334.100.1.Theboardmayrefusetoissueorrenewanycertificateofregistrationor
2authority,permitorlicenserequiredpursuanttothischapterforoneoranycombinationof
3causesstatedinsubsection2ofthissection.Theboardshallnotifytheapplicantinwritingof
4thereasonsfortherefusalandshalladvisetheapplicantoftheapplicant'srighttofilea
5complaintwiththeadministrativehearingcommissionasprovidedbychapter621.Asan
6alternativetoarefusaltoissueorrenewanycertificate,registrationorauthority,theboard
7may,atitsdiscretion,issuealicensewhichissubjecttoprobation,restrictionorlimitationto
8anapplicantforlicensureforanyoneoranycombinationofcausesstatedinsubsection2of
9thissection.Theboard'sorderofprobation,limitationorrestrictionshallcontainastatement

26 (2)Thepersonhasbeenfinallyadjudicatedandfoundguilty,orenteredapleaof
27guiltyornolocontendere,inacriminalprosecutionunderthelawsofanystateorofthe
28UnitedStates,foranyoffensereasonablyrelatedtothequalifications,functionsordutiesof
29anyprofessionlicensedorregulatedpursuanttothischapter,foranyoffenseinvolvingfraud,
30dishonestyoranactofviolence,orforanyoffenseinvolvingmoralturpitude,whetherornot
31sentenceisimposed;
32 (3)Useoffraud,deception,misrepresentationorbriberyinsecuringanycertificateof
33registrationorauthority,permitorlicenseissuedpursuanttothischapterorinobtaining

