4apart-timeortemporary-substitutebasis[nottoexceedatotaloffivehundredfiftyhoursin
5anyoneschoolyear,andthroughsuchemploymentmayearnuptofiftypercentoftheannual
6compensationpayableundertheemployer'ssalaryscheduleforthepositionorpositionsfilled

15withtheprovisionsofthissubsectionmayearnuptofiftypercentoftheannualcompensation
EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis
intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 16paidtothepersonorpersonswholastheldsuchpositionorpositions.Ifthepositionor
17positionsdidnotpreviouslyexist,thecompensationlimitshallbedeterminedinaccordance
18withrulesdulyadoptedbytheboardoftrusteesoftheretirementsystem;providedthat,it
19shallnotexceedfiftypercentoftheannualcompensationpayableforthepositionbythe
20employerthatismostcomparabletothepositionfilledbytheretiree.Inanycasewherea
21retireefillsmorethanonepositionduringtheschoolyear,thefifty-percentlimitonpermitted
22earningshallbebasedsolelyontheannualcompensationofthehighestpaidposition
23occupiedbytheretireeforatleastone-fifthofthetotalhoursworkedduringtheyear.]If
24twenty-fivepercentoftheperson'sannualizedfinalaveragesalary,includingthe
25inflationarycomponent,islessthantenthousanddollars,thepersonmayearninany
26oneschoolyearuptotenthousanddollarsthroughsuchemploymentwithouta
27discontinuanceoftheperson'sretirementallowance.BeginningJuly1,2024,an
28inflationarycomponent,whichshallbedeterminedandappliedinaccordancewithrules
29dulyadoptedbytheboardoftrusteesoftheretirementsystem,maybeappliedtothe
30tenthousanddollarminimum.Suchapersonshallnotcontributetotheretirementsystem
31ortothepubliceducationemployeeretirementsystemestablishedbysections169.600to
32169.715becauseofearningsduringsuchperiodofemployment.Ifsuchapersonisemployed
33inanycapacitybysuchanemployerinexcessofthelimitationssetforthinthissubsection,
34thepersonshallnotbeeligibletoreceivetheperson'sretirementallowanceforanymonth
35duringwhichthepersonissoemployed.Inaddition,suchpersonshallcontributetothe
36retirementsystemifthepersonsatisfiestheretirementsystem'smembershipeligibility
37requirements.Inadditiontotheconditionssetforthabove,thissubsectionshallapplytoany
38personretiredandcurrentlyreceivingaretirementallowanceundersections169.010to
39169.141,otherthanfordisability,whoisemployedbyathirdpartyorisperformingworkas
40anindependentcontractor,ifsuchpersonisperformingworkforanemployerincludedinthe
41retirementsystemasatemporaryorlong-termsubstituteteacherorinanyotherpositionthat
42wouldnormallyrequire[that]apersontobedulycertificatedunderthelawsgoverningthe
43certificationofteachersinMissouriifsuchpersonwasemployedby[thedistrict] an
44employerincludedintheretirementsystem. Theretirementsystemmayrequirethe
45employer,thethird-partyemployer,theindependentcontractor,andtheretireesubjecttothis
46subsectiontoprovidedocumentationshowingcompliancewiththissubsection.Ifsuch
47documentationisnotprovided,theretirementsystemmaydeemtheretireetohaveexceeded
48thelimitationsprovidedinthissubsection.Notwithstandingtheprovisionsofsubsection
4917ofsection169.020,byacceptingemploymentsubjecttothelimitsofthissubsection,
50theretireeshallbedeemedtohaveconsentedtotheretirementsystemdisclosingthe
51person'sapplicablesalarylimittothehiringemployerincludedintheretirementsystem
52orthethird-partyemployer.

54currentlyreceivingaretirementallowanceinaccordancewithsections169.010to169.141,

60exemptionamountapplicabletoaSocialSecurityrecipientbeforethecalendaryearof
61attainmentoffullretirementageunder20C.F.R.404.430withoutadiscontinuanceofthe
62person'sretirementallowancefromtheretirementsystem.TheSocialSecurityannual
63earningsexemptionamountappliedeachyearshallbetheexemptionamountineffect
64forthecalendaryearinwhichtheschoolyearbegins. Suchpersonshallnotcontributeto
65theretirementsystemortothepubliceducationemployeeretirementsystemestablishedby
66sections169.600to169.715becauseofearningsduringsuchperiodofemployment,andsuch
67personshallnotearnmembershipserviceforsuchemployment.Theemployer'scontribution
68rateshallbepaidbythehiringemployerintothepubliceducationemployeeretirement
69systemestablishedbysections169.600to169.715.Ifsuchapersonisemployedinany
70capacitybyanemployerinexcessofthelimitationssetforthinthissubsection,theperson
71shallnotbeeligibletoreceivetheperson'sretirementallowanceforanymonthduringwhich
72thepersonissoemployed.Inaddition,suchpersonshallbecomeamemberofandcontribute
73toanyretirementsystemdescribedinthissubsectionifthepersonsatisfiestheretirement
74system'smembershipeligibilityrequirements.Theretirementsystemmayrequirethe
75employerandtheretireesubjecttothissubsectiontoprovidedocumentationshowing
76compliancewiththissubsection.Ifsuchdocumentationisnotprovided,theretirement
77systemmaydeemtheretireetohaveexceededthelimitationsprovidedinthis
78subsection.Theprovisionsofthissubsectionshallnotapplytoanypersonretiredand
79currentlyreceivingaretirementallowanceinaccordancewithsections169.010to169.141

