Currently,actionsforpersonalinjuryorrelatingtouninsured motoristcoverageorunderinsuredmotoristcoveragemustbebrought withinfiveyearsfromthedatetheinjuryoccurred. Thisbill reducesthetimeframetotwoyearsfromwhentheinjuryoccurred. Thisbillalsoappliestoasbestostortactionsfiledonorafter August28,2022,andtoasbestosactionsfiledbeforeAugust28, 2022.Thebill: (1)Requiresaclaimanttoprovideallpartiesinanactiona swornstatementandinformationformindicatingthatallasbestos trustclaimsthattheclaimantcanfilehavebeencompletedand filed.Inaddition,theclaimantmustprovideallpartieswithall trustmaterialsrelatingtotheasbestosexposureandrelated claims; (2)Allowsanydefendantinanasbestostortactiontofilea motionforanordertorequiretheclaimanttofiletheadditional asbestostrustclaimsthedefendantbelievestheclaimantis eligibletofile; (3)Requirestrustclaimsmaterialsandtrustgovernancedocuments tobeadmissibleinevidence.
