SectionA.Chapter41,RSMo,isamendedbyaddingtheretoonenewsection,tobe
2knownassection41.037,toreadasfollows:
41.037.1.Thissectionshallbeknownandmaybecitedasthe"Defendthe
2GuardAct".
3 2.Asusedinthissection,thefollowingtermsmean:
4 (1)"Activedutycombat",performingthefollowingservicesintheactivefederal
5militaryserviceoftheUnitedStates:
6 (a)Participationinanarmedconflict;
7 (b)Performanceofahazardousserviceinaforeignstate;or
8 (c)Performanceofadutythroughaninstrumentalityofwar;
9 (2)"Officialdeclarationofwar",anofficialdeclarationofwarmadebythe
10UnitedStatesCongressunderClauseIIofArticleI,Section8,oftheConstitutionofthe
11UnitedStates.
12 3.Notwithstandinganyotherprovisionoflaw,theMissourinationalguardand
13anymemberthereofshallnotbereleasedfromthestateintoactivedutycombatunless
14theUnitedStatesCongresshaspassedanofficialdeclarationofwartoexplicitlycall
15forththeMissourinationalguard.Thegovernorshalltakeallactionsnecessaryto
16complywiththerequirementsofthissection.
