33 (10)"School",anypublicschool,privateschool,orproviderofanearly 34childhoodeducationprogramthatreceivesstatefunding. 35 3.Beginninginthe2023-24schoolyearandforeachsubsequentschoolyear, 36eachschoolshallprovidedrinkingwaterwithaleadconcentrationlevelbelowthe 37AmericanAcademyofPediatrics'recommendedmaximumlevelforschoolsofonepart 38perbillioninsufficientamountstomeetthedrinkingwaterneedsofallstudentsand 39staffasprovidedinthissection. 40 4.(1)BeforeJanuary1,2024,eachschoolshall: 41 (a)Conductaninventoryofalldrinkingwateroutletsandnonpotablewater 42fixturesineachoftheschool'sbuildings; 43 (b)RemoveanydrinkingwatercoolersthattheUnitedStatesEnvironmental 44ProtectionAgencyhasdeterminedarenotlead-freeunderthefederalLead 45ContaminationControlActof1988,asamended; 46 (c)Installafilterthatreducesleadindrinkingwateroneachdrinkingwater 47outlet,maintainsuchfilterstoensurethatleadconcentrationlevelsarebelowonepart 48perbillion,andreplacesuchfiltersatleastasfrequentlyasprovidedforinthe 49manufacturer'sinstructions.Thisparagraphshallapplyonlytoschoolswithdrinking 50waterdeterminedtohavealeadconcentrationlevelabovetheAmericanAcademyof 51Pediatrics'recommendedmaximumlevelforschoolsofonepartperbillion; 52 (d)Postawarningsignateachnonpotablewaterfixturethatisnottobeused 53forcookingordrinkingwaterpurposesstatingthatthenonpotablewaterfixtureshall 54notbeusedforcookingordrinkingwaterpurposes; HB2532 2 55 (e)Provideanannualschedulefortestingofdrinkingwateroutletsateach 56schoolfordistributiontoemployeesandparentsofchildrenateachschoolupon 57request;and 58 (f)Uponrequest,providegeneralinformationonthehealtheffectsoflead 59contaminationandadditionalinformationalresourcesforemployeesandparentsof 60childrenateachschool. 61 (2)Eachschoolshallmakebuildingshousingearlychildhoodeducation 62programs,kindergartens,andelementaryschoolstheprioritywhencomplyingwith 63paragraphs(a)to(c)ofsubdivision(1)ofthissubsection. 64 (3)Filtersdescribedinparagraph(c)ofsubdivision(1)ofthissubsectionand 65anyreplacementfiltersshallbecertifiedascompliantwithNSF/ANSI53-2017andshall 66incorporateanintegralperformanceindicationdeviceasspecifiedinsection6.1ofNSF/ 67ANSI53-2017. 68 (4)Eachschoolshallprovidesufficientfilteredwatertomeetthedrinkingwater 69needsofallstudentsandstaff. 70 (5)Withinsixtydaysafterfiltersareinstalledasrequiredunderparagraph(c) 71ofsubdivision(1)ofthissubsectionandannuallythereafter,eachschoolshallconduct 72testingforleadbyfirst-drawandfollow-upflushsamplesofarandomsamplingof 73drinkingwateroutletsasrecommendedbythe2018versionoftheUnitedStates 74EnvironmentalProtectionAgency's"Training,Testing,andTakingAction"program. 75Thetestingshallbeconductedandtheresultsanalyzedforbothtypesoftestsbyan 76entityorentitiesapprovedbythedepartment. 77 (6)Withintwoweeksafterreceivingtestresults,eachschoolshallmakeall 78testingresultsandanyinterimorpermanentleadremediationplansavailableonthe 79school'swebsiteandofferparentsanopportunityforapublicmeetingtodiscussthe 80results. 81 (7)Schooldistrictsshallsubmitsuchannualtestingresultstothecommission. 82 (8)Thissubsectionshallnotbeconstruedtopreventaschoolfromconducting 83morefrequenttestingthanrequiredunderthissection. 84 5.(1)Ifafirstdrawsampleshowsaleadconcentrationofonepartperbillionor 85greater,theaffectedschoolshall: 86 (a)Withinonebusinessdayafterreceivingthetestresult,shutoffthedrinking 87wateroutletandlabelitwithawarningstatingthatitcontainsleadandshouldnotbe 88usedforhumanconsumption; 89 (b)Providebottledwaterifthereisnotenoughwatertomeetthedrinkingwater 90needsofthestudents,teachers,andstaff; HB2532 3 91 (c)Withinthirtydaysafterreceivingthetestresult,determineinterim 92remediationstepstoimplementtoaddresstheelevatedleadconcentrationlevel.Such 93stepsshallbepostedtotheschoolwebsite;and 94 (d)Withinninetydaysafterreceivingthetestresult,developawrittenplanfor 95permanentremediation.Suchplanshallbepostedtotheschool'swebsite. 96 (2)Ifapipe,solder,fitting,orfixtureisreplacedaspartofpermanent 97remediationunderparagraph(d)ofsubdivision(1)ofthissubsection,thereplacement 98shallbelead-free,assuchtermisdefinedin40CFR143.12,asamended. 