4 (2)Havenoencumbranceonanystatelicense; 5 (3)Beeligibleforacompactprivilegeinanymemberstateinaccordancewith 6section345.185; 7 (4)Havenothadanyadverseactionagainstanylicenseorcompactprivilege 8withintheprevious2yearsfromdateofapplication; 9 (5)NotifytheCommissionthatthelicenseeisseekingthecompactprivilege 10withinaremotestateorstates; 11 (6)Payanyapplicablefees,includinganystatefee,forthecompactprivilege; 12 (7)ReporttotheCommissionadverseactiontakenbyanynon-memberstate 13within30daysfromthedatetheadverseactionistaken. 14 2.Forthepurposesofthecompactprivilege,anaudiologistorspeech-language 15pathologistshallonlyholdonehomestatelicenseatatime. 16 3.Exceptasprovidedinsection345.200,ifanaudiologistorspeech-language 17pathologistchangesprimarystateofresidencebymovingbetweentwo-memberstates, 18theaudiologistorspeech-languagepathologistmustapplyforlicensureinthenewhome 19state,andthelicenseissuedbythepriorhomestateshallbedeactivatedinaccordance 20withapplicablerulesadoptedbytheCommission. 21 4.Theaudiologistorspeech-languagepathologistmayapplyforlicensurein 22advanceofachangeinprimarystateofresidence. 23 5.Alicenseshallnotbeissuedbythenewhomestateuntiltheaudiologistor 24speech-languagepathologistprovidessatisfactoryevidenceofachangeinprimarystate HCSHB2138 15 25ofresidencetothenewhomestateandsatisfiesallapplicablerequirementstoobtaina 26licensefromthenewhomestate. 27 6.Ifanaudiologistorspeech-languagepathologistchangesprimarystateof 28residencebymovingfromamemberstatetoanon-memberstate,thelicenseissuedby 29thepriorhomestateshallconverttoasingle-statelicense,validonlyintheformerhome 30state. 31 7.Thecompactprivilegeisvaliduntiltheexpirationdateofthehomestate 32license.Thelicenseemustcomplywiththerequirementsofsubsection1ofthissection 33tomaintainthecompactprivilegeintheremotestate. 34 8.Alicenseeprovidingaudiologyorspeech-languagepathologyservicesina 35remotestateunderthecompactprivilegeshallfunctionwithinthelawsandregulations 36oftheremotestate. 37 9.Alicenseeprovidingaudiologyorspeech-languagepathologyservicesina 38remotestateissubjecttothatstate'sregulatoryauthority.Aremotestatemay,in 39accordancewithdueprocessandthatstate'slaws,removealicensee'scompactprivilege 40intheremotestateforaspecificperiodoftime,imposefines,and/ortakeanyother 41necessaryactionstoprotectthehealthandsafetyofitscitizens. 42 10.Ifahomestatelicenseisencumbered,thelicenseeshalllosethecompact 43privilegeinanyremotestateuntilthefollowingoccur: 44 (1)Thehomestatelicenseisnolongerencumbered;and 45 (2)Twoyearshaveelapsedfromthedateoftheadverseaction. 46 11.Onceanencumberedlicenseinthehomestateisrestoredtogoodstanding, 47thelicenseemustmeettherequirementsofsubsection1ofthissectiontoobtaina 48compactprivilegeinanyremotestate. 49 12.Oncetherequirementsofsubsection10ofthissectionhavebeenmet,the 50licenseemustmeettherequirementsinsubsection1ofthissectiontoobtainacompact 51privilegeinaremotestate. 345.195.Memberstatesshallrecognizetherightofanaudiologistorspeech- 2languagepathologist,licensedbyahomestateinaccordancewithsection345.185and 3underrulespromulgatedbytheCommission,topracticeaudiologyorspeech-language 4pathologyinanymemberstateviatelehealthunderaprivilegetopracticeasprovidedin 5theCompactandrulespromulgatedbytheCommission. 