13 (3)"Student",anychildattendinganelementaryorsecondarypublicschoolin 14gradeskindergartenthroughtwelve. 15 3.Beginningwiththe2023-24schoolyear,eachlocalschoolboardorcharter 16schoolshallroutinelyinformstudentsandparentsoftheabilityforstudentstoearn EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 17creditforparticipatinginextendedlearningopportunities.Publicschoolsandcharter 18schoolsmayassiststudentsandparentsincompletingenrollmentprocessesrequiredfor 19participatinginapprovedextendedlearningopportunities.Nostudentorparentshall 20berequiredtoobtainpermissionfromthestudent'sschooldistrictorcharterschoolto 21enrollinanextendedlearningopportunity.Beforeparticipatinginanyextended 22learningopportunity,thestudentandatleastoneparentshallsignanagreement 23detailingallprogramrequirementsinaformdevelopedbythedepartmentof 24elementaryandsecondaryeducationandapprovedbythestateboardofeducation. 25 4.Anextendedlearningopportunityshallcountasacredittowardgraduation 26requirementsandtheachievementofapplicablestatestandardsforstudents.Toreceive 27credit,astudentshallsubmitawrittenrequestforcreditandproofofsuccessful 28completionoftheextendedlearningopportunitytoadesignatedadministratorofthe 29schoolthestudentattends. 30 5.Eachlocalschooldistrictandcharterschoolshalladopt,distribute,and 31implementextendedlearningopportunitiespoliciesthatprovideallofthefollowing: 32 (1)Anapplicationprocessforacceptingandapprovingextendedlearning 33opportunitiesofferedforcreditfromoutsideentities; 34 (2)Alistofentitiesthatareeligibletosubmitapplicationstoofferextended 35learningopportunitiesincluding,butnotlimitedto: 36 (a)Nonprofitorganizations; 37 (b)Businesseswithestablishedlocations; 38 (c)Tradeassociations;and 39 (d)TheArmedForcesoftheUnitedStates,subjecttoapplicableage 40requirements; 41 (3)Aprocessforstudentsandparentstorequestcredit; 42 (4)Criteriathatschooldistrictsandcharterschoolsshallusetodetermine 43whetheraproposedextendedlearningopportunityshallbeapproved;and 44 (5)Criteriathatschooldistrictsandcharterschoolsshallusetoawarda 45certificateofcompletionandcreditforcompletinganextendedlearningopportunity 46including,butnotlimitedto,allowingastudenttodemonstratecompetenciesthrough 47performance-basedassessmentsandothermethodsindependentofinstructionaltime 48andcredithours. 49 6.Anentityapprovedbythestateboardofeducationtoofferanextended 50learningopportunityshallbeautomaticallyqualifiedtoofferthatextendedlearning 51opportunitytoallschooldistrictsandcharterschools. 52 7.Astudentwhosuccessfullycompletesanapprovedextendedlearning 53opportunityandsatisfiescriteriafortheawardofacertificationofcompletionand HB2325 2 54creditundersubdivision(5)ofsubsection5ofthissectionshallbeconsideredtohave 55completedallrequiredcourseworkfortheparticularcourse.Inanextendedlearning 56opportunitythatsatisfiesallrequiredcourseworkforahighschoolcourse,thestudent 57shallalsobeconsideredtohavesatisfiedtheequivalentnumberofcreditstowardthe 58student'sgraduationrequirements. 59 8.Anypolicyorprocedureadoptedbythestateboardofeducation,aschool 60board,oracharterschoolforparticipatinginanextendedlearningopportunityshall 61provideeverystudentanequalopportunitytoparticipateandshallsatisfyestablished 62timelinesandrequirementsforpurposesoftranscribingcreditsandstatereporting. 63 9.Thestateboardofeducationmaypromulgaterulestoimplementthe 64provisionsofthissection.Anyruleorportionofarule,asthattermisdefinedinsection 65536.010,thatiscreatedundertheauthoritydelegatedinthissectionshallbecome 66effectiveonlyifitcomplieswithandissubjecttoalloftheprovisionsofchapter536and, 67ifapplicable,section536.028.Thissectionandchapterarenonseverable,andifanyof 68thepowersvestedwiththegeneralassemblypursuanttochapter536toreview,todelay 69theeffectivedate,ortodisapproveandannularulearesubsequentlyheld 70unconstitutional,thenthegrantofrulemakingauthorityandanyruleproposedor 71adoptedafterAugust28,2022,shallbeinvalidandvoid. 