319 (60)"Watersystem"includesallreservoirs,tunnels,shafts,dams,dikes,headgates, 320pipes,flumes,canals,structuresandappliances,andallotherrealestate,fixturesandpersonal 321property,owned,operated,controlledormanagedinconnectionwithortofacilitatethe 322diversion,development,storage,supply,distribution,sale,furnishingorcarriageofwaterfor 323municipal,domesticorotherbeneficialuse. 393.1420.1.Thissectionshallbeknownandmaybecitedasthe"Electrical 2CorporationBroadbandAuthorizationAct". 3 2.Asusedinthissection,thefollowingtermsshallmean: 4 (1)"Broadbandinfrastructure",anyandallcomponentpartsofanelectrical 5corporation'sinfrastructurethatmaybeusedtoprovidebroadbandinfrastructure 6services,whethernowexistingorthatmaybedevelopedinthefuture,andincluding, 7butnotlimitedto,wires,coppercables,fiberopticcables,conduits,ducts,poles, 8antennas,transmitters,receivers,amplifiers,switches,multiplexers,routers,servers, 9andallappurtenancesthereto; 10 (2)"Broadbandinfrastructureservices": 11 (a)Theprovisionofaccesstodarkfiberwithinfiberopticcables: 12 a.Toanend-usecustomerfortheend-usecustomer'sprivate 13telecommunicationssystem,providedthatsuchaccessshallbeprovidedatthe 14electricalcorporation'spremisesandsuchend-usecustomershallbearallcostsand 15responsibilityfordevelopinganinterconnectionfromsuchend-usecustomer'spremises 16tothedarkfiberattheelectricalcorporation'spremises;or 17 b.Toathirdpartythatdoesnotusethefiberasanend-usecustomer;or 18 (b)Theprovisionofconnectivity,vialitfiberorothercomponentsofthe 19broadbandinfrastructure,whethertoadataorinformationtransmissionmedium,orto 20atechnology,andineithercaseforpurposesofaccessingtheinternetorprovidingother 21capabilitiesincluding,butnotlimitedto,informationsharing,informationstorage, HB2015 10 22informationcontent,orprotocolconversion,provided,however,thattheprovisionof 23suchconnectivityshallonlybemadetoathirdpartyforresaleandshallnotbemadeto 24anend-usecustomerofsuchconnectivity; 25 (3)"Commission",thepublicservicecommission; 26 (4)"Electricalcorporation",thesameasdefinedinsection386.020. 27 3.(1)Totheextentnototherwiseauthorizedbylaw,andinadditiontoallother 28purposesforwhichelectricalcorporationsmaybeformedunderthelawsofthisstate 29andallotherpowersandauthoritycurrentlygrantedtoelectricalcorporationsunder 30thelawsofthisstate,anelectricalcorporationshallbeauthorizedtodoanyorallofthe 31following: 32 (a)Own,construct,install,maintain,repair,andreplacebroadband 33infrastructure; 34 (b)Operatetheelectricalcorporation'sbroadbandinfrastructurefororin 35connectionwiththeelectricalcorporation'sprovisionofelectricservice; 36 (c)Providebroadbandinfrastructureservicesusingtheelectricalcorporation's 37broadbandinfrastructure;and 38 (d)Subjecttotheprovisionsofsection416.031,enterintocontracts,leases, 39licenses,orotheragreementsconcerningtheprovisionofbroadbandinfrastructure 40servicesonanytermsandconditions,includingratesandcharges,astheelectrical 41corporationinitssolediscretionshalldetermineand,notwithstandingtheprovisionsof 42section393.190oranyotherlawtothecontrary,withoutsecuringanyauthorization, 43permission,orapprovalfromthecommission. 44 (2)Anelectricalcorporationshallnotrequireanyofitselectricservice 45customerstopurchasebroadbandinfrastructureservicesprovidedviatheelectrical 46corporation'sbroadbandinfrastructureasaconditionofreceivingorcontinuingto 47receiveelectricservicefromtheelectricalcorporation. 48 (3)Anelectricalcorporationshallnotdisconnectanycustomerfromreceiving 49electricserviceduetothecustomer'sfailuretopayforbroadbandinfrastructure 50servicesprovidedviatheelectricalcorporation'sbroadbandinfrastructure. 