffect.
7 2.RulesdeemedappropriatefortheoperationsoftheInterstateCommission
8shallbemadepursuanttoarulemakingprocessthatsubstantiallyconformstothe
9"ModelStateAdministrativeProcedureAct"of2010,andsubsequentamendments
10thereto.
11 3.Notlaterthanthirty(30)daysafteraruleispromulgated,anypersonmayfile
12apetitionforjudicialreviewoftheruleintheUnitedStatesDistrictCourtforthe
13DistrictofColumbiaorthefederaldistrictwheretheInterstateCommissionhasits
14principaloffices,providedthatthefilingofsuchapetitionshallnotstayorotherwise
15preventtherulefrombecomingeffectiveunlessthecourtfindsthatthepetitionerhasa
16substantiallikelihoodofsuccess.Thecourtshallgivedeferencetotheactionsofthe
17InterstateCommissionconsistentwithapplicablelawandshallnotfindtheruletobe
18unlawfuliftherulerepresentsareasonableexerciseoftheauthoritygrantedtothe
19InterstateCommission.
334.1680.1.Theexecutive,legislative,andjudicialbranchesofstate
2governmentineachmemberstateshallenforcetheCompactandshalltakeall
3actionsnecessaryandappropriatetoeffectuatetheCompact'spurposesandintent.The
4provisionsoftheCompactandtherulespromulgatedhereundershallhavestandingas

6medicine.
7 2.AllcourtsshalltakejudicialnoticeoftheCompactandtherulesinany
8judicialoradministrativeproceedinginamemberstatepertainingtothesubjectmatter
9oftheCompactwhichmayaffectthepowers,responsibilitiesoractionsoftheInterstate
10Commission.
11 3.TheInterstateCommissionshallbeentitledtoreceiveallservicesofprocessin
12anysuchproceeding,andshallhavestandingtointerveneintheproceedingforall
13purposes.FailuretoprovideserviceofprocesstotheInterstateCommissionshall
14renderajudgmentorordervoidastotheInterstateCommission,theCompact,or
15promulgatedrules.
334.1685.1.TheInterstateCommission,inthereasonableexerciseofits
2discretion,shallenforcetheprovisionsandrulesoftheCompact.
3 2.TheInterstateCommissionmay,bymajorityvoteoftheCommissioners,
4initiatelegalactionintheUnitedStatesDistrictCourtfortheDistrictofColumbia,or,
5atthediscretionoftheInterstateCommission,inthefederaldistrictwherethe
6InterstateCommissionhasitsprincipaloffices,toenforcecompliancewiththe
7provisionsoftheCompact,anditspromulgatedrulesandbylaws,againstamember
8stateindefault.Thereliefsoughtmayincludebothinjunctivereliefanddamages.In
9theeventjudicialenforcementisnecessary,theprevailingpartyshallbeawardedall
10costsofsuchlitigationincludingreasonableattorney'sfees.
11 3.TheremedieshereinshallnotbetheexclusiveremediesoftheInterstate
12Commission.TheInterstateCommissionmayavailitselfofanyotherremedies
13availableunderstatelaworregulationofaprofession.
334.1690.1.Thegroundsfordefaultinclude,butarenotlimitedto,failureofa
2memberstatetoperformsuchobligationsorresponsibilitiesimposeduponitbythe
3Compact,ortherulesandbylawsoftheInterstateCommissionpromulgatedunderthe
4Compact.
5 2.IftheInterstateCommissiondeterminesthatamemberstatehasdefaultedin
6theperformanceofitsobligationsorresponsibilitiesundertheCompact,orthebylaws
7orpromulgatedrules,theInterstateCommissionshall:
8 (1)Providewrittennoticetothedefaultingstateandothermemberstates,ofthe
9natureofthedefault,themeansofcuringthedefault,andanyactiontakenbythe
10InterstateCommission.TheInterstateCommissionshallspecifytheconditionsby
11whichthedefaultingstatemustcureitsdefault;and
12 (2)Provideremedialtrainingandspecifictechnicalassistanceregardingthe
13default.
HB2004	15 14 3.Ifthedefaultingstatefailstocurethedefault,thedefaultingstateshallbe
15terminatedfromtheCompactuponanaffirmativevoteofamajorityofthe
16Commissionersandallrights,privileges,andbenefitsconferredbytheCompactshall
17terminateontheeffectivedateoftermination.Acureofthedefaultdoesnotrelievethe
18offendingstateofobligationsorliabilitiesincurredduringtheperiodofthedefault.
19 4.TerminationofmembershipintheCompactshallbeimposedonlyafterall
20othermeansofsecuringcompliancehavebeenexhausted.Noticeofintenttoterminate
21shallbegivenbytheInterstateCommissiontothegovernor,themajorityandminority
22leadersofthedefaultingstate'slegislature,andeachofthememberstates.
23 5.TheInterstateCommissionshallestablishrulesandprocedurestoaddress
24licensesandphysiciansthataremateriallyimpactedbytheterminationofamember
25state,orthewithdrawalofamemberstate.
26 6.Thememberstatewhichhasbeenterminatedisresponsibleforalldues,
27obligations,andliabilitiesincurredthroughtheeffectivedateofterminationincluding
28obligations,theperformanceofwhichextendsbeyondtheeffectivedateoftermination.
29 7.TheInterstateCommissionshallnotbearanycostsrelatingtoanystatethat
30hasbeenfoundtobeindefaultorwhichhasbeenterminatedfromtheCompact,unless
31otherwisemutuallyagreeduponinwritingbetweentheInterstateCommissionandthe
32defaultingstate.
33 8.ThedefaultingstatemayappealtheactionoftheInterstateCommissionby
34petitioningtheUnitedStatesDistrictCourtfortheDistrictofColumbiaorthefederal
35districtwheretheInterstateCommissionhasitsprincipaloffices.Theprevailingparty
36shallbeawardedallcostsofsuchlitigationincludingreasonableattorney'sfees.
334.1695.1.TheInterstateCommissionshallattempt,upontherequestofa
2memberstate,toresolvedisputeswhicharesubjecttotheCompactandwhichmayarise
3amongmemberstatesormemberboards.
4 2.TheInterstateCommissionshallpromulgaterulesprovidingforboth
5mediationandbindingdisputeresolutionasappropriate.
334.1700.1.AnystateiseligibletobecomeamemberoftheCompact.
2 2.TheCompactshallbecomeeffectiveandbindinguponlegislativeenactmentof
3theCompactintolawbynolessthanseven(7)states.Thereafter,itshallbecome
4effectiveandbindingonastateuponenactmentoftheCompactintolawbythatstate.
5 3.Thegovernorsofnon-memberstates,ortheirdesignees,shallbeinvitedto
6participateintheactivitiesoftheInterstateCommissiononanon-votingbasispriorto
7adoptionoftheCompactbyallstates.
8 4.TheInterstateCommissionmayproposeamendmentstotheCompactfor
9enactmentbythememberstates.Noamendmentshallbecomeeffectiveandbinding

