4distributor,wholesaler,jobberorseasonalretailerfromthestatefiremarshalandapplicable 5federalpermitorlicense.Possessionofsaidpermitisaconditionprecedentto 6manufacturing,sellingorofferingforsale,shippingorcausingtobeshippedany 7fireworksintothestateofMissouri,exceptashereinprovided.Thisprovisionappliesto 8nonresidentsaswellasresidentsofthestateofMissouri. 9 2.Thestatefiremarshalhastheauthorityandisauthorizedanddirectedtoissue 10permitsforthesaleoffireworks.Nopermitshallbeissuedtoapersonundertheageof 11eighteenyears.Allpermitsexceptforseasonalretailersshallbeforthecalendaryearorany 12fractionthereofandshallexpireonthethirty-firstdayofDecemberofeachyear. 13 3.Permitsissuedmustbedisplayedinthepermitholder'splaceofbusiness.No 14permitprovidedforhereinshallbetransferablenorshallapersonoperateunderapermit 65withholdpermitsfromapplicantsuponevidencethatallstatesalestaxesforthepreceding 66yearoryearshavenotbeenpaid;except,thissubsectionshallnotapplyifanapplicantis 67pursuinganyproperremedyatlawchallengingtheamount,collection,orassessmentofany 68salestax. 69 13.Aholderofadistributor,wholesaler,orjobber'spermitshallberequiredto 70operateoutofapermanentstructureincompliancewithallapplicablebuildingandfire 71regulationsinthecityorcountyinwhichsaidpersonisoperatingafireworksbusiness. 72Seasonalretailpermitlocationsshallbeincompliancewithallapplicablebuildingandfire 73regulations.Theapplicantmaybesubjecttoafiresafetyinspectionbythestatefiremarshal 74baseduponpromulgatedrulesandregulationsadoptedbythestatefiremarshal. 75 14.[Itisunlawfulforanymanufacturer,distributor,wholesaler,orjobbertosell 76consumerfireworkstoaseasonalretailerwhohasnotacquiredanappropriatepermitfromthe 77statefiremarshalforthecurrentpermitperiod.Aseasonalretailershallacquireandpresent 78theappropriatepermitfromthestatefiremarshalbeforeanymanufacturer,distributor, 79wholesalerorjobberisallowedtosellconsumerfireworkstosuchseasonalretailer,provided 80thatsuchseasonalretailerispurchasingtheconsumerfireworksforresaleinthisstate. 81 15.]Thestatefiremarshalandthemarshal'sdeputiesmayconductinspectionsofany 82premisesandallportionsofbuildingswherefireworksarestored,manufactured,keptor 83beingofferedforsale.Allpersonsselling,offeringforsale,barter,gift,exchange,oroffer 84thereofanyfireworksshallcooperatefullywiththestatefiremarshalandthemarshal's 85deputiesduringanysuchinspection.Thisinspectionshallbeperformedduringnormal 86businesshours. 87 [16.]15.Inadditiontoanyotherpenalty,anypersonwhomanufactures,sells,offers 88forsale,shipsorcausestobeshippedintoorcausedtobeshippedintothestateofMissouri, HB2847 5 89foruseinMissouri,anyitemsoffireworkswithoutfirsthavingtherequiredapplicablepermit 90shallbeassessedacivilpenaltyofuptoaonethousanddollarfineforeachdayofoperation 91uptoamaximumoftenthousanddollars. 320.121.1.Theprovisionsofsections320.106to320.161shallnotbeconstruedto 2abrogateorinanywayaffectthepowersofthefollowingpoliticalsubdivisionstoregulate[or 3prohibit] fireworkswithinitscorporatelimits: 4 (1)Anycity,town,orvillageinthisstate;or 5 (2)Anycountyoperatingunderacharterformofgovernment. 6 2.[Itisunlawfulforanymanufacturer,distributor,wholesaler,jobberorseasonal 7retailertosellorshipbycommoncarrierfireworkstoconsumerswithinthecorporatelimits 8ofthefollowingpoliticalsubdivisionswhichprohibitthesaleorpossessionoffireworks: 9 (1)Anycity,town,orvillageinthisstate;or 10 (2)Anycountyoperatingunderacharterformofgovernment] Thepolitical 11subdivisionsdesignatedundersubsection1ofthissectionareauthorizedtoissue 12permitsforthesaleoffireworks.Anypermitfeeschargedshallnotexceedthefees 13authorizedundersubsection6ofsection320.111. 320.126.1.Anyperson,entity,partnership,corporation,orassociationtransporting 2displayorproximatefireworksordisplayandproximatefireworksintothestateofMissouri 3forthepurposeofresaleortoconductadisplayshallbepermittedbythestatefiremarshalas 4adistributorormanufacturerandhaveobtainedapplicablefederallicenseorpermit. 