196andadministersuchbenefitplan.
104.020.Thereisherebycreatedthe"MissouriDepartmentofTransportationand
2HighwayPatrolEmployees'RetirementSystem",whichshallbeabodycorporateandan
3instrumentalityofthestate.Insuchsystemshallbevestedthepowersanddutiesspecifiedin
4sections104.010to[104.270] 104.312andsuchotherpowersasmaybenecessaryorproper
5toenableit,itsofficers,employees,andagentstocarryoutfullyandeffectivelyallthe
6purposesofsections104.010to[104.270] 104.312.
104.035.1.AnymemberwhoseemploymentterminatedpriortoAugust13,1976,
2andwhohadservedtwentyyearsormoreasanemployeeshallbeentitledtoadeferred
3normalannuitybasedonhiscreditableservice,averagecompensation,andtheactineffectat
4thetimehisemploymentwasterminated.
5 2.AnymemberwhoseemploymentterminatesonorafterAugust13,1976,andprior
6toJune1,1981,andwhohadservedfifteenormoreyears'creditableserviceasanemployee
7orhadservedtenormoreyearsofcreditableserviceasanemployeeandwasatleastthirty-
8fiveyearsofageatthedateofterminationofemploymentshallbeentitledtoadeferred
9normalannuitybasedonhiscreditableservice,averagecompensation,andtheactineffectat
10thetimehisemploymentwasterminated.
11 3.AnymemberwhoseemploymentterminatesonorafterJune1,1981,andwhohas
12tenormoreyearsofcreditableserviceatthedateofterminationofemploymentshallbe
13entitledtoadeferrednormalannuitybasedonthemember'screditableservice,average
14compensationandtheactineffectatthetimethemember'semploymentisterminated.
15 4.Anymemberentitledtoadeferrednormalannuityasprovidedinsubsection1,2,3
16or5ofthissectionwhoreenterstheserviceofadepartmentandagainbecomesamemberof
17thesystem[andthereafterservesforonecontinuousyear]shallhavehispriorperiodof
18servicerestored,sothatbenefitsdeterminedbyreasonofhisretirementorsubsequent
19withdrawalfromservicewillincludethesumofallperiodsofcreditableservice,andhis
20annuityshallbebasedonhiscreditableservice,averagecompensation,andtheactineffectat
21thetimeofhisretirementorsubsequentwithdrawalfromservice.
22 5.Notwithstandinganyotherlawtothecontrary,anymemberofthetransportation
23departmentandhighwaypatrolretirementsystemwhoseemploymentterminatedonorafter
24September28,1992,whohasfiveormoreyearsofvestingserviceasanemployeeatthedate
25ofterminationofemploymentshallbeentitledtoadeferrednormalannuitybasedonthe
26member'screditableservice,averagecompensation,andtheactineffectatthetimethe
27member'semploymentwasterminated.
HB2234	7 104.090.1.Thenormalannuityofamembershallequaloneandsix-tenthspercent
2oftheaveragecompensationofthemembermultipliedbythenumberofyearsofcreditable
3serviceofsuchmember.Inaddition,thenormalannuityofauniformedmemberofthepatrol
4shallbeincreasedbythirty-threeandone-thirdpercent.
5 2.Inaddition,auniformedmemberofthehighwaypatrolwhoisretiringwitha
6normalannuityafterattainingnormalretirementageshallreceiveanadditionalsumofninety
7dollarspermonthasacontributionbythesystemuntilsuchmemberattainstheageofsixty-
8fiveyears,whensuchcontributionshallcease.Toqualifyforthecontributionprovidedin
9thissubsectionbythesystem,theretireduniformedmemberofthehighwaypatrolismade,
10constituted,appointedandemployedbytheboardasaspecialconsultantontheproblemsof
11retirement,agingandotherstatematters.Suchadditionalcontributionshallbereducedeach
12monthbysuchamountearnedbytheretireduniformedmemberofthehighwaypatrolin
13gainfulemployment.Inordertoqualifyfortheadditionalcontributionprovidedinthis
14subsection,theretireduniformedmemberofthehighwaypatrolshallhavebeen:
15 (1)HiredbytheMissouristatehighwaypatrolpriortoJanuary1,1995;and
16 (2)EmployedbytheMissouristatehighwaypatrolorreceivinglong-termdisability
17orwork-relateddisabilitybenefitsonthedaybeforetheeffectivedateofthemember's
18retirement.
19 3.Inlieuoftheannuitypayabletothememberpursuanttosection104.100,a
20memberwhoseageatretirementisforty-eightormoremayelectinthemember'sapplication
21forretirementtoreceiveoneofthefollowing:
22	Option1.
23 Anactuarialreductionapprovedbytheboardofthemember'sannuityinreduced
24monthlypaymentsforlifeduringretirementwiththeprovisionthatuponthemember'sdeath
25thereducedannuityatdateofdeathshallbecontinuedthroughoutthelifeof,andbepaidto,
26themember'sspouse;or
27	Option2.
28 Themember'snormalannuityinregularmonthlypaymentsforlifeduringretirement
29withtheprovisionthatuponthemember'sdeathasurvivor'sbenefitequaltoone-halfthe
30member'snormalannuityatdateofdeathshallbepaidtothemember'sspouseinregular
31monthlypaymentsforlife;or
32	Option3.
33 Anactuarialreductionapprovedbytheboardofthemember'snormalannuityin
34reducedmonthlypaymentsforthemember'slifewiththeprovisionthatifthememberdies
35priortothemember'shavingreceivedonehundredtwentymonthlypaymentsofthemember's
36reducedannuity,themember'sreducedallowancetowhichthememberwouldhavebeen
37entitledhadthememberlivedshallbepaidfortheremainderoftheonehundredtwenty-

