2enactedinlieuthereof,tobeknownassections104.380and104.1039,toreadasfollows:
104.380.1.Ifaretiredmemberiselectedtoanystateofficeorisappointedtoany
2stateofficeorisemployedbyadepartmentinapositionnormallyrequiringtheperformance
3bythepersonofdutiesduringnotlessthanonethousandfortyhoursperyear,themember
4shallnotreceiveanannuityforanymonthorpartofamonthforwhichthememberservesas
5anofficeroremployee,[but]except,notwithstandingtheprovisionsofsection105.684to
6thecontrary,thoseretiredmembersservingasamemberofthegeneralassemblyunder
7section104.370oranelectedstateofficialundersection104.371.
8 2.Uponreemploymentundersubsection1ofthissection,themembershallbe
9consideredtobeanewemployeewithnopreviouscreditableserviceandmustaccrue
10creditableservicecontinuouslyforatleastoneyearinordertoreceiveanyadditionalannuity.
11Anyretiredmemberwhoagainbecomesanemployeeandwhoaccruesadditionalcreditable
12serviceandlaterretiresshallreceiveanadditionalamountofmonthlyannuitycalculatedto
13includeonlythecreditableserviceandtheaveragecompensationearnedbythemembersince
14suchemploymentorcreditableserviceearnedasamemberofthegeneralassembly.Yearsof
15membershipserviceandtwelfthsofayeararetobeusedincalculatinganyadditionalannuity
16exceptforcreditableserviceearnedasamemberofthegeneralassembly,andsuchadditional
17annuityshallbebasedonthetypeofserviceaccrued.Ineitherevent,theoriginalannuityand

23section104.010.Aretiredmemberwhobecomesreemployedasanemployeeonorafter
24August28,2001,inapositioncoveredbytheMissouridepartmentoftransportationand
25highwaypatrolemployees'retirementsystemshallnotbeeligibletoreceiveretirement
26benefitsoradditionalcreditableservicefromthestateemployees'retirementsystem.Annual
27benefitincreasespaidundersection104.415shallnotaccruewhilearetiredmemberis
28employedasdescribedinthissectionexcept,notwithstandingtheprovisionsofsection
29105.684tothecontrary,thoseretiredmembersservingasamemberofthegeneral
30assemblyundersection104.370oranelectedstateofficialundersection104.371. Any
31futureannualbenefitincreasespaidafterthememberterminatessuchemploymentwillbe
32paidinthesamemonthasthemember'soriginalannualbenefitincreaseswerepaid.Benefits
33paidundersubsection3ofsection104.374arenotapplicabletoanyadditionalannuitypaid
34underthissection.
104.1039.Ifaretireeisemployedasanemployeebyadepartment,theretireeshall
2notreceiveanannuitypaymentforanycalendarmonthinwhichtheretireeissoemployed
3except,notwithstandingtheprovisionsofsection105.684tothecontrary,thoseretirees
4servingasamemberofthegeneralassemblyorasastatewideelectedofficialunder
5section104.1084. Whilereemployedtheretireeshallbeconsideredtobeanewemployee
6withnopreviouscreditedserviceandmustaccruecreditedservicecontinuouslyforatleast
7oneyearinordertoreceiveanyadditionalannuity.Suchretireeshallreceiveanadditional
8annuityinadditiontotheoriginalannuity,calculatedbasedonlyonthecreditedserviceand
9thepayearnedbysuchretireeduringreemploymentandpaidinaccordancewiththeannuity
10optionoriginallyelected;providedsuchretireewhoceasestoreceiveanannuitypursuantto
11thissectionshallnotreceivesuchadditionalannuityifsuchretireeisemployedbya
12departmentinapositionthatiscoveredbyastate-sponsoreddefinedbenefitretirementplan
13notcreatedpursuanttothischapter.Theoriginalannuityandanyadditionalannuityshallbe
14paidcommencingasoftheendofthefirstmonthafterthemonthduringwhichtheretiree's
15reemploymentterminates.Cost-of-livingadjustmentspaidundersection104.1045shallnot
16accruewhilearetireeisemployedasdescribedinthissectionexcept,notwithstandingthe
17provisionsofsection105.684tothecontrary,thoseretireesservingasamemberofthe
18generalassemblyorasastatewideelectedofficialundersection104.1084. Anyfuture
19cost-of-livingadjustmentspaidaftertheretireeterminatessuchemploymentwillbepaidin
20thesamemonthastheretiree'soriginalannualbenefitincreaseswerepaid.
