BeitresolvedbytheHouseofRepresentatives,theSenateconcurringtherein: ThatatthenextgeneralelectiontobeheldinthestateofMissouri,onTuesdaynext 2followingthefirstMondayinNovember,2022,orataspecialelectiontobecalledbythe 3governorforthatpurpose,thereisherebysubmittedtothequalifiedvotersofthisstate,for 4adoptionorrejection,thefollowingamendmenttoArticleXIVoftheConstitutionofthestate 5ofMissouri: SectionA.Section1,ArticleXIV,ConstitutionofMissouri,isrepealedandonenew 2sectionadoptedinlieuthereof,tobeknownasSection1,toreadasfollows: Section1.1.Purposes. 2 Thissectionisintendedtopermitstate-licensedphysicianstorecommendmarijuana 3formedicalpurposestopatientswithseriousillnessesandmedicalconditions.Thesection 4allowspatientswithqualifyingmedicalconditionstherighttodiscussfreelywiththeir 5physiciansthepossiblebenefitsofmedicalmarijuanause,therightoftheirphysiciansto 6provideprofessionaladviceconcerningthesame,andtherighttousemedicalmarijuanafor 7treatmentunderthesupervisionofaphysician. 8 ThissectionisintendedtomakeonlythosechangestoMissourilawsthatare 9necessarytoprotectpatients,theirprimarycaregivers,andtheirphysiciansfromciviland 10criminalpenalties,andtoallowforthelimitedlegalproduction,distribution,saleand 11purchaseofmarijuanaformedicaluse.Thissectionisnotintendedtochangecurrentcivil EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 12andcriminallawsgoverningtheuseofmarijuanafornonmedicalpurposes.Thesectiondoes 13notallowforthepublicuseofmarijuanaanddrivingundertheinfluenceofmarijuana. 14 2.Definitions. 15 (1)"Administer"meansthedirectapplicationofmarijuanatoaqualifyingpatientby 16wayofanyofthefollowingmethods: 17 (a)Ingestionofcapsules,teas,oils,andothermarijuana-infusedproducts; 18 (b)Vaporizationorsmokingofdriedflowers,buds,plantmaterial,extracts,oroils; 19 (c)Applicationofointmentsorbalms; 20 (d)Transdermalpatchesandsuppositories; 21 (e)Consumingmarijuana-infusedfoodproducts;or 22 (f)Anyothermethodrecommendedbyaqualifyingpatient'sphysician. 23 (2)"Department"meansthedepartmentofhealthandseniorservices,oritssuccessor 24agency. 25 (3)"Entity"meansanaturalperson,corporation,professionalcorporation,nonprofit 26corporation,cooperativecorporation,unincorporatedassociation,businesstrust,limited 27liabilitycompany,generalorlimitedpartnership,limitedliabilitypartnership,jointventure,or 28anyotherlegalentity. 29 (4)"Floweringplant"meansamarijuanaplantfromthetimeitexhibitsthefirstsigns 30ofsexualmaturitythroughharvest. 31 (5)"Marijuana"or"marihuana"meansCannabisindica,Cannabissativa,and 32Cannabisruderalis,hybridsofsuchspecies,andanyotherstrainscommonlyunderstood 33withinthescientificcommunitytoconstitutemarijuana,aswellasresinextractedfromthe 34plantandmarijuana-infusedproducts."Marijuana"or"marihuana"donotincludeindustrial 35hempcontainingacropwideaveragetetrahydrocannabinolconcentrationthatdoesnotexceed 36three-tenthsofonepercentonadryweightbasis,orcommoditiesorproductsmanufactured 37fromindustrialhemp. 38 (6)"Marijuana-infusedproducts"meansproductsthatareinfusedwithmarijuanaor 39anextractthereofandareintendedforuseorconsumptionotherthanbysmoking,including, 40butnotlimitedto,edibleproducts,ointments,tincturesandconcentrates. 41 (7)"Medicalmarijuanacultivationfacility"meansafacilitylicensedbythe 42departmenttoacquire,cultivate,process,store,transport,andsellmarijuanatoamedical 43marijuanadispensaryfacility,medicalmarijuanatestingfacility,ortoamedicalmarijuana- 44infusedproductsmanufacturingfacility. 45 (8)"Medicalmarijuanadispensaryfacility"meansafacilitylicensedbythe 46departmenttoacquire,store,sell,transport,anddelivermarijuana,marijuana-infused 47products,anddrugparaphernaliausedtoadministermarijuanaasprovidedforinthissection 48toaqualifyingpatient,aprimarycaregiver,anothermedicalmarijuanadispensaryfacility,a HCSHJR142 2 49medicalmarijuanatestingfacility,oramedicalmarijuana-infusedproductsmanufacturing 50facility. 