39dulyexecutedandfiledwiththeboard.Ifthereisnobeneficiarysurvivingtheretiree,the
40reserveforsuchallowancefortheremainderofsuchonehundredtwenty-monthperiodshall
41bepaidtotheretiree'sestate;or
42	Option4.
43 Anactuarialreductionapprovedbytheboardofthemember'snormalannuityin
44reducedmonthlypaymentsforthemember'slifewiththeprovisionthatifthememberdies
45priortothememberhavingreceivedsixtymonthlypaymentsofthemember'sreduced
46annuity,themember'sreducedallowancetowhichthememberwouldhavebeenentitledhad
47thememberlivedshallbepaidfortheremainderofthesixty-monthperiodtosuch
48beneficiaryasthemembershallhavenominatedbywrittendesignationdulyexecutedand
49filedwiththeboard.Ifthereisnobeneficiarysurvivingtheretiree,thereserveforsuch
50allowancefortheremainderofsuchsixty-monthperiodshallbepaidtotheretiree'sestate.
51 4.Theelectionmaybemadeonlyintheapplicationforretirement,andsuch
52applicationshallbefiledatleastthirtydaysbutnotmorethanninetydayspriortothedateon
53whichtheretirementofthememberistobeeffective,providedthatifeitherthememberor
54thespousenominatedtoreceivethesurvivorshippaymentdiesbeforetheeffectivedateof
55retirement,theelectionshallnotbeeffective.Ifafterthereducedannuitycommences,the
56spousepredeceasestheretiredmember,thereducedannuitycontinuestotheretiredmember
57duringthemember'slifetime.
58 5.EffectiveJuly1,2000,amembermaymakeanelectionunderoption1or2after
59thedateretirementbenefitsareinitiatedifthemembermakestheelectionwithinoneyear
60fromthedateofmarriageorJuly1,2000,whicheverislater,underanyofthefollowing
61circumstances:
62 (1)Thememberelectedtoreceiveanormalannuityandwasnoteligibletoelect

11 2.Theboardoftrusteesmayrequireamedicalexaminationofanyuniformed
12memberofthewaterpatrolwhoisreceivingdisabilitybenefitspursuanttothissectionatany
13timebyadesignatedphysician,anddisabilitybenefitsshallbediscontinuediftheboardfinds
14thatsuchmemberisabletoperformthedutiesofthemember'sformerposition,orifsuch
15memberrefusestosubmittosuchanexamination.
16 3.Thedisabilitybenefitsdescribedinthissectionshallnotbepaidtoanyuniformed
17memberofthewaterpatrolwhohasretainedorregainedmorethanfiftypercentofthe
18member'searningcapacity.Ifanyuniformedmemberofthewaterpatrolwhohasbeen
19receivingdisabilitybenefitsagainbecomesanemployee,themember'sdisabilitybenefits
20shallbediscontinued,themember'spriorperiodofcreditableserviceshallberestored,and

4generation.Suchcontributiondeterminationsrequireregularactuarialvaluations,whichshall
5bemadebytheboard'sactuary,usingassumptionsandmethodsadoptedbytheboardafter
6consultingwithitsactuary.Theentryagenormalcostvaluationmethodshallbeusedin

