BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows:
SectionA.Section376.1800,RSMo,isrepealedandonenewsectionenactedinlieu
2thereof,tobeknownassection376.1800,toreadasfollows:
376.1800.1.Asusedinthissection,thefollowingtermsshallmean:
2 (1)"Dentist",adentistlicensedunderchapter332.Theterm"dentist"includes
3anindividualdentistoragroupofdentists;
4 (2)"Medicalretaineragreement",acontractbetweenaphysicianoradentistandan
5individualpatientorsuchindividualpatient'slegalrepresentativeinwhichthephysicianor
6dentistagreestoprovidecertainhealthcareservicesdescribedintheagreementtothe
7individualpatientforanagreed-uponfeeandperiodoftime;
8 [(2)](3)"Physician",aphysicianlicensedunderchapter334.Physicianincludesan
9individualphysicianoragroupofphysicians.
10 2.Amedicalretaineragreementisnotinsuranceandisnotsubjecttothischapter.
11Enteringintoamedicalretaineragreementisnotthebusinessofinsuranceandisnotsubject
12tothischapter.
13 3.Aphysician, adentist,oranagentofaphysicianordentistisnotrequiredto
14obtainacertificateofauthorityorlicenseunderthissectiontomarket,sell,oroffertosella
15medicalretaineragreement.
16 4.Tobeconsideredamedicalretaineragreementforthepurposesofthissection,the
17agreementshallmeetallofthefollowingrequirements:

intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 18 (1)Beinwriting;
19 (2)Besignedbythephysician, thedentist,ortheagentofthephysicianordentist
20andtheindividualpatientorsuchindividualpatient'slegalrepresentative;
21 (3)Alloweitherpartytoterminatetheagreementonwrittennoticetotheotherparty;
22 (4)Describethespecifichealthcareservicesthatareincludedintheagreement;
23 (5)Specifythefeefortheagreement;
24 (6)Specifytheperiodoftimeundertheagreement;and
25 (7)Prominentlystateinwritingthattheagreementisnothealthinsurance.
26 5.(1)Foranypatientwhoentersintoamedicalretaineragreementunderthissection
27andwhohasestablishedahealthsavingsaccount(HSA)incompliancewith26U.S.C.
28Section223,orwhohasaflexiblespendingarrangement(FSA)orhealthreimbursement
29arrangement(HRA),feesunderthepatient'smedicalretaineragreementmaybepaidfrom
30suchhealthsavingsaccountorreimbursedthroughsuchflexiblespendingarrangementor
31healthreimbursementarrangement,subjecttoanyfederalorstatelawsregardingqualified
32expendituresfromahealthsavingsaccount,orreimbursementthroughaflexiblespending
33arrangementorahealthreimbursementarrangement.
34 (2)Theemployerofanypatientdescribedinsubdivision(1)ofthissubsectionmay:
35 (a)Makecontributionstosuchpatient'shealthsavingsaccount,flexiblespending
36arrangement,orhealthreimbursementarrangementtocoveralloranyportionoftheagreed-
37uponfeesunderthepatient'smedicalretaineragreement,subjecttoanyfederalorstate
38restrictionsoncontributionsmadebyanemployertoahealthsavingsaccount,or
39reimbursementthroughaflexiblespendingarrangement,orhealthreimbursement
40arrangement;or
41 (b)Paytheagreed-uponfeesdirectlytothephysicianordentistunderthemedical
42retaineragreement.
43 6.Nothinginthissectionshallbeconstruedasprohibiting,limiting,orotherwise
44restrictingaphysicianinacollaborativepracticearrangementfromenteringintoamedical
45retaineragreementunderthissection.