160.2700.Forpurposesofsections160.2700to160.2725,"adulthighschool"means 2aschoolthat: 3 (1)Isforindividualswhodonothaveahighschooldiplomaandwhoaretwenty-one 4yearsofageorolder; 5 (2)Offersanindustrycertificationprogramorprogramsandahighschooldiplomain 6amannerthatallowsstudentstoearnadiplomaatthesametimethattheyearnanindustry 7certification; 8 (3)Offers[on-site] childcareforchildrenofenrolledstudentsattendingtheschool; 9and 10 (4)Isnoteligibletoreceivefundingundersection160.415or163.031. 160.2705.1.Thedepartmentofelementaryandsecondaryeducationshallauthorize 2beforeJanuary1,2018,aMissouri-basednonprofitorganizationmeetingthecriteriaunder 3subsection2ofthissectiontoestablishandoperatefouradulthighschools,with: 4 (1)Oneadulthighschooltobelocatedinacitynotwithinacounty; 5 (2)Oneadulthighschooltobelocatedinacountyofthethirdclassificationwithouta 6townshipformofgovernmentandwithmorethanforty-onethousandbutfewerthanforty- 7fivethousandinhabitantsoracountycontiguoustothatcounty; HB2325 3 8 (3)Oneadulthighschooltobelocatedinacountyofthefirstclassificationwith 9morethantwohundredsixtythousandbutfewerthanthreehundredthousandinhabitantsora 10countycontiguoustothatcounty;and 11 (4)Oneadulthighschooltobelocatedinacountyofthefirstclassificationwith 12morethanonehundredfiftythousandbutfewerthantwohundredthousandinhabitants. 13 2.Thedepartmentofelementaryandsecondaryeducationshallgrantthe 14authorizationdescribedundersubsection1ofthissectionbasedonabidprocess 15conductedinaccordancewiththerulesandregulationsgoverningpurchasingthroughthe 16officeofadministration.Thesuccessfulbiddershall: 17 (1)Demonstratetheabilitytoestablish,withintwenty-onemonthsofthereceiptof 18theauthorization,fouradulthighschoolsofferinghighschooldiplomas,anindustry 19certificationprogramorprograms,and[on-site] childcareforchildrenofthestudents 20attendingthehighschools; 21 (2)Commitatleasttwomilliondollarsininvestmentforthepurposeofestablishing 22thenecessaryinfrastructuretooperatefouradulthighschools; 23 (3)Demonstratesubstantialandpositiveexperienceinprovidingservices,including 24industrycertificationsandjobplacementservices,toadultstwenty-oneyearsofageorolder 25whoseeducationalandtrainingopportunitieshavebeenlimitedbyeducationaldisadvantages, 26disabilities,homelessness,criminalhistory,orsimilarcircumstances; 27 (4)Establishapartnershipwithastate-supportedpostsecondaryeducationinstitution 28ormorethanonesuchpartnership,ifapartnershiporpartnershipsarenecessaryinorderto 29meettherequirementsforanadulthighschool; 30 (5)Establishacomprehensiveplanthatsetsforthhowtheadulthighschoolswillhelp 31addresstheneedforasufficientlytrainedworkforceinthesurroundingregionforeachadult 32highschool; 33 (6)Establishpartnershipsandstrategiesforengagingthecommunityandbusiness 34leadersincarryingoutthegoalsofeachadulthighschool; 35 (7)Establishtheabilitytomeetqualitystandardsthroughcertifiedteachersand 36programsthatsupporteachstudentin[hisorher]suchstudent'sgoaltofindamore 37rewardingjob; 38 (8)Establishaplanforassistingstudentsinovercomingbarrierstoeducational 39successincluding,butnotlimitedto,educationaldisadvantages,homelessness,criminal 40history,disability,includinglearningdisabilitysuchasdyslexia,andsimilarcircumstances; 41 (9)Establishaprocessfordeterminingoutcomesoftheadulthighschool,including 42outcomesrelatedtoastudent'sabilitytofindamorerewardingjobthroughtheattainmentof 43ahighschooldiplomaandjobtrainingandcertification;and 44 (10)Bidsshallnotincludeanadministrativefeegreaterthantenpercent. HB2325 4 45 3.