51 (9)"Medicalmarijuana-infusedproductsmanufacturingfacility"meansafacility 52licensedbythedepartmenttoacquire,store,manufacture,transport,andsellmarijuana- 53infusedproductstoamedicalmarijuanadispensaryfacility,amedicalmarijuanatesting 54facility,ortoanothermedicalmarijuana-infusedproductsmanufacturingfacility. 55 (10)"Medicalmarijuanatestingfacility"meansafacilitycertifiedbythedepartment 56toacquire,test,certify,andtransportmarijuana. 57 (11)"Medicaluse"meanstheproduction,possession,delivery,distribution, 58transportation,oradministrationofmarijuanaoramarijuana-infusedproduct,ordrug 59paraphernaliausedtoadministermarijuanaoramarijuana-infusedproduct,forthebenefitof 60aqualifyingpatienttomitigatethesymptomsoreffectsofthepatient'squalifyingmedical 61condition. 62 (12)"Physician"meansanindividualwhoislicensedandingoodstandingtopractice 63medicineorosteopathyunderMissourilaw. 64 (13)"Physiciancertification"meansadocument,whetherhandwritten,electronicor 65inanothercommonlyusedformat,signedbyaphysicianandstatingthat,inthephysician's 66professionalopinion,thepatientsuffersfromaqualifyingmedicalcondition. 67 (14)"Primarycaregiver"meansanindividualtwenty-oneyearsofageorolderwho 68hassignificantresponsibilityformanagingthewell-beingofaqualifyingpatientandwhois 69designatedassuchontheprimarycaregiver'sapplicationforanidentificationcardunderthis 70sectionorinotherwrittennotificationtothedepartment. 71 (15)"Qualifyingmedicalcondition"meanstheconditionof,symptomsrelatedto,or 72side-effectsfromthetreatmentof: 73 (a)Cancer; 74 (b)Epilepsy; 75 (c)Glaucoma; 76 (d)Intractablemigrainesunresponsivetoothertreatment; 77 (e)Achronicmedicalconditionthatcausessevere,persistentpainorpersistent 78musclespasms,includingbutnotlimitedtothoseassociatedwithmultiplesclerosis,seizures, 79Parkinson'sdisease,andTourette'ssyndrome; 80 (f)Debilitatingpsychiatricdisorders,including,butnotlimitedto,posttraumatic 81stressdisorder,ifdiagnosedbyastatelicensedpsychiatrist; 82 (g)Humanimmunodeficiencyvirusoracquiredimmunedeficiencysyndrome; 83 (h)Achronicmedicalconditionthatisnormallytreatedwithaprescription 84medicationthatcouldleadtophysicalorpsychologicaldependence,whenaphysician HCSHJR142 3 85determinesthatmedicaluseofmarijuanacouldbeeffectiveintreatingthatconditionand 86wouldserveasasaferalternativetotheprescriptionmedication; 87 (i)Anyterminalillness;or 88 (j)Intheprofessionaljudgmentofaphysician,anyotherchronic,debilitatingorother 89medicalcondition,including,butnotlimitedto,hepatitisC,amyotrophiclateralsclerosis, 90inflammatoryboweldisease,Crohn'sdisease,Huntington'sdisease,autism,neuropathies, 91sicklecellanemia,agitationofAlzheimer'sdisease,cachexia,andwastingsyndrome. 92 (16)"Qualifyingpatient"meansaMissouriresidentdiagnosedwithatleastone 93qualifyingmedicalcondition. 94 3.CreatingPatientAccesstoMedicalMarijuana. 95 (1)Incarryingouttheimplementationofthissection,thedepartmentshallhavethe 96authorityto: 97 (a)Grantorrefusestatelicensesandcertificationsforthecultivation,manufacture, 98dispensing,sale,testing,tracking,andtransportationofmarijuanaformedicaluseasprovided 99bylaw;suspend,fine,restrict,orrevokesuchlicensesandcertificationsuponaviolationof 100thissectionorarulepromulgatedpursuanttothissection;andimposeanyadministrative 101penaltyauthorizedbythissectionoranyrulepromulgatedpursuanttothissection. 102 (b)Promulgaterulesandemergencyrulesnecessaryfortheproperregulationand 103controlofthecultivation,manufacture,dispensing,andsaleofmarijuanaformedicaluseand 104fortheenforcementofthissectionsolongaspatientaccessisnotrestrictedunreasonablyand 105suchrulesarereasonablynecessaryforpatientsafetyortorestrictaccesstoonlylicensees 106andqualifyingpatients. 