345.200.Activedutymilitarypersonnel,ortheirspouse,shalldesignateahome 2statewheretheindividualhasacurrentlicenseingoodstanding.Theindividualmay 3retainthehomestatedesignationduringtheperiodtheservicememberisonactive 4duty.Subsequenttodesignatingahomestate,theindividualshallonlychangetheir 5homestatethroughapplicationforlicensureinthenewstate. HCSHB2138 16 345.205.1.Inadditiontotheotherpowersconferredbystatelaw,aremotestate 2shallhavetheauthority,inaccordancewithexistingstatedueprocesslaw,to: 3 (1)Takeadverseactionagainstanaudiologist'sorspeech-languagepathologist's 4privilegetopracticewithinthatmemberstate. 5 (2)Issuesubpoenasforbothhearingsandinvestigationsthatrequirethe 6attendanceandtestimonyofwitnessesaswellastheproductionofevidence.Subpoenas 7issuedbyalicensingboardinamemberstatefortheattendanceandtestimonyof 8witnessesortheproductionofevidencefromanothermemberstateshallbeenforcedin 9thelatterstatebyanycourtofcompetentjurisdiction,accordingtothepracticeand 10procedureofthatcourtapplicabletosubpoenasissuedinproceedingspendingbeforeit. 11Theissuingauthorityshallpayanywitnessfees,travelexpenses,mileageandotherfees 12requiredbytheservicestatutesofthestateinwhichthewitnessesorevidenceare 13located. 14 (3)Onlythehomestateshallhavethepowertotakeadverseactionagainstan 15audiologist'sorspeech-languagepathologist'slicenseissuedbythehomestate. 16 2.Forpurposesoftakingadverseaction,thehomestateshallgivethesame 17priorityandeffecttoreportedconductreceivedfromamemberstateasitwouldifthe 18conducthadoccurredwithinthehomestate.Insodoing,thehomestateshallapplyits 19ownstatelawstodetermineappropriateaction. 20 3.Thehomestateshallcompleteanypendinginvestigationsofanaudiologistor 21speech-languagepathologistwhochangesprimarystateofresidenceduringthecourse 22oftheinvestigations.Thehomestateshallalsohavetheauthoritytotakeappropriate 23actionoractionsandshallpromptlyreporttheconclusionsoftheinvestigationstothe 24administratorofthedatasystem.Theadministratorofthecoordinatedlicensure 25informationsystemshallpromptlynotifythenewhomestateofanyadverseactions. 26 4.Ifotherwisepermittedbystatelaw,thememberstatemayrecoverfromthe 27affectedaudiologistorspeech-languagepathologistthecostsofinvestigationsand 28dispositionofcasesresultingfromanyadverseactiontakenagainstthataudiologistor 29speech-languagepathologist. 30 5.Thememberstatemaytakeadverseactionbasedonthefactualfindingsofthe 31remotestate,providedthatthememberstatefollowsthememberstate'sown 32proceduresfortakingtheadverseaction. 33 6.(1)Inadditiontotheauthoritygrantedtoamemberstatebyitsrespective 34audiologyorspeech-languagepathologypracticeactorotherapplicablestatelaw,any 35memberstatemayparticipatewithothermemberstatesinjointinvestigationsof 36licensees. HCSHB2138 21 131 (b)TheCommissionmayacceptanyandallappropriaterevenuesources, 132donations,andgrantsofmoney,equipment,supplies,materials,andservices. 133 (c)TheCommissionmaylevyonandcollectanannualassessmentfromeach 134memberstateorimposefeesonotherpartiestocoverthecostoftheoperationsand 135activitiesoftheCommissionanditsstaff,whichmustbeinatotalamountsufficientto 136coveritsannualbudgetasapprovedeachyearforwhichrevenueisnotprovidedby 137othersources.Theaggregateannualassessmentamountshallbeallocatedbasedupona 138formulatobedeterminedbytheCommission,whichshallpromulgatearulebinding 139uponallmemberstates. 