9 2.Atleastninetydaysbeforeeachregularsessionofthegeneralassembly,theboard
10shallcertifytothedivisionofbudgetthecontributionratenecessarytocovertheliabilitiesof
11theplanadministeredbythesystem,includingcostsofadministration,expectedtoaccrue
12duringthenextappropriationperiod.Thecommissionerofadministrationshallrequest
13appropriationoftheamountcalculatedpursuanttotheprovisionsofthissubsection.
14Followingeachpayperiod,thecommissionerofadministrationshallrequisitionandcertify
15thepaymenttotheexecutivedirectoroftheMissouristateemployees'retirementsystem.The
16executivedirectorshallpromptlydeposittheamountscertifiedtothecreditoftheMissouri
17stateemployees'retirementfund.
18 3.Theemployersofmembersofthesystemwhoarenotpaidoutoffundsthathave
19beendepositedinthestatetreasuryshallremitpromptlytotheexecutivedirectoranamount
20equaltotheamountwhichthestatewouldhavepaidifthosemembershadbeenpaidentirely
21fromstatefunds.Theexecutivedirectorshallpromptlydeposittheamountscertifiedtothe
22creditoftheMissouristateemployees'retirementsystemfund.
23 4.Theseamountsarefundsofthesystem,andshallnotbecommingledwithany
24fundsinthestatetreasury.
104.490.1.Shouldanyerrorresultinanymemberorbeneficiaryreceivingmoreor
2lessthanheorshewouldhavebeenentitledtoreceivehadtheerrornotoccurred,theboard
3shallcorrectsucherror,and,asfaraspracticable,makefuturepaymentsinsuchamannerthat

27disabilitybenefits.Allcontributionsmadeonbehalfofmembersofthestatetransportation

29funds.Ifthehighwaysandtransportationcommissionsoelects,thespousesand
30unemancipatedchildrenundertwenty-threeyearsofageofemployeeswhoaremembers
31ofthestatetransportationdepartmentemployees'andhighwaypatrolretirementsystemshall
32beabletoparticipateintheprogramofinsurancebenefitstocovermedicalexpensespursuant
33totheprovisionsofsubsection3ofthissection.
34 3.Theboardshalldeterminethepremiumamountsrequiredforparticipating
35employees.Thepremiumamountsshallbetheamount,which,togetherwiththestate's
36contribution,isrequiredtofundthebenefitsprovided,takingintoaccountnecessaryactuarial
37reserves.Separatepremiumsshallbeestablishedforemployees'benefitsandaseparate
38premiumorscheduleofpremiumsshallbeestablishedforbenefitsforspousesand
39unemancipatedchildrenundertwenty-threeyearsofageofparticipatingemployees.The
40employee'spremiumsforspouseandchildrenbenefitsshallbeestablishedtocoverthat
41portionofthecostofsuchbenefitswhichisnotpaidforbycontributionsbythestate.All
42suchpremiumamountsshallbepaidtotheboardoftrusteesatthetimethateachemployee's
43wagesorsalarywouldnormallybepaid.Thepremiumamountssoremittedwillbeplacedin
44theseparateaccountformedical,lifeinsuranceanddisabilitybenefits.Inlieuofthe
45availabilityofpremiumdeductions,theboardmayestablishalternativemethodsforthe
46collectionofpremiumamounts.
47 4.Eachspecialconsultanteligibleforlifebenefitsemployedbyaboardoftrusteesof
48aretirementsystemasprovidedinsection104.610whoisamemberoftheMissouristatelife
49insuranceplanorMissouristatetransportationdepartmentandMissouristatehighwaypatrol
50lifeinsuranceplanshall,inadditiontodutiesprescribedinsection104.610oranyotherlaw,
51anduponrequestoftheboardoftrustees,givetheboard,orallyorinwriting,ashortdetailed

4beyondnormalretirementage,mayelecttoreceiveanannuityandlumpsumpaymentor
5payments,determinedasfollows:
6 (1)Aretroactivestartingdateshallbeestablishedwhichshallbeadateselectedby
7themember;provided,however,thattheretroactivestartingdateselectedbythemember
8shallnotbeadatewhichisearlierthanthedatewhenanormalannuitywouldhavefirstbeen
9payable.Inaddition,theretroactivestartingdateshallnotbemorethanfiveyearspriortothe

10 2.Amember'sannuityshallbepaidintheformofalifeannuity,exceptasprovided
11insection104.1027,andshallbeanamountforlifeequaltooneandseven-tenthspercentof
12thefinalaveragepayofthemembermultipliedbythemember'syearsofcreditedservice.
13 3.Thelifeannuitydefinedinsubsection2ofthissectionshallnotbelessthana
14monthlyamountequaltofifteendollarsmultipliedbythemember'sfullyearsofcredited
15service.
16 4.Ifasoftheannuitystartingdateofamemberwhohasattainednormalretirement
17eligibilitythesumofthemember'syearsofageandyearsofcreditedserviceequalseightyor
18moreyearsandifthemember'sageisatleastforty-eightyearsbutlessthansixty-twoyears,
19or,inthecaseofamemberofthehighwaypatrolwhoshallbesubjecttothemandatory

