Torepealsection169.560,RSMo,andtoenactinlieuthereofonenewsectionrelatingto
teacherandschoolemployeeretirementsystems.
BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows:
SectionA.Section169.560,RSMo,isrepealedandonenewsectionenactedinlieu
2thereof,tobeknownassection169.560,toreadasfollows:
169.560.1.Anypersonretiredandcurrentlyreceivingaretirementallowance
2pursuanttosections169.010to169.141,otherthanfordisability,maybeemployedinany
3capacityforanemployerincludedintheretirementsystemcreatedbythosesectionsoneither
4apart-timeortemporary-substitutebasisnottoexceedatotaloffivehundredfiftyhoursin
5anyoneschoolyear,andthroughsuchemploymentmayearnuptofiftypercentoftheannual
6compensationpayableundertheemployer'ssalaryscheduleforthepositionorpositionsfilled
7bytheretiree,givensuchperson'slevelofexperienceandeducation,withouta
8discontinuanceoftheperson'sretirementallowance.Iftheemployerdoesnotutilizea
9salaryschedule,orifthepositioninquestionisnotsubjecttotheemployer'ssalaryschedule,
10aretireeemployedinaccordancewiththeprovisionsofthissubsectionmayearnuptofifty
11percentoftheannualcompensationpaidtothepersonorpersonswholastheldsuchposition
12orpositions.Ifthepositionorpositionsdidnotpreviouslyexist,thecompensationlimitshall
13bedeterminedinaccordancewithrulesdulyadoptedbytheboardoftrusteesoftheretirement
14system;providedthat,itshallnotexceedfiftypercentoftheannualcompensationpayablefor
15thepositionbytheemployerthatismostcomparabletothepositionfilledbytheretiree.In
16anycasewherearetireefillsmorethanonepositionduringtheschoolyear,thefifty-percent
17limitonpermittedearningshallbebasedsolelyontheannualcompensationofthehighest
EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis
intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 18paidpositionoccupiedbytheretireeforatleastone-fifthofthetotalhoursworkedduringthe
19year.Suchapersonshallnotcontributetotheretirementsystemortothepubliceducation
20employeeretirementsystemestablishedbysections169.600to169.715becauseofearnings
21duringsuchperiodofemployment.Ifsuchapersonisemployedinanycapacitybysuchan
22employerinexcessofthelimitationssetforthinthissubsection,thepersonshallnotbe
23eligibletoreceivetheperson'sretirementallowanceforanymonthduringwhichthepersonis
24soemployed.Inaddition,suchpersonshallcontributetotheretirementsystemiftheperson
25satisfiestheretirementsystem'smembershipeligibilityrequirements.Inadditiontothe
26conditionssetforthabove,thissubsectionshallapplytoanypersonretiredandcurrently
27receivingaretirementallowanceundersections169.010to169.141,otherthanfordisability,
28whoisemployedbyathirdpartyorisperformingworkasanindependentcontractor,ifsuch
29personisperformingworkforanemployerincludedintheretirementsystemasatemporary
30orlong-termsubstituteteacherorinanyotherpositionthatwouldnormallyrequirethat
31persontobedulycertificatedunderthelawsgoverningthecertificationofteachersin
32Missouriifsuchpersonwasemployedbythedistrict.Theretirementsystemmayrequirethe
33employer,thethird-partyemployer,theindependentcontractor,andtheretireesubjecttothis
34subsectiontoprovidedocumentationshowingcompliancewiththissubsection.Ifsuch
35documentationisnotprovided,theretirementsystemmaydeemtheretireetohaveexceeded
36thelimitationsprovidedinthissubsection.
37 2.Notwithstandinganyotherprovisionofthissection,anypersonretiredand
38currentlyreceivingaretirementallowanceinaccordancewithsections169.010to169.141,
39otherthanfordisability,maybeemployedbyanemployerincludedintheretirementsystem
40createdbythosesectionsinapositionthatdoesnotnormallyrequireapersonemployedin
41thatpositiontobedulycertificatedunderthelawsgoverningthecertificationofteachersin
42Missouri,andthroughsuchemploymentmayearnuptosixtypercentofthe[minimum]
43averageteacher'ssalary[assetforthinsection163.172]fortheprimarydistrictthe
44personwillbeemployedinafterretirement,withoutadiscontinuanceoftheperson's
45retirementallowancefromtheretirementsystem. Suchpersonshallnotcontributetothe
46retirementsystemortothepubliceducationemployeeretirementsystemestablishedby
47sections169.600to169.715becauseofearningsduringsuchperiodofemployment,andsuch
48personshallnotearnmembershipserviceforsuchemployment.Theemployer'scontribution
49rateshallbepaidbythehiringemployerintothepubliceducationemployeeretirement
50systemestablishedbysections169.600to169.715.Ifsuchapersonisemployedinany
51capacitybyanemployerinexcessofthelimitationssetforthinthissubsection,theperson
52shallnotbeeligibletoreceivetheperson'sretirementallowanceforanymonthduringwhich
53thepersonissoemployed.Inaddition,suchpersonshallbecomeamemberofandcontribute
54toanyretirementsystemdescribedinthissubsectionifthepersonsatisfiestheretirement

56applytoanypersonretiredandcurrentlyreceivingaretirementallowanceinaccordancewith
57sections169.010to169.141employedbyapubliccommunitycollege.