140 (9)TheCommissionshallnotincurobligationsofanykindpriortosecuringthe 141fundsadequatetomeetthesame;norshalltheCommissionpledgethecreditofanyof 142thememberstates,exceptbyandwiththeauthorityofthememberstate. 143 (10)TheCommissionshallkeepaccurateaccountsofallreceiptsand 144disbursements.ThereceiptsanddisbursementsoftheCommissionshallbesubject 145totheauditandaccountingproceduresestablishedunderitsbylaws.However,all 146receiptsanddisbursementsoffundshandledbytheCommissionshallbeauditedyearly 147byacertifiedorlicensedpublicaccountant,andthereportoftheauditshallbeincluded 148inandbecomepartoftheannualreportoftheCommission. 149 6.(1)Themembers,officers,executivedirector,employeesandrepresentatives 150oftheCommissionshallbeimmunefromsuitandliability,eitherpersonallyorintheir 151officialcapacity,foranyclaimfordamagetoorlossofpropertyorpersonalinjuryor 152othercivilliabilitycausedbyorarisingoutofanyactualorallegedact,erroror 153omissionthatoccurred,orthatthepersonagainstwhomtheclaimismadehada 154reasonablebasisforbelievingoccurredwithinthescopeofCommissionemployment, 155dutiesorresponsibilities;providedthatnothinginthissubdivisionshallbeconstruedto 156protectanypersonfromsuitand/orliabilityforanydamage,loss,injury,orliability 157causedbytheintentionalorwillfulorwantonmisconductofthatperson. 158 (2)TheCommissionshalldefendanymember,officer,executivedirector, 159employeeorrepresentativeoftheCommissioninanycivilactionseekingtoimpose 160liabilityarisingoutofanyactualorallegedact,error,oromissionthatoccurredwithin 161thescopeofCommissionemployment,duties,orresponsibilities,orthattheperson 162againstwhomtheclaimismadehadareasonablebasisforbelievingoccurredwithinthe 163scopeofCommissionemployment,duties,orresponsibilities;providedthatnothing 164hereinshallbeconstruedtoprohibitthatpersonfromretaininghisorherowncounsel; 165andprovidedfurther,thattheactualorallegedact,error,oromissiondidnotresult 166fromthatperson'sintentionalorwillfulorwantonmisconduct. HCSHB2138 22 167 (3)TheCommissionshallindemnifyandholdharmlessanymember,officer, 168executivedirector,employee,orrepresentativeoftheCommissionfortheamountofany 169settlementorjudgmentobtainedagainstthatpersonarisingoutofanyactualoralleged 170act,errororomissionthatoccurredwithinthescopeofCommissionemployment, 171duties,orresponsibilities,orthatpersonhadareasonablebasisforbelievingoccurred 172withinthescopeofCommissionemployment,duties,orresponsibilities,providedthat 173theactualorallegedact,error,oromissiondidnotresultfromtheintentionalorwillful 174orwantonmisconductofthatperson. 345.215.1.TheCommissionshallprovideforthedevelopment,maintenance, 2andutilizationofacoordinateddatabaseandreportingsystemcontaininglicensure, 3adverseaction,andinvestigativeinformationonalllicensedindividualsinmember 4states. 5 2.Notwithstandinganyotherprovisionofstatelawtothecontrary,amember 6stateshallsubmitauniformdatasettothedatasystemonallindividualstowhomthis 7CompactisapplicableasrequiredbytherulesoftheCommission,including: 8 (1)Identifyinginformation; 9 (2)Licensuredata; 10 (3)Adverseactionsagainstalicenseorcompactprivilege; 11 (4)Non-confidentialinformationrelatedtoalternativeprogramparticipation; 12 (5)Anydenialofapplicationforlicensure,andthereasonorreasonsfordenial; 13and 14 (6)OtherinformationthatmayfacilitatetheadministrationofthisCompact,as 15determinedbytherulesoftheCommission. 