51 (4)Anelectricalcorporationshallrequirecontributionsinaidofconstruction 52fromanycustomerorthirdpartytowhomitprovidesbroadbandinfrastructure 53services,intheamountofthecostofanyitemofbroadbandinfrastructureinstalledby 54theelectricalcorporationtoprovidebroadbandinfrastructureservicessolelytosuch 55customerorthirdparty. 56 4.(1)Asusedinthissubsection,"broadbandinfrastructureservicesrevenue" 57shallmeanrevenuereceivedbyanelectricalcorporationfortheprovisionofbroadband 58infrastructureservices. HB2015 11 59 (2)Whendeterminingtherevenuerequirementusedtosettheelectrical 60corporation'sbaseratesintheelectricalcorporation'sgeneralrateproceedings,the 61followingshallbeincluded: 62 (a)Theelectricalcorporation'stestyearbroadbandinfrastructureservices 63revenues,asupdated,trued-up,ornormalized,ifapplicable; 64 (b)Theelectricalcorporation'sprudently-incurredtestyearoperationsand 65maintenanceexpendituresassociatedwithgeneratingtherevenuesinparagraph(a)of 66thissubdivision,asupdated,trued-up,ornormalized,ifapplicable;and 67 (c)Theelectricalcorporation'sprudently-incurredinvestmentinbroadband 68infrastructureasofthedatetheelectricalcorporation'sotherratebaseadditionsare 69accountedfor. 70 71Thecommissionshalldeterminetheprudenceoftherevenues,expenditures,and 72investmentscoveredbyparagraphs(a)to(c)ofthissubdivisionconsistentwithexisting 73lawrespectingtheburdensofproductionandpersuasioningeneralrateproceedings 74applicabletoutilityexpendituresandinvestments. 75 (3)Anyordinanceadoptedundersection71.520orassentgrantedundersection 76229.100shallalsogranttheelectricalcorporationtherighttoconstruct,install, 77maintain,repair,andreplacebroadbandinfrastructureandtherighttoprovide 78broadbandinfrastructureservicesviatheelectricalcorporation'sbroadband 79infrastructureonandsubjecttothetermsandconditionsofsuchordinanceorassent. 80 5.Notwithstandinganyprovisionofchapters386or393tothecontrary,and 81consistentwiththeauthorityanddiscretiongrantedtoelectricalcorporationsin 82paragraph(d)ofsubdivision(1)ofsubsection3ofthissection,thecommissionshallnot 83havejurisdictionovertheterms,conditions,charges,contracts,leases,licenses,orother 84agreementsofanelectricalcorporationfortheelectricalcorporation'sprovisionof 85broadbandinfrastructureservices. 393.1800.1.Thissectionappliestoanyinversecondemnationortrespasscause 2ofaction,whethercommonlaworstatutory,broughtagainstanelectricalcorporation, 3againstaruralelectriccooperativeoperatingunderchapter394,oragainsta 4municipallyownedoroperatedelectricutilityoperatingunderchapter91,where: 5 (1)Thedefendanthasaneasementinrealproperty; 6 (2)Thedefendantusestherealproperty; 7 (3)Theplaintiffallegesthatthemannerorextentofusebythedefendantorthe 8defendant'sassigneesisanexpandedusethatincreasestheburdenofthedefendant's 9easement,orthattheuseexceedsthescopeofthedefendant'seasementrights; HB2015 12 10 (4)Theusecomplainedofinvolvestheuseofanelectricplantforbroadband 11infrastructureservices,ortheuseofelectrictransmissionlinesorsystemsinproviding 12accesstobroadbandservices;and 13 (5)ThecauseofactionaccruesafterAugust28,2021. 14 2.Anycauseofactionforinversecondemnationdescribedinsubsection1ofthis 15sectionshallbecommencedwithintwoyearsafterthecauseofactionshallhaveaccrued 16andindefaultthereofbebarred,andtotheextentthatanygeneralstatuteoflimitations 17including,butnotlimitedto,sections516.010,516.110,and516.120;anyspecialstatute 18oflimitations;orthecommonlawofthisstatewouldextendthetwo-yearperiodfor 19commencingacauseofactionforinversecondemnationdescribedinsubsection1ofthis 20section,thecommonlawandanysuchstatutesoflimitationareherebysupersededand 21displaced. 