10 2.Notwithstandinganyprovisionoflawtothecontrary,anyindividualinactive
11militaryserviceorwhowashonorablydischargedorseparatedfromactivemilitary

13UnitedStates] activemilitaryservicewithanhonorabledischargeorageneraldischarge
14[shallhavestudentresidentstatusforpurposesofadmissionand]whoisacceptedfor
15admissionbyanydegreeprogram,trainingprogram,orcourseofinstruction,whether
16suchprogramorcourseisanundergraduateorgraduateprogramorcourseandis

24residencywithinthetaxingdistrictofthecommunitycollegeheorsheattends.]
25 3.Adependentofanindividualdescribedinsubsection2ofthissectionandwho
26isacceptedforadmissionbyanydegreeprogram,trainingprogram,orcourseof
27instruction,whethersuchprogramorcourseisanundergraduateorgraduateprogram
28orcourseandisofferedintheclassroom,online,orbyahybridofboth,atanyapproved
29publicfour-yearorapprovedtwo-yearinstitutionshallnotbechargedarateoftuition
30thatexceedstherateofin-statetuitionatsuchapprovedpublicfour-yearinstitutionin
31Missouriorin-state,in-districttuitionatsuchapprovedtwo-yearinstitutionin
32Missouri.ForadependentwhoisnotdomiciledinMissouri,thein-statetuitionrateor
33thein-state,in-districttuitionrateshallterminateuponsuchdependent'scompletionof
34suchdegreeprogram,trainingprogram,orcourseofinstruction.
35 [3.]4.Thecoordinatingboardforhighereducationshallpromulgaterulesto
36implementthissection.
37 [4.]5.Forpurposesofthissection,"approvedpublicinstitution"shallhavethesame
38meaningasprovidedinsubdivision(3)ofsubsection1ofsection173.1102.
39 [5.]6.Anyruleorportionofarule,asthattermisdefinedinsection536.010,thatis
40createdundertheauthoritydelegatedinthissectionshallbecomeeffectiveonlyifitcomplies
41withandissubjecttoalloftheprovisionsofchapter536and,ifapplicable,section536.028.
42Thissectionandchapter536arenonseverableandifanyofthepowersvestedwiththe
43generalassemblypursuanttochapter536toreview,todelaytheeffectivedate,orto
44disapproveandannularulearesubsequentlyheldunconstitutional,thenthegrantof
45rulemakingauthorityandanyruleproposedoradoptedafterAugust28,2013,shallbeinvalid
46andvoid.
[41.890.Forthepurposesofstudentresidentstatus,military
2 personnel,whenstationedwithinthestateundermilitaryorders,their
3 spouses,andtheirunemancipatedchildrenundertwenty-fouryearsofagewho
4 enrollinaMissouricommunitycollege,Missouricollege,orMissouristate
5 universityshallberegardedasholdingMissouriresidentstatus.]
[173.1153.1.Notwithstandinganyprovisionoflawtothecontrary,
2 anyindividualwhoiscurrentlyservingintheMissouriNationalGuardorina
3 reservecomponentoftheArmedForcesoftheUnitedStatesshallbedeemed
HCSHB2543 2 4 tobedomiciledinthisstateforpurposesofeligibilityforin-statetuitionatany
5 approvedpublicinstitutioninMissouri.
6 2.Tobeeligibleforin-statetuitionunderthissection,anysuch
7 individualshalldemonstratepresencewithinthestateofMissouri.For
8 purposesofattendingacommunitycollege,anindividualshalldemonstrate
9 presencewithinthetaxingdistrictofthecommunitycollegeheorsheattends.
10 3.Ifanysuchindividualiseligibletoreceivefinancialassistance
11 underanyotherfederalorstatestudentaidprogram,publicorprivate,thefull
12 amountofsuchaidshallbereportedtothecoordinatingboardforhigher
13 educationbytheinstitutionandtheindividual.Thetuitionlimitationunder
14 thissectionshallbeprovidedafterallotherfederalandstateaidforwhichthe
15 individualiseligiblehasbeenapplied,andnoindividualshallreceivemore
16 thantheactualcostofattendancewhenthelimitationiscombinedwithother
17 aidmadeavailabletosuchindividual.
18 4.Thecoordinatingboardforhighereducationshallpromulgaterules
19 toimplementthissection.
20 5.Forpurposesofthissection,"approvedpublicinstitution"shallhave
21 thesamemeaningasprovidedinsubdivision(3)ofsubsection1ofsection
22 173.1102.
23 6.Anyruleorportionofarule,asthattermisdefinedinsection
24 536.010,thatiscreatedundertheauthoritydelegatedinthissectionshall
25 becomeeffectiveonlyifitcomplieswithandissubjecttoalloftheprovisions
26 ofchapter536and,ifapplicable,section536.028.Thissectionandchapter
27 536arenonseverableandifanyofthepowersvestedwiththegeneral
28 assemblypursuanttochapter536toreview,todelaytheeffectivedate,orto
29 disapproveandannularulearesubsequentlyheldunconstitutional,thenthe
30 grantofrulemakingauthorityandanyruleproposedoradoptedafterAugust

[173.1155.Notwithstandinganyotherprovisionoflaw,all
2 dependents,asdefinedby37U.S.C.Section401,ofactivedutymilitary
3 personnel,oractivatedortemporarilymobilizedreservistsorguardmembers,
4 assignedtoapermanentdutystationorworkplacegeographicallylocatedin
5 thisstate,whoresideinthisstate,shallbedeemedtobedomiciledinthisstate
6 forpurposesofeligibilityforin-statetuitionandshallbeeligibletoreceivein-
7 statetuitionatpublicinstitutionsofhighereducationinthisstate.The
8 determinationofeligibilityforin-statetuitionshallbemadeatthetimethe
9 dependentisacceptedforadmissionbytheinstitution.Allsuchdependents
10 shallbeaffordedthesameeducationalbenefitsasanyotherindividual
11 receivingin-statetuitionsolongasheorsheiscontinuouslyenrolledinan
12 undergraduateorgraduatedegreeprogramofaninstitutionofhighereducation
13 inMissouri,ortransferringbetweenMissouriinstitutionsofhighereducation
14 orfromanundergraduatedegreeprogramtoagraduatedegreeprogram.]