16 3.Investigativeinformationpertainingtoalicenseeinanymemberstateshall 17onlybeavailabletoothermemberstates. 18 4.TheCommissionshallpromptlynotifyallmemberstatesofanyadverseaction 19takenagainstalicenseeoranindividualapplyingforalicense.Adverseaction 20informationpertainingtoalicenseeinanymemberstateshallbeavailabletoanyother 21memberstate. 22 5.Memberstatescontributinginformationtothedatasystemmaydesignate 23informationthatmaynotbesharedwiththepublicwithouttheexpresspermissionof 24thecontributingstate. 25 6.Anyinformationsubmittedtothedatasystemthatissubsequentlyrequiredto 26beexpungedbythelawsofthememberstatecontributingtheinformationshallbe 27removedfromthedatasystem. HCSHB2138 23 345.220.1.TheCommissionshallexerciseitsrulemakingpowerspursuantto 2thecriteriasetforthinthisSectionandtherulesadoptedthereunder.Rulesand 3amendmentsshallbecomebindingasofthedatespecifiedineachruleoramendment. 4 2.Ifamajorityofthelegislaturesofthememberstatesrejectsarule,by 5enactmentofastatuteorresolutioninthesamemannerusedtoadopttheCompact 6within4yearsofthedateofadoptionoftherule,theruleshallhavenofurtherforceand 7effectinanymemberstate. 8 3.Rulesoramendmentstotherulesshallbeadoptedataregularorspecial 9meetingoftheCommission. 10 4.Priortopromulgationandadoptionofafinalruleorrulesbythe 11Commission,andatleastthirty(30)daysinadvanceofthemeetingatwhichtherule 12shallbeconsideredandvotedupon,theCommissionshallfileaNoticeofProposed 13Rulemaking: 14 (1)OnthewebsiteoftheCommissionorotherpubliclyaccessibleplatform;and 15 (2)Onthewebsiteofeachmemberstateaudiologyorspeech-languagepathology 16licensingboardorotherpubliclyaccessibleplatformorthepublicationinwhicheach 17statewouldotherwisepublishproposedrules. 18 5.TheNoticeofProposedRulemakingshallinclude: 19 (1)Theproposedtime,date,andlocationofthemeetinginwhichtheruleshall 20beconsideredandvotedupon; 67 (2)PreventalossofCommissionormemberstatefunds;or 68 (3)Meetadeadlineforthepromulgationofanadministrativerulethatis 69establishedbyfederallaworrule. 70 13.TheCommissionoranauthorizedcommitteeoftheCommissionmaydirect 71revisionstoapreviouslyadoptedruleoramendmentforpurposesofcorrecting 72typographicalerrors,errorsinformat,errorsinconsistency,orgrammaticalerrors. 73PublicnoticeofanyrevisionsshallbepostedonthewebsiteoftheCommission.The HCSHB2138 25 74revisionshallbesubjecttochallengebyanypersonforaperiodofthirty(30)daysafter 75posting.Therevisionmaybechallengedonlyongroundsthattherevisionresultsina 76materialchangetoarule.Achallengeshallbemadeinwritinganddeliveredtothe 77chairoftheCommissionpriortotheendofthenoticeperiod.Ifnochallengeismade, 78therevisionshalltakeeffectwithoutfurtheraction.Iftherevisionischallenged,the 79revisionmaynottakeeffectwithouttheapprovaloftheCommission. 345.225.1.(1)Uponrequestbyamemberstate,theCommissionshallattempt 2toresolvedisputesrelatedtotheCompactthatariseamongmemberstatesandbetween 3memberandnon-memberstates. 4 (2)TheCommissionshallpromulgatearuleprovidingforbothmediationand 5bindingdisputeresolutionfordisputesasappropriate. 6 2.(1)TheCommission,inthereasonableexerciseofitsdiscretion,shallenforce 7theprovisionsandrulesofthisCompact. 8 (2)Bymajorityvote,theCommissionmayinitiatelegalactionintheUnited 9StatesDistrictCourtfortheDistrictofColumbiaorthefederaldistrictwherethe 10Commissionhasitsprincipalofficesagainstamemberstateindefaulttoenforce 11compliancewiththeprovisionsoftheCompactanditspromulgatedrulesandbylaws. 