22 3.Anycauseofactionfortrespassdescribedinsubsection1ofthissectionshall 23becommencedwithintwoyearsafterthecauseofactionshallhaveaccruedandin 24defaultthereofbebarred,andtotheextentanygeneralstatuteoflimitationsincluding, 25butnotlimitedto,sections516.010,516.110,and516.120;anyspecialstatuteof 26limitations;orthecommonlawofthisstatewouldextendthetwo-yearperiodfor 27commencingacauseofactionfortrespassdescribedinsubsection1ofthissection,the 28commonlawandanysuchstatutesoflimitationareherebysupersededanddisplaced. 29 4.Inacauseofactionforinversecondemnationdescribedinsubsection1ofthis 30section,iftheplaintiffprevails,thedamageortakingshallbedeemedpermanent,the 31injurytotheplaintiffshallnotbedeemedtocontinuetoaccumulateortoaccrue,and 32thedamages,past,present,andfuture,resultingtherefrom,whichshallalwaysbe 33greaterthanzero,shallbefixedanddeterminedasofthedatetheexpandedusethat 34increasedtheburdenofthedefendant'seasementorusethatexceededthescopeofthe 35defendant'seasementrights,initiallyoccurred. 36 5.Inacauseofactionfortrespassdescribedinsubsection1ofthissection,a 37defendantshallbeentitledtoadeterminationbythecourtastowhethertheusebythe 38defendantoritsassignees,allegedbytheplaintifftobeanexpandedusethatincreases 39theburdenofthedefendant'seasement,ortoexceedthescopeofthedefendant's 40easementrights,isapublicuse;and: 41 (1)Ifthecourtfindsthatsuchuseisapublicuse,andiftheplaintiffprevailson 42theclaimfortrespass: 43 (a)Theplaintiffshallnotbegrantedanorderofejectment; 44 (b)Theplaintiffshallnotbegrantedanyequitableremedies;and 45 (c)Thetrespassshallbedeemedpermanent,theinjurytotheplaintiffshallnot 46bedeemedtocontinuetoaccumulateoraccrue,andthedamages,past,present,and HB2015 13 47future,resultingtherefrom,whichshallalwaysbegreaterthanzero,andwhichmay 48includedamagesforphysicaldamagetothepropertycausedbythedefendant's 49wrongfulusepriortosuit,shallbefixedanddeterminedasofthedatetheexpandeduse 50thatincreasedtheburdenofthedefendant'seasementrightsorusethatexceededthe 51scopeofthedefendant'seasementrights,initiallyoccurred;or 52 (2)Ifthecourtfindssuchauseisnotapublicuse,andiftheplaintiffprevailson 53theclaimoftrespass,nothingshallpreventadeterminationofwhethersuchuseis 54permanentortemporaryorpreventtheplaintifffrompursuingremediesorreliefnot 55availableundertheprovisionsofsubdivision(1)ofthissubsection. 56 6.Ifaplaintiffprevailsinacauseofactiondescribedinsubsection1ofthis 57section,thefinderoffactshallmakeadeterminationastowhethertheexpandeduse 58thatincreasedtheburdenofthedefendant'seasementortheusethatexceededthescope 59ofthedefendant'seasementrightsdidordidnotoccuroutsideofthefootprintofthe 60defendant'seasement.Ifthefinderoffactfindssuchwrongfulusedidnotoccuroutside 61thefootprintofthedefendant'seasement: 62 (1)Theplaintiffshallnotbeentitledto,normaytheplaintiffbeawarded,any 63punitivedamages; 64 (2)Theplaintiffshallnotbeentitledto,normaytheplaintiffbeawarded, 65attorneys'fees,costs,orexpenses,exceptasprovidedinsubdivision(5)ofthis 66subsection; 67 (3)Thecourtmaytreblethedamagesawarded,ifany,bythefinderoffactfor 68physicaldamagetothepropertycausedbythedefendant'swrongfulusepriortosuit; 69 (4)Shouldtheplaintiffprovetothecourtthatsuchwrongfulusebythe 70defendanthaspreventedtheplaintifffromusingaportionorportionsoftheplaintiff's 