36thatclassificationofmotorvehicleasalicenseissuedpursuanttosection302.177,exceptthat 37nopersonshalloperateamotorvehicleonthehighwaysofthisstateundersuchan 38intermediatedriver'slicensebetweenthehoursof1:00a.m.and5:00a.m.unless 39accompaniedbyapersondescribedinsubsection1ofsection302.130;exceptthelicensee 40mayoperateamotorvehiclewithoutbeingaccompaniedifthetravelistoorfromaschoolor 41educationalprogramoractivity,aregularplaceofemploymentorinemergencysituationsas 42definedbythedirectorbyregulation. 43 3.Eachintermediatedriver'slicenseshallberestrictedbyrequiringthatthedriver 44andallpassengersinthelicensee'svehiclewearsafetybeltsatalltimes.Thissafetybelt 45restrictionshallnotapplytoapersonoperatingamotorcycle.Forthefirstsixmonthsafter 46issuanceoftheintermediatedriver'slicense,theholderofthelicenseshallnotoperateamotor 47vehiclewithmorethanonepassengerwhoisundertheageofnineteenwhoisnotamember 48oftheholder'simmediatefamily.Asusedinthissubsection,anintermediatedriver'slicense 49holder'simmediatefamilyshallincludebrothers,sisters,stepbrothersorstepsistersofthe 50driver,includingadoptedorfosterchildrenresidinginthesamehouseholdoftheintermediate 51driver'slicenseholder.Aftertheexpirationofthefirstsixmonths,theholderofan 52intermediatedriver'slicenseshallnotoperateamotorvehiclewithmorethanthreepassengers 53whoareundernineteenyearsofageandwhoarenotmembersoftheholder'simmediate 54family.Thepassengerrestrictionsofthissubsectionshallnotbeapplicabletoany 55intermediatedriver'slicenseholderwhoisoperatingamotorvehiclebeingusedin 56agriculturalwork-relatedactivities. 57 4.Notwithstandingtheprovisionsofsection302.177tothecontrary,thefeeforan 58intermediatedriver'slicenseshallbefivedollarsandsuchlicenseshallbevalidforaperiodof 59twoyears.Suchfeeshallbewaivedforanypersonqualifyingasanemancipatedminor 60undersubdivision(4)ofsubsection1ofthissection. 61 5.Anyintermediatedriver'slicenseeaccumulatingsixormorepointsinatwelve- 62monthperiodmayberequiredtoparticipateinandsuccessfullycompleteadriver- 63improvementprogramapprovedbythestatehighwaysandtransportationcommission.The HB2789 4 64driver-improvementprogramorderedbythedirectorofrevenueshallnotbeusedinlieuof 65pointassessment. 66 6.(1)Anintermediatedriver'slicenseewhohas,fortheprecedingtwelve-month 67period,hadnoalcohol-relatedenforcementcontacts,asdefinedinsection302.525andno 68trafficconvictionsforwhichpointsareassessed,uponreachingtheageofeighteenyearsor 69withinthethirtydaysimmediatelyprecedingtheireighteenthbirthdaymayapplyforand 70receivewithoutfurtherexamination,otherthanavisiontestasprescribedbysection302.173, 71alicenseissuedpursuanttothischaptergrantingfulldrivingprivileges.Suchpersonshall 72paytherequiredfeeforsuchlicenseasprescribedinsection302.177. 73 (2)Ifanintermediatedriver'slicenseexpiresonaSaturday,Sunday,orlegalholiday, 74suchlicenseshallremainvalidforthefivebusinessdaysimmediatelyfollowingthe 75expirationdate.Innocaseshallalicenseewhoseintermediatedriver'slicenseexpiresona 76Saturday,Sunday,orlegalholidaybeguiltyofanoffenseofdrivingwithanexpiredorinvalid 77driver'slicenseifsuchoffenseoccurredwithinfivebusinessdaysimmediatelyfollowingan 78expirationdatethatoccursonaSaturday,Sunday,orlegalholiday. 79 (3)Thedirectorofrevenueshalldenyanapplicationforafulldriver'slicenseuntil 80thepersonhashadnotrafficconvictionsforwhichpointsareassessedforaperiodoftwelve 81monthspriortothedateofapplicationforlicenseoruntilthepersoniseligibletoapplyfora 82six-yeardriver'slicenseasprovidedforinsection302.177,providedtheapplicantis 83otherwiseeligibleforfulldrivingprivileges.Anintermediatedriver'slicenseshallexpire 84whenthelicenseeiseligibleandreceivesafulldriver'slicenseasprescribedinsubdivision 85(1)ofthissection. 