25temporaryannuitypursuanttosection104.1045shallterminateattheendofthecalendar
26monthinwhichtheearlierofthefollowingeventsoccurs:themember'sdeathorthe
27member'sattainmentoftheearliestageofeligibilityforreducedSocialSecurityretirement
28benefits,butnolaterthanagesixty-two.
29 5.Theannuitydescribedinsubsection2ofthissectionforanypersonwhohas
30creditedservicenotcoveredbythefederalSocialSecurityAct,asprovidedin[sections
31105.300to105.430] subdivision(1)ofsubsection7ofsection104.342, shallbecalculated

39leasttwoyearsbeyondthedateofnormalretirementeligibility,mayelecttoreceivean
40annuityandlumpsumpaymentorpayments,determinedasfollows:

42themember;provided,however,thattheretroactivestartingdateselectedbythemember
43shallnotbeadatewhichisearlierthanthedatewhenanormalannuitywouldhavefirstbeen
44payable.Inaddition,theretroactivestartingdateshallnotbemorethanfiveyearspriortothe
45annuitystartingdate.Themember'sselectionofaretroactivestartingdateshallbedonein

10 2.Apersonwhoknowinglymakesafalsestatement,orfalsifiesorpermitstobe
11falsifiedarecordofthesystem,inanattempttodefraudthesystemshallbesubjecttofineor
12imprisonmentundertheMissourirevisedstatutes.
13 3.Aboardshallnotpayanannuitytoanysurvivororbeneficiarywhoischargedwith
14theintentionalkillingofamember,retireeorsurvivorwithoutlegalexcuseorjustification.A
15survivororbeneficiarywhoisconvictedofsuchchargeshallnolongerbeentitledtoreceive
16anannuity.Ifthesurvivororbeneficiaryisnotconvictedofsuchcharge,theboardshall

18weresuspendedpendingresolutionofsuchcharge.
104.1066.1.Theyear2000planintendstofollowafinancingpatternwhich
2computesandrequirescontributionamountswhich,expressedaspercentsofactivemember
3payroll,willremainapproximatelylevelfromyeartoyearandfromonegenerationof
4citizenstothenextgeneration.Suchcontributiondeterminationsrequireregularactuarial
5valuations,whichshallbemadebytheboard'sactuary,usingassumptionsandmethods
6adoptedbytheboardafterconsultingwithitsactuary.Theentryage-normalcostvaluation
7methodshallbeusedindeterminingthenormalcost[,andcontributionsforunfundedaccrued
8liabilitiesshallbedeterminedusinglevelpercent-of-payrollamortization] calculation. For
9purposesofthissubsectionandsection104.436,theactuaryshalldetermineasingle
10contributionrateapplicabletobothclosedplanandyear2000planparticipantsand,in
11determiningsuchrate,makeestimatesoftheprobabilitiesofclosedplanparticipants
12transferringtotheyear2000plan.
13 2.Atleastninetydaysbeforeeachregularsessionofthegeneralassembly,theboard
14oftheMissouristateemployees'retirementsystemshallcertifytothedivisionofbudgetthe
15contributionratenecessarytocovertheliabilitiesoftheyear2000planadministeredbysuch
16system,includingcostsofadministration,expectedtoaccrueduringthenextappropriation
17period.Thecommissionerofadministrationshallrequestappropriationsbaseduponthe
18contributionratesocertified.Fromappropriationssomade,thecommissionerof
19administrationshallcertifycontributionamountstothestatetreasurerwhointurnshall
20immediatelypaythecontributionstotheyear2000plan.
21 3.TheemployersofmemberscoveredbytheMissouristateemployees'retirement
22systemwhoarenotpaidoutoffundsthathavebeendepositedinthestatetreasuryshallremit
23followingeachpayperiodtotheyear2000plananamountequaltotheamountwhichthe
24statewouldhavepaidifthosemembershadbeenpaidentirelyfromstatefunds.Such
25employersshallmaintainpayrollrecordsforaminimumoffiveyearsandshallproduceall
26suchrecordsasrequestedbythesystem.Thesystemisauthorizedtorequestfromthestate
27officeofadministrationanappropriationoutoftheannualbudgetofanysuchemployerinthe
28eventsuchrecordsindicatethatsuchemployerhasnotcontributedtheamountsrequiredby
29thissection.Theofficeofadministrationshallrequestsuchappropriationwhichshallbe
30equaltotheamountnecessarytoreplaceanyshortfallincontributionsasdeterminedbythe
31system.Fromappropriationssomade,thecommissionerofadministrationshallcertify