71propertylyingexclusivelywithinthefootprintoftheeasementinsubstantiallythesame 72mannerassuchportionorportionswerebeingutilizedimmediatelypriortothe 73wrongfuluse,thenthecourtmayincreasethedamagesawardedtoanamountnotto 74exceedthelesserof: 75 (a)Treblethedamagesawardedbythefinderoffact;or 76 (b)Thefairmarketvalueoftheportionorportionsoftheplaintiff'sproperty 77lyingexclusivelywithinthefootprintoftheeasementthattheplaintiffhasbeen 78prevented,bythedefendant'swrongfuluse,fromusinginsubstantiallythesame 79mannerastheportionorportionswerebeingutilizedimmediatelypriortosuch 80wrongfuluse; 81 (5)Inthealternative,andnotinadditiontosubdivision(4)ofthissubsection, 82shouldtheplaintiffprovetothecourtthatsuchwrongfulusebythedefendanthas 83preventedtheplaintifffromusingsomeportionorportionsoftheplaintiff'sproperty HB2015 14 84thatdoesnotlieexclusivelywithinthefootprintoftheeasementinsubstantiallythe 85samemannerassuchportionorportionswerebeingutilizedimmediatelypriortothe 86wrongfuluse,thecourtmayawardtheplaintiffreasonableattorneys'fees,costs,and 87expenses. 88 89Provided,however,withregardtosubdivisions(4)and(5)ofthissubsection,ifthe 90plaintiffseekssuchdamagesbutdoesnotmeettheburdenofproof,uponmotionbythe 91defendant,ifthecourtfindstheplaintiff'sclaimforsuchdamageswasfactually 92frivolous,thecourtmayawardthedefendantitsreasonableattorneys'fees,costs,and 93expensesincurredindefendingagainstsuchclaimbytheplaintiff. 94 7.Totheextentthecommonlawofthisstateortheprovisionsofanystatute 95including,butnotlimitedto,section523.283andsubdivision(11)ofsubsection1of 96section394.080,wouldentitleorpermitaplaintiffprevailinginacauseofaction 97describedinsubsection1ofthissectiontoreceivereliefordamagesorpursuearemedy 98expresslyprohibitedinsubsection4,5,or6ofthissection,thecommonlawandany 99suchotherstatutesareherebysupersededanddisplaced. 100 8.Asusedinthissection,thefollowingtermsmean: 101 (1)"Easement",includesexpresseasementsthetermsofwhichhavebeen 102reducedtowriting,whetheracquiredvoluntarilyorbycondemnation,aswellas 103prescriptiveeasements,impliedeasements,andeasementsbyestoppel; 104 (2)"Footprint",theareaorareasdescribedinanexpresseasementwithinthe 105boundsofwhichthedefendanteasementholdermayexerciseeasementrightsgranted, 106includingrightsofaccess,oriftheareaorareasarenotdescribedintheexpress 107easementoriftheeasementisotherthananexpresseasement,theareaorareasthe 108locationsanddimensionsofwhicharedeterminedbythecourtfromevidenceofthe 109priorusesoftheeasementbythedefendanteasementholderanddeterminedbythe 110courttobereasonablynecessarytoaccomplishthedefendanteasementholder'sprior 111uses; 112 (3)"Railroadcorporation",thesameasdefinedinsection388.010. 113 9.Uponthepaymentofanawardofdamagestoaplaintiffwhoprevailsina 114causeofactiondescribedinsubsection1ofthissectionforinversecondemnation,or 115whoprevailsinacauseofactiondescribedinsubsection1ofthissectionforatrespass 116wherethecourthasdeterminedthattheexpandedusethatincreasedtheburdenofthe 117defendant'seasementortheusethatexceededthescopeofthedefendant'seasement 118rightsisapublicuse,thescopeofthedefendant'seasementshallbepermanently 119expandedtoincludetheusesthat,priortothepayment,werefoundtohaveincreased 120theburdenofthedefendant'seasementorexceededthescopeofthedefendant's HB2015 15 121easementrights,includingleasing,licensing,orotherwisepermittingoragreeingtothe 122usesby,anotherparty;providedthatthereafter,ifthedefendantintheexerciseofits 123expandedeasementrightsshouldcausephysicaldamagetotheproperty,thedefendant 