HB2096	6 200 5.Inanyorderofrevocation,theboardmayprovidethatthepersonmaynotapplyfor
201reinstatementoftheperson'slicenseforaperiodoftimerangingfromtwotosevenyears
202followingthedateoftheorderofrevocation.Allstayordersshalltollthistimeperiod.
203 6.Beforerestoringtogoodstandingalicense,certificateorpermitissuedpursuantto
204thischapterwhichhasbeeninarevoked,suspendedorinactivestateforanycauseformore
205thantwoyears,theboardmayrequiretheapplicanttoattendsuchcontinuingmedical
206educationcoursesandpasssuchexaminationsastheboardmaydirect.
207 7.Inanyinvestigation,hearingorotherproceedingtodeterminealicensee'sor
208applicant'sfitnesstopractice,anyrecordrelatingtoanypatientofthelicenseeorapplicant
209shallbediscoverablebytheboardandadmissibleintoevidence,regardlessofanystatutoryor
210commonlawprivilegewhichsuchlicensee,applicant,recordcustodianorpatientmight
211otherwiseinvoke.Inaddition,nosuchlicensee,applicant,orrecordcustodianmaywithhold
212recordsortestimonybearinguponalicensee'sorapplicant'sfitnesstopracticeontheground
213ofprivilegebetweensuchlicensee,applicantorrecordcustodianandapatient.
334.506.1.Asusedinthissection,"approvedhealthcareprovider"meansaperson
2holdingacurrentandactivelicenseasaphysicianandsurgeonunderthischapter,a
3chiropractorunderchapter331,adentistunderchapter332,apodiatristunderchapter330,a
4physicianassistantunderthischapter,anadvancedpracticeregisterednurseunderchapter
5335,oranylicensedandregisteredphysician,chiropractor,dentist,orpodiatristpracticingin
6anotherjurisdictionwhoselicenseisingoodstanding.
7 2.Aphysicaltherapist[shallnot]mayevaluateandinitiatetreatment[foranew
8injuryorillness] onapatientwithoutaprescriptionorreferralfromanapprovedhealthcare
9provider.
10 3.Aphysicaltherapistmayprovideeducationalresourcesandtraining,develop
11fitnessorwellnessprograms[forasymptomaticpersons], orprovidescreeningorconsultative
12serviceswithinthescopeofphysicaltherapypracticewithout[the]aprescription[and
13directionof]orreferralfromanapprovedhealthcareprovider.
14 4.[Aphysicaltherapistmayexamineandtreatwithouttheprescriptionanddirection
15ofanapprovedhealthcareprovideranypersonwitharecurringself-limitedinjurywithinone
16yearofdiagnosisbyanapprovedhealthcareproviderorachronicillnessthathasbeen
17previouslydiagnosedbyanapprovedhealthcareprovider.Thephysicaltherapistshall:
18 (1)Contactthepatient'scurrentapprovedhealthcareproviderwithinsevendaysof
19initiatingphysicaltherapyservicesunderthissubsection;
20 (2)Notchangeanexistingphysicaltherapyreferralavailabletothephysicaltherapist
21withoutapprovalofthepatient'scurrentapprovedhealthcareprovider;
HB2096	7 22 (3)Refertoanapprovedhealthcareprovideranypatientwhosemedicalconditionat
23thetimeofexaminationortreatmentisdeterminedtobebeyondthescopeofpracticeof
24physicaltherapy;
25 (4)Refertoanapprovedhealthcareprovideranypatientwhoseconditionforwhich
26physicaltherapyservicesarerenderedunderthissubsectionhasnotbeendocumentedtobe
27progressingtowarddocumentedtreatmentgoalsaftersixvisitsorfourteendays,whichever
28firstoccurs;
29 (5)Notifythepatient'scurrentapprovedhealthcareproviderpriortothecontinuation
30oftreatmentiftreatmentrenderedunderthissubsectionistocontinuebeyondthirtydays.
31Thephysicaltherapistshallprovidesuchnotificationforeachsuccessiveperiodofthirty
32days.
33 5.]Theprovisionofphysicaltherapyservicesofevaluationandscreeningpursuantto
34thissectionshallbelimitedtoaphysicaltherapist,andanyauthorityforevaluationand
35screeninggrantedwithinthissectionmaynotbedelegated.Uponeachreinitiationof
36physicaltherapyservices,aphysicaltherapistshallprovideafullphysicaltherapyevaluation
37priortothereinitiationofphysicaltherapytreatment.[Physicaltherapytreatmentprovided
38pursuanttotheprovisionsofsubsection4ofthissectionmaybedelegatedbyphysical
39therapiststophysicaltherapistassistantsonlyifthepatient'scurrentapprovedhealthcare
40providerhasbeensoinformedaspartofthephysicaltherapist'sseven-daynotificationupon
41reinitiationofphysicaltherapyservicesasrequiredinsubsection4ofthissection.] Nothing
42inthissubsectionshallbeconstruedastolimittheabilityofphysicaltherapistsorphysical
43therapistassistantstoprovidephysicaltherapyservicesinaccordancewiththeprovisionsof
44thischapter,anduponthereferralofanapprovedhealthcareprovider.Nothinginthis
45subsectionshallprohibitanapprovedhealthcareproviderfromactingwithinthescopeof
46theirpracticeasdefinedbytheapplicablechaptersofRSMo.
47 [6.]5.Nopersonlicensedtopractice,orapplicantforlicensure,asaphysical
48therapistorphysicaltherapistassistantshallmakeamedicaldiagnosis.
49 [7.]6.Aphysicaltherapistshallonlydelegatephysicaltherapytreatmenttoa
50physicaltherapistassistantortoapersoninanentrylevelofaprofessionaleducation
51programapprovedbytheCommissiononAccreditationinPhysicalTherapyEducation
52(CAPTE)whosatisfiessupervisedclinicaleducationrequirementsrelatedtotheperson's
53physicaltherapistorphysicaltherapistassistanteducation.Theentry-levelpersonshallbe
54underthesupervisionofaphysicaltherapist.
334.613.1.Theboardmayrefusetoissueorrenewalicensetopracticeasaphysical
2therapistorphysicaltherapistassistantforoneoranycombinationofcausesstatedin
3subsection2ofthissection.Theboardshallnotifytheapplicantinwritingofthereasonsfor
4therefusalandshalladvisetheapplicantoftheapplicant'srighttofileacomplaintwiththe

6toissueorrenewalicensetopracticeasaphysicaltherapistorphysicaltherapistassistant,the
7boardmay,atitsdiscretion,issuealicensewhichissubjecttoprobation,restriction,or
8limitationtoanapplicantforlicensureforanyoneoranycombinationofcausesstatedin
9subsection2ofthissection.Theboard'sorderofprobation,limitation,orrestrictionshall
10containastatementofthedisciplineimposed,thebasistherefor,thedatesuchactionshall
11becomeeffective,andastatementthattheapplicanthasthirtydaystorequestinwritinga
12hearingbeforetheadministrativehearingcommission.Iftheboardissuesaprobationary,
13limited,orrestrictedlicensetoanapplicantforlicensure,eitherpartymayfileawritten
14petitionwiththeadministrativehearingcommissionwithinthirtydaysoftheeffectivedateof
15theprobationary,limited,orrestrictedlicenseseekingreviewoftheboard'sdetermination.If
