104.380.1.Ifaretiredmemberiselectedtoanystateofficeorisappointedtoany
2stateofficeorisemployedbyadepartmentinapositionnormallyrequiringtheperformance
3bythepersonofdutiesduringnotlessthanonethousandfortyhoursperyear,themember
4shallnotreceiveanannuityforanymonthorpartofamonthforwhichthememberservesas
5anofficeroremployee,butthemembershallbeconsideredtobeanewemployeewithno
6previouscreditableserviceandmustaccruecreditableservicecontinuouslyforatleastone
7yearinordertoreceiveanyadditionalannuity.Anyretiredmemberwhoagainbecomesan
8employeeandwhoaccruesadditionalcreditableserviceandlaterretiresshallreceivean
9additionalamountofmonthlyannuitycalculatedtoincludeonlythecreditableserviceandthe
10averagecompensationearnedbythemembersincesuchemploymentorcreditableservice
11earnedasamemberofthegeneralassembly.Yearsofmembershipserviceandtwelfthsofa
12yeararetobeusedincalculatinganyadditionalannuityexceptforcreditableserviceearned
13asamemberofthegeneralassembly,andsuchadditionalannuityshallbebasedonthetype
14ofserviceaccrued.Ineitherevent,theoriginalannuityandtheadditionalannuity,ifany,
15shallbepaidcommencingwiththeendofthefirstmonthafterthemonthduringwhichthe
16member'stermofofficehasbeencompleted,orthemember'semploymentterminated.Ifa
17retiredmemberisemployedbyadepartmentinapositionthatdoesnotnormallyrequirethe

27undersubsection3ofsection104.374arenotapplicabletoanyadditionalannuitypaidunder

29 2.Upontheendofreemployment,asdescribedinsubsection1ofthissection,a
30retireemaymakeanelectionunderoption1oroption2ofsubsection1ofsection
31104.395underthefollowingcircumstances:
32 (1)Thememberelectedtoreceivealifeannuityandwasnoteligibletoelect
33option1oroption2ofsubsection1ofsection104.395ontheoriginalannuitystarting
34date;and
35 (2)Themembermarriedduringreemployment.
36 3.Amembershallmaketheelectiondescribedinsubsection2ofthissection
37withinninetydaysofthefirstdayofthemonthfollowingtheterminationof
38reemployment.Suchelectionshallapplytoboththeoriginalandadditionalannuity.
39Suchelectionshallbeprospectiveandeffectivethefirstdayofthemonthfollowingthe
40dateofelection.
104.1039.1.Ifaretireeisemployedasanemployeebyadepartment,theretiree
2shallnotreceiveanannuitypaymentforanycalendarmonthinwhichtheretireeisso
3employed.Whilereemployedtheretireeshallbeconsideredtobeanewemployeewithno
4previouscreditedserviceandmustaccruecreditedservicecontinuouslyforatleastoneyear
5inordertoreceiveanyadditionalannuity.Suchretireeshallreceiveanadditionalannuityin
6additiontotheoriginalannuity,calculatedbasedonlyonthecreditedserviceandthepay
7earnedbysuchretireeduringreemploymentandpaidinaccordancewiththeannuityoption
8originallyelectedorasprovidedinsubsection2ofthissection; providedsuchretireewho
9ceasestoreceiveanannuitypursuanttothissectionshallnotreceivesuchadditionalannuity
10ifsuchretireeisemployedbyadepartmentinapositionthatiscoveredbyastate-sponsored
11definedbenefitretirementplannotcreatedpursuanttothischapter.Theoriginalannuityand
12anyadditionalannuityshallbepaidcommencingasoftheendofthefirstmonthafterthe
13monthduringwhichtheretiree'sreemploymentterminates.Cost-of-livingadjustmentspaid
14undersection104.1045shallnotaccruewhilearetireeisemployedasdescribedinthis
HB2236 2 15section.Anyfuturecost-of-livingadjustmentspaidaftertheretireeterminatessuch
16employmentwillbepaidinthesamemonthastheretiree'soriginalannualbenefitincreases
17werepaid.
18 2.Upontheendofreemployment,asdescribedinsubsection1ofthissection,a
19retireemaymakeanelectionunderoption1oroption2ofsubsection1ofsection
20104.1027underthefollowingcircumstances:
21 (1)Thememberelectedtoreceivealifeannuityandwasnoteligibletoelect
22option1oroption2ofsubsection1ofsection104.1027ontheoriginalannuitystarting
23date;and
24 (2)Themembermarriedduringreemployment.
25 3.AmemberoftheMissouristateemployeesretirementsystemshallmakethe
26electiondescribedinsubsection2ofthissectionwithinninetydaysofthe
27commencementoftheannuityandadditionalannuity.Suchelectionshallapplyto
28boththeoriginalandadditionalannuity.Suchelectionshallbeprospectiveand
29effectivethefirstdayofthemonthfollowingthedateofelection.
30 4.AmemberoftheMissouridepartmentoftransportationandhighwaypatrol
31employees'retirementsystemshallmaketheelectiondescribedinsubsection2ofthis
32sectionduringtheretirementapplicationprocess.Suchelectionshallapplytoboththe
33originalandadditionalannuity.Suchelectionshallbeprospectiveandeffectivethefirst
34dayofthemonthfollowingthedateofelection.