107 (c)Developsuchforms,certificates,licenses,identificationcards,andapplicationsas 108arenecessaryfor,orreasonablyrelatedto,theadministrationofthissectionoranyofthe 109rulespromulgatedunderthissection; 110 (d)Requireaseed-to-saletrackingsystemthattracksmedicalmarijuanafromeither 111theseedorimmatureplantstageuntilthemedicalmarijuanaormedicalmarijuana-infused 112productissoldtoaqualifyingpatientorprimarycaregivertoensurethatnomedical 113marijuanagrownbyamedicalmarijuanacultivationfacilityormanufacturedbyamedical 114marijuana-infusedproductsmanufacturingfacilityissoldorotherwisetransferredexceptbya 115medicalmarijuanadispensaryfacility.Thedepartmentshallcertify,ifpossible,atleasttwo 116commerciallyavailablesystemstolicenseesascompliantwithitstrackingstandardsand 117issuestandardsforthecreationoruseofothersystemsbylicensees. 118 (e)Issuestandardsforthesecuretransportationofmarijuanaandmarijuana-infused 119products.Thedepartmentshallcertifyentitieswhichdemonstratecompliancewithits 120transportationstandardstotransportmarijuanaandmarijuana-infusedproductstoamedical 121marijuanacultivationfacility,amedicalmarijuana-infusedproductsmanufacturingfacility,a HCSHJR142 4 122medicalmarijuanadispensaryfacility,amedicalmarijuanatestingfacility,oranotherentity 123withatransportationcertification.Thedepartmentshalldeveloporadoptfromanyother 124governmentalagencysuchsafetyandsecuritystandardsasarereasonablynecessaryforthe 125transportationofmarijuana.Anyentitylicensedorcertifiedpursuanttothissectionshallbe 126allowedtotransportcannabis. 127 (f)Thedepartmentmaychargeafeenottoexceed$5,000foranycertificationissued 128pursuanttothissection. 129 (g)Prepareandtransmitannuallyapubliclyavailablereportaccountingtothe 130governorfortheefficientdischargeofallresponsibilitiesassignedtothedepartmentunder 131thissection; 132 (h)Establishasystemtonumericallyscorecompetingmedicalmarijuanalicensee 133andcertificateapplicants,onlyincaseswheremoreapplicantsapplythantheminimum 134numberoflicensesorcertificatesascalculatedbythissection,whichscoringshallbelimited 135toananalysisofthefollowing: 136 (i)thecharacter,veracity,background,qualifications,andrelevantexperienceof 137principalofficersormanagers; 138 (ii)thebusinessplanproposedbytheapplicant,whichinthecaseofcultivation 139facilitiesanddispensariesshallincludetheabilitytomaintainanadequatesupplyof 140marijuana,planstoensuresafetyandsecurityofqualifyingpatientsandthecommunity, 141procedurestobeusedtopreventdiversion,andanyplanformakingmarijuanaavailableto 142low-incomequalifyingpatients; 143 (iii)sitesecurity; 144 (iv)experienceinalegalcannabismarket; 145 (v)inthecaseofmedicalmarijuanatestingfacilities,theexperienceoftheirpersonnel 146withtestingmarijuana,foodordrugsfortoxinsand/orpotencyandhealthcareindustry 147experience; 148 (vi)thepotentialforpositiveeconomicimpactinthesitecommunity; 149 (vii)inthecaseofmedicalmarijuanacultivationfacilities,capacityorexperiencewith 150agriculture,horticulture,andhealthcare; 151 (viii)inthecaseofmedicalmarijuanadispensaryfacilities,capacityorexperience 152withhealthcare,thesuitabilityoftheproposedlocation,anditsaccessibilityforpatients; 153 (ix)inthecaseofmedicalmarijuana-infusedproductsmanufacturingfacilities, 154capacityorexperiencewithfoodandbeveragemanufacturing;and 155 (x)maintainingcompetitivenessinthemarijuanaformedicalusemarketplace. 156 Inrankingapplicantsandawardinglicensesandcertificates,thedepartmentmay 157consultorcontractwithotherpublicagencieswithrelevantexpertiseregardingthesefactors. HCSHJR142 5 158Thedepartmentshallliftoreaseanylimitonthenumberoflicenseesorcertificateholdersin 159ordertomeetthedemandformarijuanaformedicalusebyqualifyingpatients. 