99 (3)Ifatestresultexceedsonepartperbillion,theaffectedschoolshallcontact 100parentsandstaffviawrittennotificationwithinsevenbusinessdaysafterreceivingthe 101testresult.Thenotificationshallincludeatleast: 102 (a)Thetestresultsandasummarythatexplainssuchresults; 103 (b)Adescriptionofanyremedialstepstaken;and 104 (c)Adescriptionofgeneralhealtheffectsofleadcontaminationandcommunity 105specificresources. 106 6.(1)Inadditiontotheapportionmentspayabletoaschooldistrictunder 107chapter163,thedepartmentofnaturalresourcesisherebyauthorizedtoapportionto 108anyschooladditionalfundingforthefiltration,testing,andotherremediationof 109drinkingwatersystemsrequiredunderthissection,subjecttoappropriation. 110 (2)Totheextentpermittedbyfederallaw,aschooldistrictmayseek 111reimbursementorotherfundsforcomplianceincurredunderthissectionunderany 112applicablefederallawincluding,butnotlimitedto,America'sWaterInfrastructureAct 113of2018andtheWaterInfrastructureFinanceandInnovationActof2014,33U.S.C. 114Section3901etseq. 115 (3)Disadvantagedschooldistrictsshallreceivefundingpriorityunderthis 116subsection. 117 7.Thecommission,inconjunctionwiththedepartmentofelementaryand 118secondaryeducation,shallpublishareportbienniallybasedonthefindingsfromthe 119watertestingconductedunderthissection.Suchreportshallbesenttothegovernor 120andthejointcommitteeoneducationandshallbemadeavailableonthewebsiteofthe 121commission. 122 8.(1)Thecommissionshall: 123 (a)WithinonehundredninetydaysafterAugust28,2022,provideguidanceto 124schoolsregardingthemaintenanceoffiltersandfiltrationsystemsandthedevelopment 125andimplementationofflushingplans.Suchguidanceshallincluderecommendations 126forflushingafterstagnanttimesincluding,butnotlimitedto,themorningofeach HB2532 4 127schooldayandafterweekends,schoolholidays,andsummerbreak.Flushingplans 128shallincludedetailsforflushingtheincomingwaterlineandthefilter;and 129 (b)WithintwohundredtendaysafterAugust28,2022,createanonline 130programtoprovidetrainingforcustodialstaffonthemaintenanceoffiltersand 131filtrationsystemsandontheimplementationofflushingplans,emphasizingthatproper 132maintenanceiscriticaltoimproveddrinkingwaterqualityandsafety. 133 (2)WithinthreehundreddaysafterAugust28,2022,eachschoolshalldevelop 134andimplementaplanformaintenanceoffiltersandfiltrationsystemsandforflushing 135basedontheguidanceandtrainingsissuedbythecommission. 136 9.(1)Forpublicschools,thecommissionshallensurecompliancewiththis 137section.Eachschooldistrictshallberesponsibleforensuringcompliancewithineach 138schoolwithintheschooldistrict'sjurisdiction. 139 (2)Thecommissionshallhavetheauthoritytoenteraschoolbuildinggoverned 140bythissectiontodeterminecompliancewiththissection.Thecommissionshalltake 141enforcementactionauthorizedbylawincluding,butnotlimitedto,issuing 142administrativeordersandassessingpenaltiesinaccordancewithsections640.100to 143640.140. 144 10.NoschoolbuildingconstructedafterJanuary4,2014,asprovidedinthe 145federalReductionofLeadinDrinkingWaterAct(42U.S.C.Section300g-6),as 146amended,shallberequiredtoinstall,maintain,orreplacefiltersunderparagraph(c)of 147subdivision(1)ofsubsection4ofthissection. 148 11.Aschoolthatundertakesremediationeffortsmayusethemethodof 149remediationthatisthemostcost-effective. 150 12.Thecommissionmaypromulgateallnecessaryrulesandregulationsforthe 151administrationofthissection.Anyruleorportionofarule,asthattermisdefinedin 152section536.010,thatiscreatedundertheauthoritydelegatedinthissectionshall 153becomeeffectiveonlyifitcomplieswithandissubjecttoalloftheprovisionsofchapter 154536and,ifapplicable,section536.028.Thissectionandchapter536arenonseverable, 155andifanyofthepowersvestedwiththegeneralassemblypursuanttochapter536to 156review,todelaytheeffectivedate,ortodisapproveandannularulearesubsequently 157heldunconstitutional,thenthegrantofrulemakingauthorityandanyruleproposedor 158adoptedafterAugust28,2022,shallbeinvalidandvoid. ✔ HB2532 5