5 2.Saleofdisplayorproximatefireworksshallbelimitedtoaholderofafederal 6licenseorpermitandadistributorormanufacturerpermitissuedbythestatefiremarshal. 7 3.Possessionofdisplayorproximatefireworksforresaletoholdersofa[permit] 8licensefordisplayorproximatefireworksshallbeconfinedtoholdersofastatemanufacturer 9ordistributorpermitandapplicablefederallicenseorpermit. 10 4.Permitsfordisplayorproximatefireworksmaybegrantedtomunicipalities,fair 11associations,amusementparks,organizations,persons,firmsorcorporations.Suchpermits 12maybegranteduponapplicationandapprovalbythestatefiremarshalorlocalfireservice 13authoritiesofthecommunitywherethedisplayisproposedtobeheld.Allapplications 14submittedfordisplayorproximatefireworkspermitsmustbesubmittedtotheofficeofthe 15statefiremarshalaminimumoftenworkingdayspriortothedateoftheevent.The 16applicationshallbemadeonaformprovidedorapprovedbythestatefiremarshal.Every 17suchdisplayshallbesupervised,managed,ordirectedbyaMissourilicensedoperator,or 18pyrotechnicoperatoronsitepursuanttosubdivisions(11)and(18)ofsection320.106and 19shallbelocated,discharged,orfiredsoasintheopinionofthepermittingauthority,after 20properinspectionbasedonthemostcurrenteditionoftheNationalFireProtection 21Associationstandards,NFPA1123,1124,and1126,tonotbehazardoustoanypersonor HB2847 6 22property.Afterapermithasbeengranted,thesale,possession,useanddistributionof 23fireworksforsuchdisplayshallbelawfulforthatpurposeonly.Acopyofallpermitsissued 24fordisplayorproximatefireworksshallbeforwardedbythepermitholdertothestatefire 25marshal'soffice.Nopermitgrantedhereundershallbetransferableandeachpermitshall 26applytoonlyonelocation.Noholderofamanufacturerordistributorpermitshallsell,barter, 27ortransferdisplayorproximatefireworkstoanyonenotpossessinganapplicablepermitor 28license. 29 5.Possessionofdisplayorproximatefireworksshallbelimitedtoaholderofa 30displayorproximatefireworkspermitissuedbytheauthorityhavingjurisdictionwherethe 31displayorproximatefireworksisproposedtobeheldorthestatefiremarshalorholderofa 32statemanufacturerordistributorpermitandapplicablefederallicenseorpermit. 33 6.Beforeissuinganypermitforadisplayorproximatefireworks,themunicipality, 34fairassociation,amusementpark,organization,firm,persons,orcorporationmaking 35applicationthereforshallfurnishproofoffinancialresponsibilityinanamountestablishedby 36promulgatedruletothepermittingauthorityinordertosatisfyclaimsfordamagestoproperty 37orpersonalinjuriesarisingoutofanyactoromissiononthepartofsuchperson,firmor 38corporationoranyagentoremployeethereof. 39 7.Anyestablishmentwhereproximatefireworksaretobedischargedshallbe 40inspectedbythestatefiremarshalorlocalfiredepartmenthavingjurisdictionforcompliance 41withNFPA101LifeSafetyCodeorequivalentnationallyrecognizedcodeinrelationto 42meansofegress,occupancyload,andautomaticsprinklerandfirealarmsystems.Allpermits 43issuedwillbeforwardedtothestatefiremarshalbythepermitholder.Permitswillbeissued 44inthesamemannerasthoserequiredinthissection. 320.131.1.Itisunlawfulforanypersontopossess,sell,orusewithinthestateof 2Missouri,[or]shipintothestateofMissouri,orexportfromthestateofMissouri,exceptas 3providedinsection320.126,anypyrotechnicscommonlyknownas"fireworks"anddefined 4asconsumerfireworksinsubdivision(3)ofsection320.106otherthanitemsnoworhereafter 5classifiedasfireworksUNO336,1.4GbytheUnitedStatesDepartmentofTransportationthat 6complywiththeconstruction,chemicalcomposition,labeling, andotherregulationsrelative 7toconsumerfireworksregulationspromulgatedbytheUnitedStatesConsumerProduct 8SafetyCommissionandpermittedforusebythegeneralpublicpursuanttosuch 9commission'sregulations. 10 HB2847 7 14 3.Nojobber,wholesaler,manufacturer,ordistributorshallselltoseasonalretailer 15dealers,oranyotherperson,inthisstateforthepurposeofresale,oruse,inthisstate,any 16consumerfireworkswhichdonothavethenumbersandletter"1.4G"printedwithinan 17orange,diamond-shapedlabelprintedonorattachedtothefireworksshippingcarton. 