124shall,atthedefendant'soption,eithercausethepropertytoberestoredtothecondition 125itwasinimmediatelypriortocausingthephysicaldamageorpaydamagestothe 126propertyownertocompensatethepropertyownerforsuchphysicaldamage,exceptin 127theeventthatthephysicaldamagecreatesanimmediatethreattolife,property,or 128safety,inwhichcasethepropertyownermayproceedtorestorethepropertytoits 129conditionpriortosuchdamageandinwhichcasethedefendantshallbeliabletothe 130propertyownerforthepropertyowner'sreasonablyincurredexpensesofrestoration. 131 10.Recognizingthatindividualcharacteristicsofeveryparceloflandmake 132everyparcelunique,incapableofduplication,andofparticularvalue,suchthatthe 133damagesawardedinanytrespassorinversecondemnationinvolvingrealpropertyshall 134bedeterminedonanindividualized,parcelbyparcelbasis,nocauseofactiondescribed 135insubsection1ofthissectionmaybebroughtasanactiononbehalfofaclass.The 136limitationinthissubsectionisasubstantivelimitationandallowingapersontobringa 137classactionorotherrepresentativeactionwouldabridge,enlarge,ormodifythe 138substantiverightsaddressedbythissection. 139 11.Inacauseofactiondescribedinsubsection1ofthissection,thefollowing 140shallnotbeadmissibleinevidence,forpurposesofdeterminingtheplaintiff'sdamages 141oranyotherpurpose: 142 (1)Profits,fees,orrevenuederivedbythedefendantfromusesbythedefendant 143oritsassigneesoftheeasement;and 144 (2)Therentalvalueoftherealpropertyoroftheeasement,includingtherental 145valueofanassembledutilitycorridorofanytype. 146 12.Thissectionisintendedtoadvancethestate'sinterestinfacilitatingand 147acceleratingcitizens'accesstobroadbandviatheelectricalsystem,onandoverwhich 148broadbandinfrastructuresuchasfiberopticcable,facilities,andtechnologiesisalready 149deployedtoenhancethereliability,resilience,andsecurityoftheelectricalsystem,by 150reducingthelitigationrisksinvolvedwhensuchbroadbandinfrastructureisusedfor 151suchpurposes,whileatthesametimeprotectingcitizens'propertyrights. 152 13.Totheextentthecommonlaworstatutesprohibitthecondemnationof 153propertyofaproviderofpublicutilityserviceorofarailroadcorporationthatisbeing 154puttopublicuse,nothinginthissectionshallabrogateoreliminatethoseprohibitions. 155Further,nothinginthissectionshallabrogateoreliminateanyobligationofanelectrical 156corporation,aruralelectricalcooperativeoperatingunderchapter394,ora 157municipally-ownedoroperatedelectricutilityoperatingunderchapter91,thescope HB2015 16 158ofwhoseeasementrightsarepermanentlyexpandedasdescribedinsubsection9ofthis 159section,tocomplywithsafetyorpermittinglaws,regulations,existingcontracts,or 160standardsrequiredbytheproviderofthepublicutilityserviceorrailroadcorporation 161acrosswhosepropertysuchexpandedeasementrightsareobtained. 523.010.1.Incaseland,orotherproperty,issoughttobeappropriatedbyanyroad, 2railroad,streetrailway,telephone,telegraphoranyelectricalcorporationorganizedforthe 3manufacture, distribution,ortransmissionofelectriccurrentforlight,heat,[or]power,orby 4anyelectricalcorporationfortheprovisionofbroadbandinfrastructureservices, 5includingtheconstruction,whenthatisthecase,ofnecessarydamsandappurtenantcanals, 6flumes,tunnelsandtailracesandincludingtheerection,whenthatisthecase,ofnecessary 7electricsteampowerhouses,hydroelectricpowerhouses, andelectricsubstationsoranyoil, 8pipelineorgascorporationengagedinthebusinessoftransportingorcarryingoil,liquid 9fertilizersolutions,orgasbymeansofpipesorpipelineslaidunderneaththesurfaceofthe 10ground,orothercorporationcreatedunderthelawsofthisstateforpublicuse,andsuch 