160 (2)Thedepartmentshallissueanyrulesoremergencyrulesnecessaryforthe 161implementationandenforcementofthissectionandtoensuretherightto,availability,and 162safeuseofmarijuanaformedicalusebyqualifyingpatients.Indevelopingsuchrulesor 163emergencyrules,thedepartmentmayconsultwithotherpublicagencies.Inadditiontoany 164otherrulesoremergencyrulesnecessarytocarryoutthemandatesofthissection,the 165departmentmayissuerulesoremergencyrulesrelatingtothefollowingsubjects: 166 (a)Compliancewith,enforcementof,orviolationofanyprovisionofthissectionor 167anyruleissuedpursuanttothissection,includingproceduresandgroundsfordenying, 168suspending,fining,restricting,orrevokingastatelicenseorcertificationissuedpursuantto 169thissection; 170 (b)Specificationsofdutiesofofficersandemployeesofthedepartment; 171 (c)Instructionsorguidanceforlocalauthoritiesandlawenforcementofficers; 172 (d)Requirementsforinspections,investigations,searches,seizures,andsuch 173additionalenforcementactivitiesasmaybecomenecessaryfromtimetotime; 182 (h)Developmentofindividualidentificationcardsforowners,officers,managers, 183contractors,employees,andothersupportstaffofentitieslicensedorcertifiedpursuanttothis 184section,includingafingerprint-basedfederalandstatecriminalrecordcheckinaccordance 185withU.S.PublicLaw92-544,oritssuccessorprovisions,asmayberequiredbythe 186departmentpriortoissuingacardandprocedurestoensurethatcardsfornewapplicantsare 187issuedwithinfourteendays.Applicantslicensedpursuanttothissectionshallsubmit 188fingerprintstotheMissouristatehighwaypatrolforthepurposeofconductingastateand 189federalfingerprint-basedcriminalbackgroundcheck.TheMissouristatehighwaypatrol,if 190necessary,shallforwardthefingerprintstotheFederalBureauofInvestigation(FBI)forthe 191purposeofconductingafingerprint-basedcriminalbackgroundcheck.Fingerprintsshallbe 192submittedpursuantto43.543andfeesshallbepaidpursuantto43.530; 193 (i)Securityrequirementsforanypremiseslicensedorcertifiedpursuanttothis 194section,including,ataminimum,lighting,physicalsecurity,video,alarmrequirements,and HCSHJR142 6 195otherminimumproceduresforinternalcontrolasdeemednecessarybythedepartmentto 196properlyadministerandenforcetheprovisionsofthissection,includingreporting 197requirementsforchanges,alterations,ormodificationstothepremises; 206 (o)Statelicensingprocedures,includingproceduresforrenewals,reinstatements, 207initiallicenses,andthepaymentoflicensingfees; 208 (p)Thereportingandtransmittaloftaxpayments; 209 (q)Authorizationforthedepartmentofrevenuetohaveaccesstolicensing 210informationtoensuretaxpaymentandtheeffectiveadministrationofthissection;and 211 (r)Suchothermattersasarenecessaryforthefair,impartial,stringent,and 212comprehensiveadministrationofthissection. 213 (3)Thedepartmentshallissuerulesoremergencyrulesforamedicalmarijuanaand 214medicalmarijuana-infusedproductsindependenttestingandcertificationprogramfor 215medicalmarijuanalicenseesandrequiringlicenseestotestmedicalmarijuanausingoneor 216moreimpartial,independentlaboratoriestoensure,ataminimum,thatproductssoldfor 217humanconsumptiondonotcontaincontaminantsthatareinjurioustohealth,toensurecorrect 218labelingandmeasurepotency.Thedepartmentshallnotrequireanymedicalmarijuanaor 219medicalmarijuana-infusedproductstobetestedmorethanoncepriortosale. 220 (4)Thedepartmentshallissuerulesoremergencyrulestoprovideforthe 221certificationofandstandardsformedicalmarijuanatestingfacilities,includingthe 222requirementsforequipmentandqualificationsforpersonnel,butshallnotrequire 223certificateholderstohaveanyfederalagencylicensingorhaveanyrelationshipwitha 224federallylicensedtestingfacility.Thedepartmentshallcertify,ifpossible,atleasttwo 225entitiesasmedicalmarijuanatestingfacilities.Nomedicalmarijuanatestingfacilityshallbe 226ownedbyanentityundersubstantiallycommoncontrol,ownership,ormanagementasa 227medicalmarijuanacultivationfacility,medicalmarijuana-infusedproductmanufacturing 228facility,ormedicalmarijuanadispensaryfacility. 