18 4.Thissectiondoesnotprohibitamanufacturer,distributor, oranyotherperson 19possessingtheproperpermitsasspecifiedbystateandfederallawfromstoring,selling, 20shipping, orotherwisetransportingdisplayorproximatefireworks. 21 5.Matches,toypistols,toycanes,toyguns,partypoppers,orotherdevicesinwhich 22papercapscontainingtwenty-fivehundredthsgrainsorlessofexplosivecompound,provided 23thattheyaresoconstructedthatthehandcannotcomeintocontactwiththecapwheninplace 24foruse,andtoypistolpapercapswhichcontainlessthantwenty-fivehundredthsgrainsof 25explosivemixtureshallbepermittedforsaleanduseatalltimesandshallnotberegulatedby 26theprovisionsofsections320.106to320.161. 27 6.SkylanternsorChineselanternsshallbepermittedforsaleandusewithinthe 28stateofMissouriatalltimesandshallnotberegulatedbytheprovisionsofsections 29320.106to320.161. 320.141.Permissibleitemsofconsumerfireworksdefinedinsection320.131maybe 2soldatwholesaleorretailbyholdersofajobber'spermittononlicensedbuyersfrominside 3andoutsidethestateofMissouriduringacalendaryearfromthefirstdayofJanuaryuntilthe 4thirty-firstdayofDecember.Permissibleitemsofconsumerfireworksdefinedinsection 5320.131maybesoldatretailbyholdersofaseasonalretailpermitduringthesellingperiods 6ofthe[twentieth] firstdayofJunethroughthetenthdayofJulyandthe[twentieth] tenthday 7ofDecemberthroughthe[second] thirddayofJanuary. 320.151.1.Itisunlawfultoattempttosellortosellatretailanyfireworksto 2childrenundertheageoffourteenyearsexceptwhensuchchildisinthepresenceofaparent 3orguardian. 4 2.Itisunlawfulforanypersonundertheageofsixteentosellfireworksorworkina 5facilitywherefireworksarestored,sold,orofferedforsaleunlesssupervisedbyanadult. 6 3.Itisunlawfultoexplodeorigniteconsumerfireworkswithinsixhundredfeetof 7anychurch,hospital,mentalhealthfacility,school,orwithinonehundredfeetofanylocation 8wherefireworksarestored,sold,orofferedforsale. 9 4.Nopersonshalligniteordischargeanypermissiblearticlesofconsumerfireworks 10withinorthrowthesamefromamotorizedvehicleincludingwatercraftoranyothermeansof 11transportation,exceptwheredisplaypermithasbeenissuedforafloatingvesselorfloating 12platform,norshallanypersonplaceorthrowanyignitedarticleoffireworksintoorata 13motorizedvehicleincludingwatercraftoranyothermeansoftransportation,oratornearany 14personorgroupofpeople. HB2847 8 15 5.Nopersonshalligniteordischargeconsumerfireworkswithinthreehundredfeet 16ofanypermanentstorageofignitableliquid,gases,gasolinepump,gasolinefillingstation,or 17anynonpermanentstructurewherefireworksarestored,soldorofferedforsale. 18 6.Noitemsofexplosiveorpyrotechniccompositionotherthanfireworksasdefined 19bysubdivisions(3),(5),and(17)ofsection320.106shallbedisplayed,sold,orofferedfor 20salewithintheapplicablepermitlocationasidentifiedonsuchpermitgrantedbythestatefire 21marshal. 22 7.Proximatefireworks[shallnotbeallowedtobestoredwithconsumerfireworks] 23maybestoredadjacentto,butshallnotbeintermingledwith,fireworksapprovedfor 24consumeruse. 25 8.AllInternetretailsalesofconsumerfireworksshallbefromlocations 26authorized,licensed,andpermittedbyastatefiremarshal. 27 9.FireworksthatdonotmeetthelesseroftheAmericanPyrotechnics 28Association(APA)Standard87-1orNFPAorCPSCdevicestandardsforpyrotechnic 29andexplosivecompositionshallbedisposedofbyproperdetonationasauthorizedby 30thestatefiremarshal,thestatefiremarshal'sdeputiesordesignees,oranyauthority 31havingjurisdiction. 32 10.Allstorageandtransportationoffireworksshallbeinaccordancewithallfederal 33andstaterulesandregulations. 34 [9.]11.Nothinginsections320.106to320.161shallbeconstruedtoprevent 35permitteesfromdemonstratingortestingfireworks.Anysuchdemonstrationortestshall 36requirethenotificationandapprovalofthelocalfireserviceorthestatefiremarshal.
