SectionA.Section558.041,RSMo,isrepealedandonenewsectionenactedinlieu
2thereof,tobeknownassection558.041,toreadasfollows:
558.041.1.Anyoffendercommittedtothedepartmentofcorrections,exceptthose
2personscommittedpursuanttosubsection7ofsection558.016,orsubsection3ofsection
3566.125,[may] shallreceiveadditionalcreditintermsofdaysspentinconfinement[upon
4recommendationforsuchcreditbytheoffender'sinstitutionalsuperintendentwhen] ifthe
5offendermeetstherequirementsforsuchcreditasprovidedinsubsections3[and],4,6,and8
6ofthissection.Goodtimecreditmayberescindedbythedirectororhisorherdesignee
7pursuanttothedivisionalpolicyissuedpursuanttosubsection3ofthissection.
8 2.Anycreditextendedtoanoffendershallonlyapplytothesentencewhichthe
9offenderiscurrentlyserving.
10 3.(1)Thedirectorofthedepartmentofcorrectionsshallissueapolicyforawarding
11credit.Thepolicy[may] shallrewardan[inmate] offenderwhohasservedhisorher
12sentenceinanorderlyandpeaceablemannerandhastakenadvantageoftherehabilitation
13programsavailabletohimorher.Anyviolationofmajorinstitutionalrules[or],thelawsof
14thisstate,ortheaccumulationofminorviolationsexceedingsixwithinacalendaryear
15mayresultinthelossofalloraportionofanycreditearnedbythe[inmate] offender
16pursuanttothissection.

intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 17 (2)Earnedcreditslostforaviolationofinstitutionalrulesorlawsofthisstate
18mayberestoredasprovidedunderthedepartment'spolicy.
19 (3)Earnedcreditsfrompreviousyearsshallnotbelost.
20 4.(1)Thedepartmentshallcausethepolicytobepublishedinthecodeofstate
21regulations.
22 (2)Subjecttotheprovisionsofsubsection6ofthissection,thedepartmentshall
23adoptrulesthatspecifytheprogramsoractivitiesforwhichcreditmaybeearnedunder
24thissection;thecriteriafordeterminingproductiveparticipationin,orcompletionof,
25theprogramsoractivities;thecriteriaforawardingcredit,includingcriteriafor
26awardingadditionalcreditforsuccessfulprogramoractivitycompletion;andthe
27criteriaforwithdrawingpreviouslyearnedcreditasaresultofaviolationof
28institutionalrulesorlawsofthisstate.
29 5.[Noruleorportionofarulepromulgatedundertheauthorityofthischaptershall
30becomeeffectiveunlessithasbeenpromulgatedpursuanttotheprovisionsofsection
31536.024.](1)Nopersoncommittedtothedepartmentwhoissentencedtodeathshallbe
32eligibleforgoodtimecredit.
33 (2)Notwithstandinganyprovisionoflaw:
34 (a)Offendersservinglifewithoutparoleundersection565.020shallbe
35calculatedasfiftyyearsandcreditearnedshallbedeductedfromsuchtermunderthis
36section;
37 (b)OffendersservinglifewithoutparoleonorafterAugust28,1994,andunder
38section565.020shallbecalculatedasthirtyyears.
39 6.(1)Eachoffendershallreceiveadeductionfromhisorhersentencebybeing
40awardedthefollowingspecifiedmonthlycredits:
41 (a)Fortheoffender'sparticipationinanyworkprogram,creditearnedshallbe
42fifteendaysforeverymonth'sworkperformedbysuchoffender;
43 (b)Fortheoffender'ssuccessfulcompletionofhighschool,orfortheoffender
44whohasobtainedhisorherdiplomaorequivalentgeneraleducationdiploma,credit
45earnedshallbeninetydays;
46 (c)Fortheoffender'ssuccessfulcompletionofanalcoholordrugabuse
47treatmentprogram,creditearnedshallbeninetydays;
48 (d)Fortheoffender'ssuccessfulcompletionofeachrestorativejusticeprogram,
49creditearnedshallbeninetydays;
50 (e)Fortheoffender'ssuccessfulcompletionofeachmentalhealthor
51rehabilitationprogramnotspecifiedinthissection,creditearnedshallbeninetydays;
52 (f)Fortheoffender'ssuccessfulcompletionofvocationaltraining,creditearned
53shallbeninetydays;and
HB2397	2 54 (g)Fortheoffender'ssuccessfulcompletionofothereducational
55accomplishmentsorotherprogramsnotspecifiedinthissection,creditearnedshall
56beninetydays.
57 (2)Forpurposesofthissubsection,"creditearned"meansgoodtimecredit
58awardedtoanoffenderandeachcreditshallbecalculatedtobeaperiodofoneday.
59 (3)Anoffenderwhohassuccessfullycompletedanyoftheprogramsunder
60subdivision(1)ofthissubsectionpriortoAugust28,2022,shallbeawardedcreditor
61creditsasoutlinedunderthissubsectionanduponproperverificationofprograms
62completed.
63 7.Theaccumulatedcreditofeveryoffendershallbetalliedmonthlyand
64maintainedbytheinstitutionwherethetermofimprisonmentisbeingserved.Arecord
65ofsuchcreditaccumulatedshallbe:
66 (1)Senttotherecordsofficeofthedepartmentonaquarterlybasis;
67 (2)Forwardedtothedivisionofprobationandparole;and
68 (3)Providedtotheoffender.
69 8.Theprovisionsofthissectionshallapplyonlytooffensesoccurringafter
70January1,1979.
71 9.Thedepartmentofcorrectionsshallpromulgaterulestoimplementthe
72provisionsofthissection.Anyruleorportionofarule,asthattermisdefinedinsection
73536.010,thatiscreatedundertheauthoritydelegatedinthissectionshallbecome
74effectiveonlyifitcomplieswithandissubjecttoalloftheprovisionsofchapter536and,
75ifapplicable,section536.028.Thissectionandchapter536arenonseverable,andifany
76ofthepowersvestedwiththegeneralassemblypursuanttochapter536toreview,to
77delaytheeffectivedate,ortodisapproveandannularulearesubsequentlyheld
78unconstitutional,thenthegrantofrulemakingauthorityandanyruleproposedor
79adoptedafterAugust28,2022,shallbeinvalidandvoid.
