1212 392.248.1.Inordertoensurejust,reasonable,andaffordableratesforreasonably
1313 2comparableessentiallocaltelecommunicationsservicesthroughoutthestate,thereishereby
1414 3establishedthe"UniversalServiceBoard"whichshallconsistofthemembersofthepublic
1515 4servicecommissionandthepubliccounsel,andwhichshallbeincorporatedasanot-for-
1616 5profit,publicbenefitcorporationinthemannerprovidedpursuanttochapter355,exceptas
1717 6otherwiseprovidedinthissection.Consistentwithrulesadoptedbythecommission,the
1818 7universalserviceboardshallcreateauniversalservicefund.Theuniversalserviceboard
1919 8shallsupervisethemanagementoftheuniversalservicefund.Fundsdepositedinthe
2020 9universalservicefundarenotstatefunds.Thecommissionshalladoptrulesgoverningthe
2121 10operationsofthestateuniversalservicefundwithinthreemonthsoftheadoptionoftherules
2222 11adoptedbytheFederalCommunicationCommissionforthefederalUniversalServiceFund.
2323 12Nothingintherulesadoptedbythecommissionshallbeinconsistentwiththesupport
2424 13mechanismsestablishedforthefederalUniversalServiceFund,butthecommissionmay
2525 14adoptanyadditionaldefinitionsandstandardsitbelievesarenecessarytopreserveand
2626 15advanceuniversalserviceinthestateofMissouri.Thecommissionshalladoptrules

4141 29Theindependentauditshallbepaidforfromfundsheldintheuniversalservicefund.
4242 30 2.Thecommissionshalladoptandenforcerulestobeimplementedbytheuniversal
4343 31serviceboard,governingthesystemoffundinganddisbursingfundsfromtheuniversal
4444 32servicefundinamannerthatdoesnotgrantapreferenceorcompetitiveadvantagetoany
4545 33telecommunicationscompanyorsubjectatelecommunicationscompanytoprejudiceor
4646 34disadvantage.Fundsfromtheuniversalservicefundshallonlybeused:

5151 39essentialtelecommunicationsservicesorbroadbandinternetaccessservice.Forthe
5252 40purposesofthissection,"broadbandinternetaccessservice"isdefinedasaretail
5353 41servicethatenablesuserstoconnecttotheinternettoaccesscontent,information,or
5454 42otherservicesatspeedsofatleasttwenty-fivemegabitsperseconddownloadandthree
5555 43megabitspersecondupload; and

5757 45 3.Theuniversalservicefundshallbefundedthroughassessmentsonall

8787 75service,usingitsownfacilities,inwholeorinpart,throughoutanentirehigh-costareaand
8888 76havingcarrieroflastresortobligationsinthathigh-costarea;and
8989 77 (b)Thetelecommunicationscompanychargingaratenotinexcessofthatsetbythe

9191 79 (2)Atelecommunicationscompany'seligibilitytoreceivesupporttoassistlow-