(1)Thedepartmentofelementaryandsecondaryeducationshallestablish 46academicrequirementsforstudentstoobtainhighschooldiplomas. 47 (2)Requirementsforahighschooldiplomashallbebasedonanadultstudent'sprior 48highschoolachievementandtheremainingcreditsandcourseworkthatwouldbenecessary 49forthestudenttoreceiveahighschooldiplomaif[heorshe]suchstudentwereina 50traditionalhighschoolsetting.Theadultstudentshallmeettherequirementswiththesame 51levelofacademicrigoraswouldotherwisebenecessarytoattainsuchcredits. 52 (3)Theadulthighschoolauthorizedunderthissectionshallawardhighschool 53diplomastostudentswhosuccessfullymeettheestablishedacademicrequirements.The 54adulthighschoolauthorizedunderthissectionshallconferthediplomaasthoughthestudent 55earnedthediplomaatatraditionalhighschool.Thediplomashallhavenodifferentiating 56marks,titles,orothersymbols. 57 (4)Studentsatadulthighschoolsmaycompleterequiredcourseworkattheirown 58paceandasavailablethroughtheadulthighschool.Theyshallnotberequiredtosatisfyany 59specificnumberofclassminutes.Theadulthighschoolmayalsomakeclassesavailableto 60studentsonlineasmaybeappropriate.However,studentsshallnotcompletethemajorityof 61instructionoftheschool'scurriculumonlineorthroughremoteinstruction.Forthepurposes 62ofthissubsection,synchronousinstructionconnectingstudentstoaliveclassconducted 63inaMissouriadulthighschoolshallbetreatedthesameasin-personinstruction. 64 (5)Thedepartmentofelementaryandsecondaryeducationshallnotcreateadditional 65regulationsorburdensontheadulthighschoolorthestudentsattendingtheadulthigh 66schoolsbeyondcertifyingnecessarycreditsandensuringthatstudentshavesufficiently 67masteredthesubjectmattertomakethemeligibleforcredit. 68 4.Anadulthighschoolshallbedeemeda"secondaryschoolsystem"forthe 69purposesofsubdivision(15)ofsubsection1ofsection210.211. 173.831.1.Asusedinthissection,thefollowingtermsmean: 2 (1)"Academicskillintakeassessment",acriterion-referencedassessmentof 3numeracyandliteracyskillswithhighreliabilityandvalidityasdeterminedbythird- 4partyresearch; 5 (2)"Accredited",holdinganactiveaccreditationfromoneofthesevenUnited 6Statesregionalaccreditorsincluding,butnotlimitedto,theMiddleStatesCommission 7onHigherEducation,theNewEnglandAssociationofSchoolsandColleges,theHigher 8LearningCommission,theNorthwestCommissiononCollegesandUniversities,the 9SouthernAssociationofCollegesandSchools,theWesternAssociationofSchoolsand 10Colleges,andtheAccreditingCommissionforCommunityandJuniorColleges,aswell 11asanysuccessorentitiesorconsolidationsoftheaboveincluding,butnotlimitedto, 12AdvancEdorCognia; HB2325 7 87 (2)Eachapprovedprogramprovidershallmeetallofthefollowing 88qualifications: 89 (a)Beanaccreditedhighschooldiploma-grantingentity; 90 (b)Haveaminimumoftwoyearsofexperienceprovidingadultdropout 91recoveryservices; 92 (c)Provideacademicskillintakeassessmentsandtranscriptevaluationstoeach 93student.Suchacademicskillintakeassessmentsmaybeadministeredinpersonor 94online; 95 (d)Developalearningplanforeachstudentthatintegratesgraduation 96requirementsandcareergoals; 97 (e)Provideacoursecatalogthatincludesallcoursesnecessarytomeet 98graduationrequirements; 99 (f)Offerremediationopportunitiesinliteracyandnumeracy,asapplicable; 100 (g)Offeremployabilityskillscertification,asapplicable; 101 (h)Offercareerpathwayscoursework,asapplicable; 102 (i)Abilitytoprovidepreparationforindustry-recognizedcredentialsor 103stackablecredentials,atechnicalskillsassessment,oracombinationthereof;and 104 (j)Offercareerplacementservices,asapplicable. 105 (3)Uponconfirmationbythedepartmentthataninterestedprogramprovider 106meetsallofthequalificationslistedinsubdivision(2)ofthissubsection,aninterested 107programprovidershallbecomeanapprovedprogramprovider. 