35forstudentresidentstatusunderthissection.TheattainmentofMissouriresident
36statusforstudentresidentstatusunderthissubsectionshallterminateuponsuch
37eligibledependent'scompletionofsuchdegreeprogram,trainingprogram,orcourseof
38instruction.
39 5.Eachspouse,unemancipatedchild,eligibledependent,orMedalofHonor
40recipient'sdependent,assuchindividualsaredescribedinthissection,shallbeafforded
41thesameeducationalbenefitsasanyotherindividualreceivingin-statetuition.

15servicewithanhonorabledischargeorageneraldischargeshallhavestudentresidentstatus
16forpurposesofadmissionandin-statetuitionatanyapprovedpublicfour-yearinstitutionin
17Missouriorin-state,in-districttuitionatanyapprovedtwo-yearinstitutioninMissouri.
18 [2.Tobeeligibleforstudentresidentstatusunderthissection,anysuchindividual
19shalldemonstratepresenceanddeclareresidencywithinthestateofMissouri.Forpurposes
20ofattendingacommunitycollege,anindividualshalldemonstratepresenceanddeclare
21residencywithinthetaxingdistrictofthecommunitycollegeheorsheattends.]
22 3.Aneligibledependentofanindividualwhowashonorablydischargedor
23separatedfromactivemilitaryserviceorwhoisintheprocessofseparatingfromactive
24militaryserviceasdescribedinthissectionshallhavestudentresidentstatusfor
25purposesofadmissionandin-statetuitionasprovidedinthissection.Beforea
26nonresidenteligibledependentofsuchindividualattainsstudentresidentstatusunder
27thissubsection,suchnonresidenteligibledependentshalluseeighteenmonthsof

173.1153.1.Notwithstandinganyprovisionoflawtothecontrary,anyindividual
2whoiscurrentlyservinginthe[Missouri] NationalGuardofanystateorinareserve

4stateforpurposesofeligibilityforin-statetuitionatanyapprovedpublicinstitutionin
5Missouri.
6 2.[Tobeeligibleforin-statetuitionunderthissection,anysuchindividualshall
7demonstratepresencewithinthestateofMissouri.Forpurposesofattendingacommunity
8college,anindividualshalldemonstratepresencewithinthetaxingdistrictofthecommunity
9collegeheorsheattends.
10 3.]Ifanysuchindividualiseligibletoreceivefinancialassistanceunderanyother
11federalorstatestudentaidprogram,publicorprivate,thefullamountofsuchaidshallbe
12reportedtothecoordinatingboardforhighereducationbytheinstitutionandtheindividual.
13Thetuitionlimitationunderthissectionshallbeprovidedafterallotherfederalandstateaid
14forwhichtheindividualiseligiblehasbeenapplied,andnoindividualshallreceivemore
15thantheactualcostofattendancewhenthelimitationiscombinedwithotheraidmade
16availabletosuchindividual.
17 3.(1)Asusedinthissubsection,theterm"eligibledependent"meansany
18personwhomeetsthedefinitionof"eligibledependent"in38U.S.C.Section3319,as
19amended,or"eligibleperson"asdefinedin38U.S.C.Section3501,asamended.
20 (2)Aneligibledependentofanindividualwhoiscurrentlyservinginthe

4 assignedtoapermanentdutystationorworkplacegeographicallylocatedin
5 thisstate,whoresideinthisstate,shallbedeemedtobedomiciledinthisstate
6 forpurposesofeligibilityforin-statetuitionandshallbeeligibletoreceivein-
7 statetuitionatpublicinstitutionsofhighereducationinthisstate.The
8 determinationofeligibilityforin-statetuitionshallbemadeatthetimethe
9 dependentisacceptedforadmissionbytheinstitution.Allsuchdependents
10 shallbeaffordedthesameeducationalbenefitsasanyotherindividual
11 receivingin-statetuitionsolongasheorsheiscontinuouslyenrolledinan
12 undergraduateorgraduatedegreeprogramofaninstitutionofhighereducation
13 inMissouri,ortransferringbetweenMissouriinstitutionsofhighereducation
14 orfromanundergraduatedegreeprogramtoagraduatedegreeprogram.]
