EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 18 (2)Thegeneralassemblyherebydeclaresthatitisthepublicpolicyofthisstate 19tofurtherthegovernmentalinterestofensuringthatsufficientopportunitiesfor 20athleticsremainavailableforfemalestoremedypastdiscriminationonthebasisofsex. 21 3.(1)Exceptasprovidedundersubdivision(2)ofthissubsection,noschool 22districtorcharterschoolshallallowanystudenttocompeteinanathleticscompetition 23thatisdesignatedforthebiologicalsexoppositetothestudent'sbiologicalsexas 24correctlystatedonthestudent'sofficialbirthcertificateasdescribedinsubsection4of 25thissectionor,ifthestudent'sofficialbirthcertificateisunobtainable,another 26governmentrecord. 27 (2)Aschooldistrictorcharterschoolmayallowafemalestudenttocompetein 28anathleticscompetitionthatisdesignatedformalestudentsifnocorresponding 29athleticscompetitiondesignatedforfemalestudentsisofferedoravailable. 30 4.Forpurposesofthissection,astatementofastudent'sbiologicalsexonthe 31student'sofficialbirthcertificateoranothergovernmentrecordshallbedeemedtohave 32correctlystatedthestudent'sbiologicalsexonlyifthestatementwas: 33 (1)Enteredatornearthetimeofthestudent'sbirth;or 34 (2)Modifiedtocorrectanyscrivener'serrorinthestudent'sbiologicalsex. 35 5.Noschooldistrictorcharterschoolthatviolatessubdivision(1)ofsubsection3 36ofthissectionshallreceiveanystateaidunderthischapteroranyotherrevenuesfrom 37thestate. 38 6.Thedepartmentofelementaryandsecondaryeducationshallpromulgateall 39necessaryrulesandregulationsfortheimplementationandadministrationofthis 40section.Suchrulesandregulationsshallensurecompliancewithstateandfederallaw 41regardingtheconfidentialityofstudentmedicalinformation.Anyruleorportionofa 42rule,asthattermisdefinedinsection536.010,thatiscreatedundertheauthority 43delegatedinthissectionshallbecomeeffectiveonlyifitcomplieswithandissubjectto 44alloftheprovisionsofchapter536and,ifapplicable,section536.028.Thissectionand 45chapter536arenonseverable,andifanyofthepowersvestedwiththegeneralassembly 46pursuanttochapter536toreview,todelaytheeffectivedate,ortodisapproveandannul 47arulearesubsequentlyheldunconstitutional,thenthegrantofrulemakingauthority 48andanyruleproposedoradoptedafterAugust28,2022,shallbeinvalidandvoid. 173.088.1.Asusedinthissection,thefollowingtermsmean: 2 (1)"Athletics",anyintercollegiateathleticgames,contests,programs,activities, 3exhibitions,orothersimilarcompetitionsorganizedandprovidedforstudents; 4 (2)"Sex",thetwomaincategoriesofmaleandfemaleintowhichindividualsare 5dividedbasedonanindividual'sreproductivebiologyatbirthandtheindividual's 6genome.