108 4.(1)Thedepartmentshallannouncetheapprovedprogramprovidersbefore 109Octobersixteenthannually,withauthorizationfortheapprovedprogramprovidersto 110beginenrollingstudentsbeforeNovemberfifteenthannually. 111 (2)Approvedprogramprovidersshallmaintainapprovalwithoutreapplying 112annuallyiftheapprovedprogramproviderhasnotbeenremovedfromtheapproved 113programproviderlistunderthissection. 114 5.Allapprovedprogramprovidersshallcomplywithrequirementsasprovided 115bythedepartmenttoensure: 116 (1)Anaccurateaccountingofastudent'saccumulatedcreditstowardahigh 117schooldiploma; 118 (2)Anaccurateaccountingofcreditsnecessarytocompleteahighschool 119diploma;and 120 (3)Theprovisionofcourseworkalignedtotheacademicperformancestandards 121ofthestate. HB2325 8 122 6.(1)Exceptasprovidedinsubdivision(2)ofthissubsection,thedepartment 123shallpayanamountassetbythedepartmenttoapprovedprogramprovidersforthe 124followingmilestonesprovidedbytheapprovedprogramprovider: 125 (a)Completionofeachhalfunitofhighschoolcredit; 126 (b)Attainmentofanemployabilityskillscertification; 127 (c)Attainmentofanindustry-recognizedcredential,technicalskillsassessment, 128orstackablecredentialrequiringnomorethanfiftyhoursoftraining; 129 (d)Attainmentofanindustry-recognizedcredentialorstackablecredential 130requiringatleastfifty-onebutnomorethanonehundredhoursoftraining; 131 (e)Attainmentofanindustry-recognizedcredentialorstackablecredential 132requiringmorethanonehundredhoursoftraining;and 133 (f)Attainmentofanaccreditedhighschooldiploma. 134 (2)Noapprovedprogramprovidershallreceivefundingforastudentunderthis 135sectioniftheapprovedprogramproviderreceivesfederalorstatefundingorprivate 136tuitionforthatstudent.Noapprovedprogramprovidershallchargestudentfeesofany 137kindincluding,butnotlimitedto,textbookfees,tuitionfees,labfees,orparticipation 138feesunlessthestudentchoosestoobtainadditionaleducationofferedbytheapproved 139programproviderthatisnotincludedinthestate-fundedprogram. 140 (3)Paymentsmadeunderthissubsectionshallbesubjecttoanappropriation 141madetothedepartmentforsuchpurposes. 142 7.(1)Approvedprogramprovidersshallsubmitmonthlyinvoicestothe 143departmentbeforetheeleventhcalendardayofeachmonthformilestonesmetinthe 144previouscalendarmonth. 145 (2)Thedepartmentshallpayapprovedprogramprovidersintheorderinwhich 146invoicesaresubmitteduntilallavailablefundsareexhausted. 147 (3)Thedepartmentshallprovideawrittenupdatetoapprovedprogram 148providersbythelastcalendardayofeachmonth.Theupdateshallincludethe 149aggregatetotaldollarsthathavebeenpaidtoapprovedprogramproviderstodateand 150theestimatednumberofenrollmentsstillavailablefortheprogramyear. 151 8.BeforeJulysixteenthofeachyear,eachprovidershallreportthefollowing 152metricstothedepartmentforeachindividualcohort,onacohort-by-cohortbasis: 153 (1)Thetotalnumberofstudentswhohavebeenfundedthroughtheprogram; 154 (2)Thetotalnumberofcreditsearned; 155 (3)Thetotalnumberofemployabilityskillscertificationsissued; 156 (4)Thetotalnumberofindustry-recognizedcredentials,stackablecredentials, 157andtechnicalskillsassessmentsearnedforeachtieroffunding; 158 (5)Thetotalnumberofgraduates; HB2325 9 159 (6)Theaveragecostpergraduateoncethestipulatedtimetomakesucha 160calculationhaspassed;and 161 (7)Thegraduationrateoncethestipulatedtimetomakesuchacalculationhas 162passed. 163 9.(1)BeforeSeptembersixteenthofeachyear,eachapprovedprogram 164providershallconductandsubmittothedepartmenttheaggregateresultsofasurveyof 165eachindividualcohort,onacohort-by-cohortbasis,whograduatedfromtheprogramof 166theapprovedprogramproviderunderthissection.Thesurveyshallbeconductedinthe 167yearaftertheyearinwhichtheindividualsgraduateandthenextfourconsecutive 168years. 