86 7.Nopersonuponreachingtheageofeighteenyearswhoseintermediatedriver's 87licenseanddrivingprivilegeisdenied,suspended,cancelledorrevokedinthisstateorany 88otherstateforanyreasonmayapplyforafulldriver'slicenseuntilsuchlicenseordriving 89privilegeisfullyreinstated.Anysuchpersonwhoseintermediatedriver'slicensehasbeen 90revokedpursuanttotheprovisionsofsections302.010to302.540shall,uponreceiptof 91reinstatementoftherevocationfromthedirector,passthecompletedriverexamination,apply 92foranewlicense,andpaytheproperfeebeforeagainoperatingamotorvehicleuponthe 93highwaysofthisstate. 94 8.Apersonshallbeexemptfromtheintermediatelicensingrequirementsifthe 95personhasreachedtheageofeighteenyearsandmeetsallotherlicensingrequirements. 96 9.Anypersonwhoviolatesanyoftheprovisionsofthissectionrelatingto 97intermediatedrivers'licensesortheprovisionsofsection302.130relatingtotemporary 98instructionpermitsisguiltyofaninfraction,andnopointsshallbeassessedtohisorher 99drivingrecordforanysuchviolation. HB2789 5 100 10.Aperson'sstatusasahomelesschildoryouthorunaccompaniedyouth 101underparagraph(f)ofsubdivision(4)ofsubsection1ofthissectionshallbeverifiedby 102alettersignedbyoneofthefollowingpersons: 103 (1)Adirectorordesigneeofagovernmentalornonprofitagencythatreceives 104publicorprivatefundingtoprovideservicestohomelesspersons; 105 (2)Alocaleducationagencyliaisonforhomelesschildrenandyouthdesignated 106under42U.S.C.Section11432(g)(1)(J)(ii); 107 (3)Alicensedattorneyrepresentingtheminorinanylegalmatter;or 108 (4)Aschoolsocialworkerorcounselor. 109 11.Anyruleorportionofarule,asthattermisdefinedinsection536.010,thatis 110createdundertheauthoritydelegatedinthissectionshallbecomeeffectiveonlyifitcomplies 111withandissubjecttoalloftheprovisionsofchapter536and,ifapplicable,section536.028. 112Thissectionandchapter536arenonseverableandifanyofthepowersvestedwiththe 113generalassemblypursuanttochapter536toreview,todelaytheeffectivedateorto 114disapproveandannularulearesubsequentlyheldunconstitutional,thenthegrantof 115rulemakingauthorityandanyruleproposedoradoptedafterAugust28,2000,shallbeinvalid 116andvoid. 302.181.1.Thelicenseissuedpursuanttotheprovisionsofsections302.010to 2302.340shallbeinsuchformasthedirectorshallprescribe,butthelicenseshallbeacard 3madeofplasticorothercomparablematerial.Alllicensesshallbemanufacturedofmaterials 4andprocessesthatwillprohibit,asnearlyaspossible,theabilitytoreproduce,alter, 5counterfeit,forge,orduplicateanylicensewithoutreadydetection.Thelicenseshallalso 6beartheexpirationdateofthelicense,theclassificationofthelicense,thename,dateofbirth, 7residenceaddressincludingthecountyofresidenceoracodenumbercorrespondingtosuch 8countyestablishedbythedepartment,andbriefdescriptionandcoloreddigitizedimageofthe 9licensee,andafacsimileofthesignatureofthelicensee.Thedirectorshallprovideby 10administrativeruletheprocedureandformatforalicenseetoindicateonthebackofthe 11licensetogetherwiththedesignationforananatomicalgiftasprovidedinsection194.240the 12nameandaddressofthepersondesignatedpursuanttosections404.800to404.865asthe 13licensee'sattorneyinfactforthepurposesofadurablepowerofattorneyforhealthcare 14decisions.Nolicenseshallbevaliduntilithasbeensosignedbythelicensee.Ifanyportion 15ofthelicenseispreparedbyaprivatefirm,anycontractwithsuchfirmshallbemadein 16accordancewiththecompetitivepurchasingproceduresasestablishedbythestatedirectorof 17thedivisionofpurchasing. 