SectionA.Chapter256,RSMo,isamendedbyaddingtheretoonenewsection,tobe
2knownassection256.800,toreadasfollows:
256.800.1.Thissectionshallbeknownandmaybecitedasthe"Flood
2ResiliencyAct".
3 2.Asusedinthissection,unlessthecontextotherwiserequires,thefollowing
4termsshallmean:
5 (1)"Director",thedirectorofthedepartmentofnaturalresources;
6 (2)"Floodresiliencymeasures",structuralimprovements,studies,andactivities
7employedtoimprovefloodresiliencyinlocaltoregionalormulti-jurisdictionalareas;
8 (3)"Floodresiliencyproject",aprojectcontainingplanning,design,
9construction,orrenovationoffloodresiliencymeasuresortheconductofstudiesor
10activitiesinsupportoffloodresiliencymeasures;
11 (4)"Partner",apoliticalsubdivision,entity,orpersonworkinginconjunction
12withapromotertofacilitatethecompletionofafloodresiliencyproject;
13 (5)"Plan",apreliminaryreportdescribingtheneedfor,andimplementationof,
14floodresiliencymeasures;
15 (6)"Promoter",anypoliticalsubdivisionofthestate,oranyleveedistrictor
16drainagedistrictorganizedorincorporatedinthestate.
17 3.(1)Thereisherebyestablishedinthestatetreasuryafundtobeknownasthe
18"FloodResiliencyImprovementFund",whichshallconsistofallmoneysdepositedin
EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis
intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 19suchfundfromanysource,whetherpublicorprivate.Thestatetreasurershallbe
20custodianofthefund.Inaccordancewithsections30.170and30.180,thestatetreasurer
21mayapprovedisbursements.Thefundshallbeadedicatedfundandmoneysinthe
22fundshallbeusedsolelyforthepurposesofthissection.Notwithstandingtheprovisions
23ofsection33.080tothecontrary,anymoneysremaininginthefundattheendofthe
24bienniumshallnotreverttothecreditofthegeneralrevenuefund.Thestatetreasurer
25shallinvestmoneysinthefundinthesamemannerasotherfundsareinvested.Any
26interestandmoneysearnedonsuchinvestmentsshallbecreditedtothefund.
27 (2)Uponappropriation,thedepartmentofnaturalresourcesshallusemoneysin
28thefundcreatedbythissubsectionforthepurposesofcarryingouttheprovisionsofthis
29sectionincluding,butnotlimitedto,theprovisionofgrantsorotherfinancialassistance
30and,iflimitationsorconditionsareimposed,onlyuponsuchotherlimitationsor
31conditionsspecifiedintheinstrumentthatappropriates,grants,bequeaths,orotherwise
32authorizesthetransmissionofmoneystothefund.
33 4.InordertoincreasefloodresiliencyalongtheMissouriandMississippiRivers
34andtheirtributariesandimprovestatewidefloodforecastingandmonitoringability,
35thereisherebyestablisheda"FloodResiliencyProgram".Theprogramshallbe
36administeredbythedepartmentofnaturalresources.Thestatemayparticipatewitha
37promoterinthedevelopment,construction,orrenovationofafloodresiliencyprojectif
38thepromoterhasaplanwhichhasbeensubmittedtoandapprovedbythedirector,or
39thestatemaypromoteafloodresiliencyprojectandinitiateaplanonitsownaccord.
40 5.Theplanshallincludeadescriptionofthefloodresiliencyproject,theneedfor
41theproject,thefloodresiliencymeasurestobeimplemented,thepartnerstobeinvolved
42intheproject,andothersuchinformationasthedirectormayrequiretoadequately
43evaluatethemeritoftheproject.
44 6.Thedirectorshallonlyapproveaplanuponadeterminationthatlong-term
45floodmitigationisneededinthatareaofthestateandthatsuchaplanproposesflood
46resiliencymeasuresthatwillprovidelong-termfloodresiliency.
47 7.Promoterswithapprovedfloodresiliencyplansandtheirpartnersshallbe
48eligibletoreceiveanygifts,contributions,grants,orbequestsfromfederal,state,
49private,orothersourcesforcostsassociatedwithfloodresiliencyprojectsthatarepart
50ofsuchplans.
51 8.Promoterswithapprovedfloodresiliencyplansandtheirpartnersmaybe
52grantedmoneysfromthefloodresiliencyimprovementfundundersubsection3ofthis
53sectionforeligiblecostsassociatedwithfloodresiliencyprojectsthatarepartofsuch
54plans.
HB2617	2 55 9.Thedepartmentofnaturalresourcesisherebygrantedauthorityto
56promulgaterulestoimplementthissection.Anyruleorportionofarule,asthattermis
57definedinsection536.010,thatiscreatedundertheauthoritydelegatedinthissection
58shallbecomeeffectiveonlyifitcomplieswithandissubjecttoalloftheprovisionsof
59chapter536and,ifapplicable,section536.028.Thissectionandchapter536are
60nonseverable,andifanyofthepowersvestedwiththegeneralassemblypursuantto
61chapter536toreview,todelaytheeffectivedate,ortodisapproveandannularuleare
62subsequentlyheldunconstitutional,thenthegrantofrulemakingauthorityandanyrule
63proposedoradoptedafterAugust28,2022,shallbeinvalidandvoid.