169 (2)Thesurveyshallincludeatleastthefollowingdatacollectionelementsfor 170eachyearthesurveyisconducted: 171 (a)Theindividual'semploymentstatus,includingwhethertheindividualis 172employedfulltimeorparttime; 173 (b)Theindividual'shourlywages; 174 (c)Theindividual'saccesstoemployer-sponsoredhealthcare;and 175 (d)Theindividual'spostsecondaryenrollmentstatus,includingwhetherthe 176individualhascompletedapostsecondarycertificateordegreeprogram. 177 10.(1)Beginningattheendofthesecondfiscalyearoftheprogram,the 178departmentshallreviewdatafromeachapprovedprogramprovidertoensurethateach 179isachievingminimumprogramperformancestandardsincluding,butnotlimitedto: 180 (a)Aminimumfiftypercentaveragegraduationratepercohort;and 181 (b)Anaveragecostpergraduatepercohortofseventhousanddollarsorless. 182 (2)Anyapprovedprogramproviderthatfailstomeettheminimumprogram 183performancestandardsdescribedinsubdivision(1)ofthissubsectionshallbeplacedon 184probationarystatusfortheremainderofthefiscalyearbythedepartment. 185 (3)Anyapprovedprogramproviderthatfailstomeettheminimumprogram 186performancestandardsdescribedinsubdivision(1)ofthissubsectionfortwo 187consecutiveyearsshallberemovedfromtheapprovedprogramproviderlistbythe 188department. 189 11.(1)Noapprovedprogramprovidershalldiscriminateagainstastudenton 190thebasisofrace,color,religion,nationalorigin,ancestry,sex,sexuality,gender,orage. 191 (2)Ifanapprovedprogramproviderdeterminesthatastudentwouldbebetter 192servedbyparticipatinginadifferentprogram,theapprovedprogramprovidermay 193referthestudenttothestate'sadultbasiceducationservices. 194 12.(1)Thereisherebycreatedinthestatetreasurythe"WorkforceDiploma 195ProgramFund",whichshallconsistofanygrants,gifts,donations,bequests,ormoneys HB2325 10 196appropriatedunderthissection.Thestatetreasurershallbecustodianofthefund.In 197accordancewithsections30.170and30.180,thestatetreasurermayapprove 198disbursements.Thefundshallbeadedicatedfundand,uponappropriation,moneys 199inthefundshallbeusedsolelyasprovidedinthissection. 200 (2)Notwithstandingtheprovisionsofsection33.080tothecontrary,anymoneys 201remaininginthefundattheendofthebienniumshallnotreverttothecreditofthe 202generalrevenuefund. 203 (3)Thestatetreasurershallinvestmoneysinthefundinthesamemanneras 204otherfundsareinvested.Anyinterestandmoneysearnedonsuchinvestmentsshallbe 205creditedtothefund. 206 13.Thedirectorofthedepartmentmaypromulgateallnecessaryrulesand 207regulationsfortheadministrationofthissection.Anyruleorportionofarule,asthat 208termisdefinedinsection536.010,thatiscreatedundertheauthoritydelegatedinthis 209sectionshallbecomeeffectiveonlyifitcomplieswithandissubjecttoallofthe 210provisionsofchapter536and,ifapplicable,section536.028.Thissectionandchapter 211536arenonseverable,andifanyofthepowersvestedwiththegeneralassembly 212pursuanttochapter536toreview,todelaytheeffectivedate,ortodisapproveandannul 213arulearesubsequentlyheldunconstitutional,thenthegrantofrulemakingauthority 214andanyruleproposedoradoptedafterAugust28,2022,shallbeinvalidandvoid. 215 14.Undersection23.253oftheMissourisunsetact: 216 (1)Theprovisionsofthenewprogramauthorizedunderthissectionshall 217automaticallysunsetsixyearsaftertheeffectivedateofthissectionunlessreauthorized 218byanactofthegeneralassembly;and 219 (2)Ifsuchprogramisreauthorized,theprogramauthorizedunderthissection 220shallautomaticallysunsettwelveyearsaftertheeffectivedateofthereauthorizationof 221thissection;and 222 (3)ThissectionshallterminateonSeptemberfirstofthecalendaryear 223immediatelyfollowingthecalendaryearinwhichtheprogramauthorizedunderthis 224sectionissunset. ✔ HB2325 11