229 (5)Thedepartmentshallmaintaintheconfidentialityofreportsorotherinformation 230obtainedfromanapplicantorlicenseecontaininganyindividualizeddata,information,or 231recordsrelatedtothelicenseeoritsoperation,includingsalesinformation,financialrecords, HCSHJR142 7 232taxreturns,creditreports,cultivationinformation,testingresults,andsecurityinformation 233andplans,orrevealinganypatientinformation,oranyotherrecordsthatareexemptfrom 234publicinspectionpursuanttostateorfederallaw.Suchreportsorotherinformationmaybe 235usedonlyforapurposeauthorizedbythissection.Anyinformationreleasedrelatedto 236patientsmaybeusedonlyforapurposeauthorizedbyfederallawandthissection,including 237verifyingthatapersonwhopresentedapatientidentificationcardtoastateorlocallaw 238enforcementofficialislawfullyinpossessionofsuchcard. 239 (6)WithinonehundredeightydaysofDecember6,2018,thedepartmentshallmake 240availabletothepubliclicenseapplicationformsandapplicationinstructionsformedical 241marijuanacultivationfacilities,medicalmarijuanatestingfacilities,medicalmarijuana 242dispensaryfacilities,andmedicalmarijuana-infusedproductsmanufacturingfacilities. 243 (7)WithinonehundredeightydaysofDecember6,2018,thedepartmentshallmake 244availabletothepublicapplicationformsandapplicationinstructionsforqualifyingpatient, 245qualifyingpatientcultivation,andprimarycaregiveridentificationcards.Withintwohundred 246tendaysofDecember6,2018,thedepartmentshallbeginacceptingapplicationsforsuch 247identificationcards. 248 (8)Anentitymayapplytothedepartmentforandobtainoneormorelicensesto 249growmarijuanaasamedicalmarijuanacultivationfacility.Eachfacilityinoperationshall 250requireaseparatelicense,butmultiplelicensesmaybeutilizedinasinglefacility.Each 251indoorfacilityutilizingartificiallightingmaybelimitedbythedepartmenttothirtythousand 252squarefeetoffloweringplantcanopyspace.Eachoutdoorfacilityutilizingnaturallighting 253maybelimitedbythedepartmenttotwothousandeighthundredfloweringplants.Each 254greenhousefacilityusingacombinationofnaturalandartificiallightingmaybelimitedby 255thedepartment,attheelectionofthelicensee,totwothousandeighthundredfloweringplants 256orthirtythousandsquarefeetoffloweringplantcanopy.Thelicenseshallbevalidforthree 257yearsfromitsdateofissuanceandshallberenewable,exceptforgoodcause.The 258departmentshallchargeeachapplicantanonrefundablefeeoftenthousanddollarsperlicense 259applicationorrenewalforallapplicantsfilinganapplicationwithinthreeyearsofDecember 2606,2018,andshallchargeeachapplicantanonrefundablefeeoffivethousanddollarsper 261licenseapplicationorrenewalthereafter.Oncegranted,thedepartmentshallchargeeach 262licenseeanannualfeeoftwenty-fivethousanddollarsperfacilitylicense.Applicationand 263licensefeesshallbeincreasedordecreasedeachyearbythepercentageofincreaseor 264decreasefromtheendofthepreviouscalendaryearoftheConsumerPriceIndex,or 265successorindexaspublishedbytheU.S.DepartmentofLabor,oritssuccessoragency.No 266morethanthreemedicalmarijuanacultivationfacilitylicensesshallbeissuedtoanyentity 267undersubstantiallycommoncontrol,ownership,ormanagement. HCSHJR142 8 268 (9)Anentitymayapplytothedepartmentforandobtainoneormorelicensesto 269operateamedicalmarijuanadispensaryfacility.Eachfacilityinoperationshallrequirea 270separatelicense.Alicenseshallbevalidforthreeyearsfromitsdateofissuanceandshallbe 271renewable,exceptforgoodcause.Thedepartmentshallchargeeachapplicanta 272nonrefundablefeeofsixthousanddollarsperlicenseapplicationorrenewalforeach 