18 2.Alldigitalimagesproducedforlicensesshallbecomethepropertyofthe 19departmentofrevenue. HB2789 6 20 3.Thelicenseissuedshallbecarriedatalltimesbytheholderthereofwhiledrivinga 21motorvehicle,andshallbedisplayedupondemandofanyofficerofthehighwaypatrol,or 22anypoliceofficerorpeaceofficer,oranyotherdulyauthorizedperson,forinspectionwhen 23demandismadetherefor.Failureofanyoperatorofamotorvehicletoexhibithisorher 24licensetoanydulyauthorizedofficershallbepresumptiveevidencethatsuchpersonisnota 25dulylicensedoperator. 26 4.Thedirectorofrevenueshallnotissuealicensewithoutafacialdigitalimageof 27thelicenseapplicant,exceptasprovidedpursuanttosubsection7ofthissection.Adigital 28imageoftheapplicant'sfullfacialfeaturesshallbetakeninamannerprescribedbythe 29director.Nodigitalimageshallbetakenwearinganythingwhichcloaksthefacialfeaturesof 30theindividual. 31 5.Thedepartmentofrevenuemayissueatemporarylicenseorafulllicensewithout 32thephotographorwiththelastphotographordigitalimageinthedepartment'srecordsto 33membersoftheArmedForces,exceptthatwheresuchtemporarylicenseisissueditshallbe 34validonlyuntiltheapplicantshallhavehadtimetoappearandhavehisorherpicturetaken 35andalicensewithhisorherphotographissued. 36 6.Thedepartmentofrevenueshallissueuponrequestanondriver'slicensecard 37containingessentiallythesameinformationandphotographordigitalimage,exceptas 38providedpursuanttosubsection7ofthissection,asthedriver'slicenseuponpaymentofsix 39dollars.Allnondriver'slicensesshallexpireontheapplicant'sbirthdayinthesixthyearafter 40issuance.Apersonwhohaspassedhisorherseventiethbirthdayshalluponapplicationbe 41issuedanonexpiringnondriver'slicensecard.Notwithstandinganyotherprovisionofthis 42chapter,anondriver'slicensecontainingaconcealedcarryendorsementshallexpirethree 43yearsfromthedatethecertificateofqualificationwasissuedpursuanttosection571.101,as 44section571.101existedpriortoAugust28,2013.Thefeefornondriver'slicensesissuedfora 45periodexceedingthreeyearsissixdollarsorthreedollarsfornondriver'slicensesissuedfora 46periodofthreeyearsorless.Thenondriver'slicensecardshallbeusedforidentification 47purposesonlyandshallnotbevalidasalicense.Nofeeshallberequiredorcollectedfrom 48ahomelesschildorhomelessyouth,asdefinedinsubsection1ofsection167.020,or 49unaccompaniedyouth,asdefinedin42U.S.C.Section11434a(6),forafirstnondriver's 50licensecardissuedunderthissubsection.Suchperson'sstatusasahomelesschildor 51youthorunaccompaniedyouthshallbeverifiedbyalettersignedbyoneofthe 52followingpersons: 53 (1)Adirectorordesigneeofagovernmentalornonprofitagencythatreceives 54publicorprivatefundingtoprovideservicestohomelesspersons; 55 (2)Alocaleducationagencyliaisonforhomelesschildrenandyouthdesignated 56under42U.S.C.Section11432(g)(1)(J)(ii); HB2789 7 57 (3)Alicensedattorneyrepresentingtheminorinanylegalmatter;or 58 (4)Aschoolsocialworkerorcounselor. 59 7.Ifotherwiseeligible,anapplicantmayreceiveadriver'slicenseornondriver's 60licensewithoutaphotographordigitalimageoftheapplicant'sfullfacialfeaturesexceptthat 61suchapplicant'sphotographordigitalimageshallbetakenandmaintainedbythedirectorand 62notprintedonsuchlicense.Inordertoqualifyforalicensewithoutaphotographordigital 63imagepursuanttothissectiontheapplicantmust: 64 (1)Presentaformprovidedbythedepartmentofrevenuerequestingtheapplicant's 65photographbeomittedfromthelicenseornondriver'slicenseduetoreligiousaffiliations. 