11intolawbyunanimousconsentofthememberstates.
334.1705.1.Onceeffective,theCompactshallcontinueinforceandremain
2bindinguponeachandeverymemberstate;providedthatamemberstatemay
3withdrawfromtheCompactbyspecificallyrepealingthestatutewhichenactedthe
4Compactintolaw.
5 2.WithdrawalfromtheCompactshallbebytheenactmentofastatute
6repealingthesame,butshallnottakeeffectuntilone(1)yearaftertheeffectivedateof
7suchstatuteanduntilwrittennoticeofthewithdrawalhasbeengivenbythe
8withdrawingstatetothegovernorofeachothermemberstate.
9 3.Thewithdrawingstateshallimmediatelynotifythechairpersonofthe
10InterstateCommissioninwritingupontheintroductionoflegislationrepealingthe
11Compactinthewithdrawingstate.
12 4.TheInterstateCommissionshallnotifytheothermemberstatesofthe
13withdrawingstate'sintenttowithdrawwithinsixty(60)daysofitsreceiptofnotice
14providedundersubsection3ofthissection.
15 5.Thewithdrawingstateisresponsibleforalldues,obligationsandliabilities
16incurredthroughtheeffectivedateofwithdrawal,includingobligations,the
17performanceofwhichextendbeyondtheeffectivedateofwithdrawal.
18 6.Reinstatementfollowingwithdrawalofamemberstateshalloccuruponthe
19withdrawingstatereenactingtheCompactoruponsuchlaterdateasdeterminedbythe
20InterstateCommission.
21 7.TheInterstateCommissionisauthorizedtodeveloprulestoaddressthe
22impactofthewithdrawalofamemberstateonlicensesgrantedinothermemberstates
23tophysicianswhodesignatedthewithdrawingmemberstateasthestateofprincipal
24license.
334.1710.1.TheCompactshalldissolveeffectiveuponthedateofthe
2withdrawalordefaultofthememberstatewhichreducesthemembershipofthe
3Compacttoone(1)memberstate.
4 2.UponthedissolutionoftheCompact,theCompactbecomesnullandvoidand
5shallbeofnofurtherforceoreffect,andthebusinessandaffairsoftheInterstate
6Commissionshallbeconcluded,andsurplusfundsshallbedistributedinaccordance
7withthebylaws.
334.1715.1.TheprovisionsoftheCompactshallbeseverable,andifany
2phrase,clause,sentence,orprovisionisdeemedunenforceable,theremainingprovisions
3oftheCompactshallbeenforceable.

5 3.AlllawfulactionsoftheInterstateCommission,includingallrulesandbylaws
6promulgatedbytheCommission,arebindinguponthememberstates.
7 4.AllagreementsbetweentheInterstateCommissionandthememberstatesare
8bindinginaccordancewiththeirterms.
9 5.IntheeventanyprovisionoftheCompactexceedstheconstitutionallimits
10imposedonthelegislatureofanymemberstate,suchprovisionshallbeineffectivetothe
11extentoftheconflictwiththeconstitutionalprovisioninquestioninthatmemberstate.