273applicantfilinganapplicationwithinthreeyearsofDecember6,2018,andshallchargeeach 274applicantanonrefundablefeeofthreethousanddollarsperlicenseapplicationorrenewal 275thereafter.Oncegranted,thedepartmentshallchargeeachlicenseeanannualfeeoften 276thousanddollarsperfacilitylicense.Applicationandlicensefeesshallbeincreasedor 277decreasedeachyearbythepercentageofincreaseordecreasefromtheendoftheprevious 278calendaryearoftheConsumerPriceIndex,orsuccessorindexaspublishedbytheU.S. 279DepartmentofLabor,oritssuccessoragency.Nomorethanfivemedicalmarijuana 280dispensaryfacilitylicensesshallbeissuedtoanyentityundersubstantiallycommoncontrol, 281ownership,ormanagement. 282 (10)Anentitymayapplytothedepartmentforandobtainoneormorelicensesto 283operateamedicalmarijuana-infusedproductsmanufacturingfacility.Eachfacilityin 284operationshallrequireaseparatelicense.Alicenseshallbevalidforthreeyearsfromitsdate 285ofissuanceandshallberenewable,exceptforgoodcause.Thedepartmentshallchargeeach 286applicantanonrefundablefeeofsixthousanddollarsperlicenseapplicationorrenewalfor 287eachapplicantfilinganapplicationwithinthreeyearsofDecember6,2018,andshallcharge 288eachapplicantanonrefundablefeeofthreethousanddollarsperlicenseapplicationor 314possessedbyoronbehalfofeachqualifyingpatient,providedthatlimitisnotlessthana 315sixty-daysupplyofdried,unprocessedmarijuana,oritsequivalent.Aprimarycaregivermay 316possessaseparatelegallimitforeachqualifyingpatientundertheircareandaseparatelegal 317limitforthemselvesiftheyareaqualifyingpatient.Qualifyingpatientscultivatingmarijuana 318formedicalusemaypossessuptoaninety-daysupply,solongasthesupplyremainson 319propertyundertheircontrol.Anysuchlimitshallnotapplytoaqualifyingpatientwith 320writtencertificationfromtwoindependentphysiciansthattherearecompellingreasonsfor 321additionalamounts.Possessionofbetweenthelegallimitanduptotwicethelegallimitshall 322subjectthepossessortodepartmentsanctions,includinganadministrativepenaltyandlossof 323theirpatientidentificationcardforuptoayear.Purposefullypossessingamountsinexcessof 324twicethelegallimitshallbepunishablebyimprisonmentofuptooneyearandafineofupto 325twothousanddollars. 326 (15)Thedepartmentmayrestricttheaggregatenumberoflicensesgrantedfor 327medicalmarijuanacultivationfacilities,provided,however,thatthenumbermaynotbe 328limitedtofewerthanonelicensepereveryonehundredthousandinhabitants,oranyportion 329thereof,ofthestateofMissouri,accordingtothemostrecentcensusoftheUnitedStates.A 330decreaseinthenumberofinhabitantsinthestateofMissourishallhavenoimpact. 331 (16)Thedepartmentmayrestricttheaggregatenumberoflicensesgrantedfor 332marijuana-infusedproductsmanufacturingfacilities,provided,however,thatthenumbermay 333notbelimitedtofewerthanonelicensepereveryseventythousandinhabitants,orany 334portionthereof,ofthestateofMissouri,accordingtothemostrecentcensusoftheUnited 335States.AdecreaseinthenumberofinhabitantsinthestateofMissourishallhavenoimpact. 336 (17)Thedepartmentmayrestricttheaggregatenumberoflicensesgrantedfor 337medicalmarijuanadispensaryfacilities,provided,however,thatthenumbermaynotbe 338limitedtofewerthantwenty-fourlicensesineachUnitedStatescongressionaldistrictinthe 339stateofMissouripursuanttothemapofeachoftheeightcongressionaldistrictsasdrawnand 340effectiveonDecember6,2018.Futurechangestotheboundariesoforthenumberof 341congressionaldistrictsshallhavenoimpact. HCSHJR142 10 342 (18)Thedepartmentshallbeginacceptinglicenseandcertificationapplicationsfor 343medicalmarijuanadispensaryfacilities,medicalmarijuanatestingfacilities,medical 344marijuanacultivationfacilities,medicalmarijuana-infusedproductsmanufacturing 345facilities,seed-to-saletrackingsystems,andfortransportationofmarijuananolaterthan 346twohundredfortydaysafterDecember6,2018.Applicationsforlicensesandcertifications 347underthissectionshallbeapprovedordeniedbythedepartmentnolaterthanonehundred 348fiftydaysaftertheirsubmission.Ifthedepartmentfailstocarryoutitsnondiscretionaryduty 349toapproveordenyanapplicationwithinonehundredfiftydaysofsubmission,anapplicant 350mayimmediatelyseekacourtordercompellingthedepartmenttoapproveordenythe 351application. 