BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows: SectionA.Section643.055,RSMo,isrepealedandonenewsectionenactedinlieu 2thereof,tobeknownassection643.055,toreadasfollows: 643.055.1.Otherprovisionsoflawnotwithstanding,theMissouriairconservation 2commissionshallhavetheauthoritytopromulgaterulesandregulations,pursuanttochapter 3536,toestablishstandardsandguidelinestoensurethatthestateofMissouriisincompliance 4withtheprovisionsofthefederalCleanAirAct,asamended(42U.S.C.Section7401[,] et 5seq.).Thestandardsandguidelinessoestablishedshall[notbeanystricterthanthose 6requiredunder] meettheprovisionsofthefederalCleanAirAct,asamended[; norshallthose 7standardsandguidelinesbeenforcedinanyareaofthestatepriortothetimerequiredbythe 8federalCleanAirAct,asamended.Therestrictionsofthissectionshallnotapplytotheparts 9ofastateimplementationplandevelopedbythecommissiontobringanonattainmentarea 10intocomplianceandtomaintaincompliancewhenneededtohaveaUnitedStates 11EnvironmentalProtectionAgencyapprovedstateimplementationplan.Thedeterminationof 12whichpartsofastateimplementationplanarenotsubjecttotherestrictionsofthissection 13shallbebaseduponspecificfindingsoffactbytheairconservationcommissionastothe 14rules,regulationsandcriteriathatareneededtohaveaUnitedStatesEnvironmental 15ProtectionAgencyapprovedplan]. EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 16 2.TheMissouriairconservationcommissionshallalsohavetheauthoritytogrant 17exceptionsandvariancesfromtherulessetundersubsection1ofthissectionwhentheperson 18applyingfortheexceptionorvariancecanshowthatcompliancewithsuchrules: 19 (1)Wouldcauseeconomichardship;or 20 (2)Isphysicallyimpossible;or 21 (3)Ismoredetrimentaltotheenvironmentthanthevariancewouldbe;or 22 (4)Isimpracticalorofinsignificantvalueundertheexistingconditions. 23 3.Thedepartmentshallnotregulatethemanufacture,performance,oruseof 24residentialwoodburningheatersorappliancesthroughastateimplementationplanor 25otherwise,unlessfirstspecificallyauthorizedtodosobythegeneralassembly.Noruleor 26regulationrespectingtheestablishmentortheenforcementofperformancestandardsfor 27residentialwoodburningheatersorappliancesshallbecomeeffectiveunlessanduntilfirst 28approvedbythejointcommitteeonadministrativerules. 29 4.Newrulesorregulationsshallnotbeappliedtoexistingwoodburningfurnaces, 30stoves,fireplaces,orheatersthatindividualsarecurrentlyusingastheirsourceofheatfor 31theirhomesorbusinesses.Allwoodburningfurnaces,stoves,fireplaces,andheatersexisting 32onAugust28,2014,shallnotbesubjecttoanyrulesorregulationsenactedaftersuchdate. 33Noemployeeofthestateorstateagencyshallenforceanynewrulesorregulationsagainst 34suchexistingwoodburningfurnaces,stoves,fireplaces,andheaters. ✔ HB2058 2