66Theformshallbesignedbytheapplicantandanothermemberofthereligioustenant 67verifyingthephotographordigitalimageexemptiononthelicenseornondriver'slicenseis 68requiredaspartoftheirreligiousaffiliation.Therequiredsignaturesontheprescribedform 69shallbeproperlynotarized; 70 (2)ProvidesatisfactoryprooftothedirectorthattheapplicanthasbeenaUnited 71Statescitizenforatleastfiveyearsandaresidentofthisstateforatleastoneyear,exceptthat 72anapplicantmovingtothisstatepossessingavaliddriver'slicensefromanotherstatewithout 73aphotographshallbeexemptfromtheone-yearstateresidencyrequirement.Thedirector 74mayestablishrulesnecessarytodeterminesatisfactoryproofofcitizenshipandresidency 75pursuanttothissection; 76 (3)Applicationsforadriver'slicenseornondriver'slicensewithoutaphotographor 77digitalimagemustbemadeinpersonatalicenseofficedeterminedbythedirector.The 78directorisauthorizedtolimitthenumberofofficesthatmayissueadriver'sornondriver's 79licensewithoutaphotographordigitalimagepursuanttothissection. 80 8.Thedepartmentofrevenueshallmakeavailable,atoneormorelocationswithin 81thestate,anopportunityforindividualstohavetheirfullfacialphotographtakenbyan 82employeeofthedepartmentofrevenue,ortheirdesignee,whoisofthesamesexasthe 83individualbeingphotographed,inasegregatedlocation. 84 9.BeginningJuly1,2005,thedirectorshallnotissueadriver'slicenseora 85nondriver'slicenseforaperiodthatexceedsanapplicant'slawfulpresenceintheUnited 86States.Thedirectormay,byruleorregulation,establishprocedurestoverifythelawful 87presenceoftheapplicantandestablishthedurationofanydriver'slicenseornondriver's 88licenseissuedunderthissection. 89 10.(1)Notwithstandinganybiometricdatarestrictionscontainedinsection302.170, 90thedepartmentofrevenueisherebyauthorizedtodesignandimplementasecuredigital 91driver'slicenseprogramthatallowsapplicantsapplyingforadriver'slicenseinaccordance 92withthischaptertoobtainasecuredigitaldriver'slicenseinadditiontothephysicalcard- 93basedlicensespecifiedinthissection. HB2789 8 94 (2)Adigitaldriver'slicenseasdescribedinthissubsectionshallbeacceptedforall 95purposesforwhichalicense,asdefinedinsection302.010,isused. 96 (3)Thedepartmentmaycontractwithoneormoreentitiestodevelopthesecure 97digitaldriver'slicensesystem.Thedepartmentorentitymaydevelopamobilesoftware 98applicationcapableofbeingutilizedthroughaperson'selectronicdevicetoaccessthe 99person'ssecuredigitaldriver'slicense. 100 (4)Thedepartmentshallsuspend,disable,orterminateaperson'sparticipationinthe 101securedigitaldriver'slicenseprogramif: 102 (a)Theperson'sdrivingprivilegeissuspended,revoked,denied,withdrawn,or 103cancelledasprovidedinthischapter;or 104 (b)Thepersonreportsthattheperson'selectronicdevicehasbeenlost,stolen,or 105compromised. 106 11.Thedirectorofthedepartmentofrevenuemaypromulgaterulesasnecessaryfor 107theimplementationofthissection.Anyruleorportionofarule,asthattermisdefinedin 108section536.010thatiscreatedundertheauthoritydelegatedinthissectionshallbecome 109effectiveonlyifitcomplieswithandissubjecttoalloftheprovisionsofchapter536and,if 110applicable,section536.028.Thissectionandchapter536arenonseverableandifanyofthe 111powersvestedwiththegeneralassemblypursuanttochapter536toreview,todelaythe 112effectivedate,ortodisapproveandannularulearesubsequentlyheldunconstitutional,then 113thegrantofrulemakingauthorityandanyruleproposedoradoptedafterAugust28,2020, 114shallbeinvalidandvoid. ✔ HB2789 9