352 (19)Qualifyingpatientsunderthissectionshallobtainandannuallyrenewan 353identificationcardorcardsfromthedepartment.Thedepartmentshallchargeafeeof 354twenty-fivedollarsperyearpercardwithsuchfeetobeincreasedordecreasedeachyearby 355thepercentageofincreaseordecreasefromtheendofthepreviouscalendaryearofthe 356ConsumerPriceIndex,orsuccessorindexaspublishedbytheU.S.DepartmentofLaboror 357itssuccessoragency.Uponreceivinganapplicationforaqualifyingpatientidentification 358cardorqualifyingpatientcultivationidentificationcard,thedepartmentshall,withinthirty 359days,eitherissuethecardorprovideawrittenexplanationforitsdenial.Ifthedepartment 360failstodenyandfailstoissueacardtoaneligiblequalifyingpatientwithinthirtydays,then 361theirphysiciancertificationshallserveastheirqualifyingpatientidentificationcardor 362qualifyingpatientcultivationidentificationcardforuptooneyearfromthedateofphysician 363certification.Allinitialapplicationsfororrenewalsofaqualifyingpatientidentificationcard 364orqualifyingpatientcultivationidentificationcardshallbeaccompaniedbyaphysician 365certificationthatislessthanthirtydaysold. 366 (20)Primarycaregiversunderthissectionshallobtainandannuallyrenewan 367identificationcardfromthedepartment.Thedepartmentshallchargeafeeoftwenty-five 368dollarsperyear,withsuchfeetobeincreasedordecreasedeachyearbythepercentageof 369increaseordecreasefromtheendofthepreviouscalendaryearoftheConsumerPriceIndex, 370orsuccessorindexaspublishedbytheU.S.DepartmentofLabor,oritssuccessoragency. 371Uponreceivinganapplicationforaprimarycaregiveridentificationcard,thedepartment 372shall,withinthirtydays,eitherissuethecardorprovideawrittenexplanationforitsdenial. 373 (21)AllmarijuanaformedicalusesoldinMissourishallbecultivatedinalicensed 374medicalmarijuanacultivationfacilitylocatedinMissouri. 375 (22)Allmarijuana-infusedproductsformedicalusesoldinthestateofMissourishall 376bemanufacturedinamedicalmarijuana-infusedproductsmanufacturingfacility. 377 (23)Thedenialofalicense,licenserenewal,oridentificationcardbythedepartment 378shallbeappealabletotheadministrativehearingcommission,oritssuccessorentity. HCSHJR142 11 379Followingtheexhaustionofadministrativereview,denialofalicense,licenserenewal,or 380identificationcardbythedepartmentshallbesubjecttojudicialreviewasprovidedbylaw. 381 (24)Noelectedofficialshallinterferedirectlyorindirectlywiththedepartment's 382obligationsandactivitiesunderthissection. 383 (25)Thedepartmentshallnothavetheauthoritytoapplyorenforceanyruleor 384regulationthatwouldimposeanundueburdenonanyoneormorelicenseesorcertificate 385holders,anyqualifyingpatients,oracttounderminethepurposesofthissection. 386 4.TaxationandReporting. 387 (1)Ataxisleviedupontheretailsaleofmarijuanaformedicalusesoldatmedical 388marijuanadispensaryfacilitieswithinthestate.Thetaxshallbeatarateoffourpercentof 389theretailprice.Thetaxshallbecollectedbyeachlicensedmedicalmarijuanadispensary 390facilityandpaidtothedepartmentofrevenue.Afterretainingnomorethanfivepercentfor 391itsactualcollectioncosts,amountsgeneratedbythetaxleviedinthissectionshallbe 392depositedbythedepartmentofrevenueintotheMissouriveterans'healthandcarefund. 393Licensedentitiesmakingretailsaleswithinthestateshallbeallowedapprovedcreditfor 394returnsprovidedthetaxwaspaidonthereturneditemandthepurchaserwasgiventherefund 395orcredit. 