11corporationandtheownerscannotagreeuponthepropercompensationtobepaid,orinthe 12casetheownerisincapableofcontracting,beunknown,orbeanonresidentofthestate,such 13corporationmayapplytothecircuitcourtofthecountyofthisstatewheresuchlandorany 14partthereofliesbypetitionsettingforththegeneraldirectionsinwhichitisdesiredto 15constructitsroad,railroad,streetrailway,telephone,ortelegraphlineorelectricline, 16including,whenthatisthecase,theconstructionandmaintenanceofnecessarydamsand 17appurtenantcanals,tunnels,flumesandtailracesand,whenthatisthecase,theappropriation 18oflandsubmergedbytheconstructionofsuchdam,andincludingtheerectionand 19maintenance,whenthatisthecase,ofnecessaryelectricsteampowerhouses,hydroelectric 20powerhousesandelectricsubstations,oroil,pipeline,liquidfertilizersolutionpipeline,orgas 21lineoverorunderneaththesurfaceofsuchlands,adescriptionoftherealestate,orother 22property,whichthecompanyseekstoacquire;thenamesoftheownersthereof,ifknown;or 23ifunknown,apertinentdescriptionofthepropertywhoseownersareunknownandpraying 24theappointmentofthreedisinterestedresidentsofthecounty,ascommissioners,orajury,to 25assessthedamageswhichsuchownersmayseverallysustaininconsequenceofthe 26establishment,erectionandmaintenanceofsuchroad,railroad,streetrailway,telephone, 27telegraphline,[or]electricalline,orelectricalcorporationbroadbandinfrastructure 28includingdamagesfromtheconstructionandmaintenanceofnecessarydamsandthe 29condemnationoflandsubmergedthereby,andtheconstructionandmaintenanceof 30appurtenantcanals,flumes,tunnelsandtailracesandtheerectionandmaintenanceof 31necessaryelectricsteampowerhouses,hydroelectricpowerhousesandelectricsubstations,or 32oil,pipeline,orgaslineoverorunderneaththesurfaceofsuchlands;towhichpetitionthe 33ownersofanyorallastheplaintiffmayelectofsuchparcelsasliewithinthecountyor HB2015 17 34circuitmaybemadepartiesdefendantbynamesifthenamesareknown,andbythe 35descriptionoftheunknownownersofthelandthereindescribediftheirnamesareunknown. 36 2.Iftheproceedingsseektoaffectthelandsofpersonsunderconservatorship,the 37conservatorsmustbemadepartiesdefendant.Ifthepresentownerofanylandtobeaffected 38haslessestatethanafee,thepersonhavingthenextvestedestateinremaindermayatthe 39optionofthepetitionersbemadepartydefendant;butifsuchremaindermenarenotmade 40parties,theirinterestshallnotbeboundbytheproceedings. 41 3.Itshallnotbenecessarytomakeanypersonspartydefendantsinrespecttotheir 42ownershipunlesstheyareeitherinactualpossessionofthepremisestobeaffectedclaiming 43titleorhavingatitleofthepremisesappearingofrecordupontheproperrecordsofthe 44county. 45 4.Exceptasprovidedinsubsection5ofthissection,nothinginthischaptershallbe 46construedtogiveapublicutility,asdefinedinsection386.020,oraruralelectriccooperative, 47asprovidedinchapter394,thepowertocondemnpropertywhichiscurrentlyusedbyanother 48providerofpublicutilityservice,includingamunicipalityoraspecialpurposedistrict,when 49suchpropertyisusedorusefulinprovidingutilityservices,ifthepublicutilityorcooperative 50seekingtocondemnsuchproperty,directlyorindirectly,willuseorproposestousethe 51propertyforthesamepurpose,orapurposesubstantiallysimilartothepurposeforwhichthe 52propertyisbeingusedbytheproviderofthepublicutilityservice. 53 5.Apublicutilityoraruralelectriccooperativemayonlycondemnthepropertyof 54anotherproviderofpublicutilityservice,evenifthepropertyisusedorusefulinproviding 55utilityservicesbysuchprovider,ifthecondemnationisnecessaryforthepublicpurposeof