12Thereliefsoughtmayincludebothinjunctivereliefanddamages.Intheeventjudicial 13enforcementisnecessary,theprevailingmembershallbeawardedallcostsoflitigation, 14includingreasonableattorney'sfees. 15 (3)TheremedieshereinshallnotbetheexclusiveremediesoftheCommission. 16TheCommissionmaypursueanyotherremediesavailableunderfederalorstatelaw. 345.230.1.TheCompactshallcomeintoeffectonthedateonwhichthe 2Compactstatuteisenactedintolawinthe10thmemberstate.Theprovisions,which 3becomeeffectiveatthattime,shallbelimitedtothepowersgrantedtotheCommission 4relatingtoassemblyandthepromulgationofrules.Thereafter,theCommissionshall 5meetandexerciserulemakingpowersnecessarytotheimplementationand 6administrationoftheCompact. 7 2.AnystatethatjoinstheCompactsubsequenttotheCommission'sinitial 8adoptionoftherulesshallbesubjecttotherulesastheyexistonthedateonwhichthe 9Compactbecomeslawinthatstate.Anyrulethathasbeenpreviouslyadoptedbythe 10CommissionshallhavethefullforceandeffectoflawonthedaytheCompactbecomes 11lawinthatstate. 12 3.AnymemberstatemaywithdrawfromthisCompactbyenactingastatute 13repealingthesame. 14 (1)Amemberstate'swithdrawalshallnottakeeffectuntilsix(6)monthsafter 15enactmentoftherepealingstatute. HCSHB2138 26 16 (2)Withdrawalshallnotaffectthecontinuingrequirementofthewithdrawing 17state'saudiologyorspeech-languagepathologylicensingboardtocomplywiththe 18investigativeandadverseactionreportingrequirementsofthisactpriortotheeffective 19dateofwithdrawal. 20 4.NothingcontainedinthisCompactshallbeconstruedtoinvalidateorprevent 21anyaudiologyorspeech-languagepathologylicensureagreementorothercooperative 22arrangementbetweenamemberstateandanon-memberstatethatdoesnotconflict 23withtheprovisionsofthisCompact. 24 5.ThisCompactmaybeamendedbythememberstates.Noamendmenttothis 25Compactshallbecomeeffectiveandbindinguponanymemberstateuntilitisenacted 26intothelawsofallmemberstates. 345.235.ThisCompactshallbeliberallyconstruedsoastoeffectuatethe 2purposesthereof.TheprovisionsofthisCompactshallbeseverableandifanyphrase, 3clause,sentenceorprovisionofthisCompactisdeclaredtobecontrarytothe 4constitutionofanymemberstateoroftheUnitedStatesortheapplicabilitythereofto 5anygovernment,agency,personorcircumstanceisheldinvalid,thevalidityofthe 6remainderofthisCompactandtheapplicabilitythereoftoanygovernment,agency, 7personorcircumstanceshallnotbeaffectedthereby.IfthisCompactshallbeheld 8contrarytotheconstitutionofanymemberstate,theCompactshallremaininfullforce 9andeffectastotheremainingmemberstatesandinfullforceandeffectastothe 10memberstateaffectedastoallseverablematters. 345.240.1.Nothinghereinpreventstheenforcementofanyotherlawofa 2memberstatethatisnotinconsistentwiththeCompact. 3 2.AlllawsinamemberstateinconflictwiththeCompactaresupersededtothe 4extentoftheconflict. 5 3.AlllawfulactionsoftheCommission,includingallrulesandbylaws 6promulgatedbytheCommission,arebindinguponthememberstates. 7 4.AllagreementsbetweentheCommissionandthememberstatesarebindingin 8accordancewiththeirterms. 9 5.IntheeventanyprovisionoftheCompactexceedstheconstitutionallimits 10imposedonthelegislatureofanymemberstate,theprovisionshallbeineffectivetothe 11extentoftheconflictwiththeconstitutionalprovisioninquestioninthatmemberstate. ✔ HCSHB2138 27
