4646 35thereisherebyestablisheda"FloodResiliencyProgram".Theprogramshallbe
4747 36administeredbythedepartmentofnaturalresources.Thestatemayparticipatewitha
4848 37promoterinthedevelopment,construction,orrenovationofafloodresiliencyprojectif
4949 38thepromoterhasaplanwhichhasbeensubmittedtoandapprovedbythedirector,or
5050 39thestatemaypromoteafloodresiliencyprojectandinitiateaplanonitsownaccord.
5151 40 5.Theplanshallincludeadescriptionofthefloodresiliencyproject,theneedfor
5252 41theproject,thefloodresiliencymeasurestobeimplemented,thepartnerstobeinvolved
5353 42intheproject,andothersuchinformationasthedirectormayrequiretoadequately
5454 43evaluatethemeritoftheproject.
5555 44 6.Thedirectorshallonlyapproveaplanuponadeterminationthatlong-term
5656 45floodmitigationisneededinthatareaofthestateandthatsuchaplanproposesflood
5757 46resiliencymeasuresthatwillprovidelong-termfloodresiliency.
5858 47 7.Promoterswithapprovedfloodresiliencyplansandtheirpartnersshallbe
5959 48eligibletoreceiveanygifts,contributions,grants,orbequestsfromfederal,state,
6060 49private,orothersourcesforcostsassociatedwithsuchprojects.
6161 50 8.Promoterswithapprovedfloodresiliencyplansandtheirpartnersmaybe
6262 51grantedmoneysfromthefloodresiliencyimprovementfundforeligiblecostsassociated
6363 52withsuchprojectsundersubsection3ofthissection.
6464 53 9.Thedepartmentofnaturalresourcesisherebygrantedauthorityto
6565 54promulgaterulestoimplementthissection.Anyruleorportionofarule,asthattermis
6666 55definedinsection536.010,thatiscreatedundertheauthoritydelegatedinthissection