169.596.1.Notwithstandinganyotherprovisionofthischaptertothecontrary,a
2retiredcertificatedteacherreceivingaretirementbenefitfromtheretirementsystem
3establishedpursuanttosections169.010to169.141may,withoutlosinghisorherretirement
4benefit,teachfulltimeforupto[two] fouryearsforaschooldistrictcoveredbysuch
5retirementsystem;providedthattheschooldistricthasashortageofcertifiedteachers,as
6determinedbytheschooldistrict,andprovidedthatnosuchretiredcertificatedteachershall
7beemployedasasuperintendent.Thetotalnumberofsuchretiredcertificatedteachersshall
8notexceed,atanyonetime,thelesseroftenpercentofthetotalteacherstaffforthatschool
9district,orfivecertificatedteachers.
10 2.Notwithstandinganyotherprovisionofthischaptertothecontrary,aperson
11receivingaretirementbenefitfromtheretirementsystemestablishedpursuanttosections
12169.600to169.715may,withoutlosinghisorherretirementbenefit,beemployedfulltime
13forupto[two]fouryearsforaschooldistrictcoveredbysuchretirementsystem;provided
14thattheschooldistricthasashortageofnoncertificatedemployees,asdeterminedbythe
15schooldistrict.Thetotalnumberofsuchretirednoncertificatedemployeesshallnotexceed,
16atanyonetime,thelesseroftenpercentofthetotalnoncertificatedstaffforthatschool
17district,orfiveemployees.
18 3.Theemployer'scontributionrateshallbepaidbythehiringschooldistrict.
19 4.Inordertohireteachersandnoncertificatedemployeespursuanttotheprovisions
20ofthissection,theschooldistrictshall:
21 (1)Showagoodfaithefforttofillpositionswithnonretiredcertificatedteachersor
22nonretirednoncertificatedemployees;
23 (2)Postthevacancyforatleastonemonth;
24 (3)Havenotofferedearlyretirementincentivesforeitheroftheprevioustwoyears;
25 (4)Solicitapplicationsthroughthelocalnewspaper,othermedia,orteacher
26educationprograms;
27 (5)Determinethereisaninsufficientnumberofeligibleapplicantsfortheadvertised
28position;and
29 (6)Declareacriticalshortageofcertificatedteachersornoncertificatedemployees
30thatisactiveforoneyear.
31 5.AnypersonhiredpursuanttothissectionshallbeincludedintheStateDirectoryof
32NewHiresforpurposesofincomeandeligibilityverificationpursuantto42U.S.C.Section
331320b-7.

2memberwhoissixtyormoreyearsofageandwhohasatleastfiveyearsofcreditable
3service,orwhohasattainedagefifty-fiveandhasatleasttwenty-fiveyearsofcreditable
4service,orwhohasatleastthirtyyearsofcreditableserviceregardlessofagemayretireand
5receivethefullretirementbenefitsbasedonthemember'screditableservice.Amember
6whosecreditableserviceatretirementislessthanfiveyearsshallnotbeentitledtoa
7retirementallowancebutshallbeentitledtoreceivethemember'scontributions.
8 2.Anypersonretiredandcurrentlyreceivingaretirementallowancepursuantto
9sections169.600to169.715,otherthanfordisability,maybeemployedoneitherapart-time
10ortemporary-substitutebasisby[adistrict] anemployerincludedintheretirementsystem
11[nottoexceedatotaloffivehundredfiftyhoursinanyoneschoolyear], andthroughsuch
12employmentmayearninanyoneschoolyearuptotwenty-fivepercentoftheperson's
13annualizedfinalaveragesalary,includinganinflationarycomponentinanamountthat
14shallbedeterminedandappliedinaccordancewithrulesdulyadoptedbytheboardof
15trusteesoftheretirementsystemandthatshallbeappliedfromthefirstJulyfollowing
16theperson'sfirstfullyearofretirement,withoutadiscontinuanceoftheperson's
17retirementallowance.Iftwenty-fivepercentoftheperson'sannualizedfinalaverage

24theretirementsystem,ortothepublicschoolretirementsystemestablishedbysections
25169.010to169.141,becauseofearningsduringsuchperiodofemployment.Ifsuchaperson
26isemployedinanycapacitybysuch[adistrictonaregular,full-timebasis,ortheperson's
27part-timeortemporary-substituteserviceinanycapacityexceedsfivehundredfiftyhoursin
28anyoneschoolyear]anemployerinexcessofthelimitationssetforthinthissubsection,
29thepersonshallnotbeeligibletoreceivetheperson'sretirementallowanceforanymonth
30duringwhichthepersonissoemployed.Inaddition,suchpersonshallcontributetothe
31retirementsystemifthepersonsatisfiestheretirementsystem'smembershipeligibility
32requirements.Theretirementsystemmayrequiretheemployerandtheretireesubject
33tothissubsectiontoprovidedocumentationshowingcompliancewiththissubsection.If
34suchdocumentationisnotprovided,theretirementsystemmaydeemtheretireetohave
35exceededthelimitationsprovidedinthissubsection.Notwithstandingtheprovisionsof
36subsection17ofsection169.020,byacceptingemploymentsubjecttothelimitsofthis
37subsection,theretireeshallbedeemedtohaveconsentedtotheretirementsystem