396 (2)Thereisherebycreatedinthestatetreasurythe"MissouriVeterans'Healthand 397CareFund",whichshallconsistoftaxesandfeescollectedunderthissection.Thestate 398treasurershallbecustodianofthefund,andheorsheshallinvestmoniesinthefundinthe 399samemannerasotherfundsareinvested.Anyinterestandmoniesearnedonsuch 400investmentsshallbecreditedtothefund.Notwithstandinganyotherprovisionoflaw,any 401moniesremaininginthefundattheendofabienniumshallnotreverttothecreditofthe 402generalrevenuefund.Thecommissionerofadministrationisauthorizedtomakecash 403operatingtransferstothefundforpurposesofmeetingthecashrequirementsofthe 404departmentinadvanceofitreceivingannualapplication,licensing,andtaxrevenue,withany 405suchtransferstoberepaidasprovidedbylaw.Thefundshallbeadedicatedfundandshall 406[standappropriatedwithoutfurtherlegislativeaction] bedistributedasfollows: 407 (a)First,tothedepartment,anamountnecessaryforthedepartmenttocarryoutthis 408section,includingrepaymentofanycashoperatingtransfers,paymentsmadethroughcontract 409oragreementwithotherstateandpublicagenciesnecessarytocarryoutthissection,anda 410reservefundtomaintainareasonableworkingcashbalanceforthepurposeofcarryingout 411thissection; 412 (b)Next,theremainderofsuchfundsshallbetransferredtotheMissouriveterans 413commissionforhealthandcareservicesformilitaryveterans,includingthefollowing 414purposes:operations,maintenance, andcapitalimprovementsoftheMissouriveteranshomes 415andconstructionofadditionalveteranshomes, theMissouriserviceofficer'sprogram,and HCSHJR142 12 416otherservicesforveteransapprovedbythecommission,including,butnotlimitedto,health 417careservices,mentalhealthservices,suicideprevention,drugrehabilitationservices, 418housingassistance,jobtraining,tuitionassistance,andhousingassistancetoprevent 419homelessness.TheMissouriveteranscommissionshallcontractwithotherpublicagencies 420forthedeliveryofservicesbeyonditsexpertise. 421 (c)Allmoniesfromthetaxesauthorizedunderthissubsectionshallprovide 422additionaldedicatedfundingforthepurposesenumeratedaboveandshallnotreplaceexisting 423dedicatedfunding. 424 (3)Forallretailsalesofmarijuanaformedicaluse,arecordshallbekeptbytheseller 425whichidentifies,bysecureandencryptedpatientnumberissuedbythesellertothequalifying 426patientinvolvedinthesale,allamountsandtypesofmarijuanainvolvedinthesaleandthe 427totalamountofmoneyinvolvedinthesale,includingitemizations,taxescollectedandgrand 428totalsaleamounts.Allsuchrecordsshallbekeptonthepremisesinareadilyavailable 429formatandbemadeavailableforreviewbythedepartmentandthedepartmentofrevenue 430uponrequest.Suchrecordsshallberetainedforfiveyearsfromthedateofthesale. 431 (4)Thetaxleviedpursuanttothissubsectionisseparatefrom,andinadditionto,any 432generalstateandlocalsalesandusetaxesthatapplytoretailsales,whichshallcontinuetobe 433collectedanddistributedasprovidedbygenerallaw. 434 (5)Exceptasauthorizedinthissubsection,noadditionaltaxesshallbeimposedon 435thesaleofmarijuanaformedicaluse. 436 (6)ThefeesandtaxesprovidedforinthisArticleXIV,Section1shallbefully 437enforceablenotwithstandinganyotherprovisioninthisConstitutionpurportedlyprohibiting 438orrestrictingthetaxesandfeesprovidedforherein. 439 (7)Theunexpendedbalanceexistinginthefundshallbeexemptfromtheprovisions 440ofsection33.080relatingtothetransferofunexpendedbalancestothegeneralrevenuefund. 441 5.AdditionalPatient,Physician,CaregiverandProviderProtections. 442 (1)Exceptasprovidedinthissection,thepossessionofmarijuanainquantitiesless 443thanthelimitsofthissection,orestablishedbythedepartment,andtransportationof 444marijuanafromamedicalmarijuanadispensaryfacilitytothequalifyingpatient'sresidence 445shallnotsubjectthepossessortoarrest,criminalorcivilliability,orsanctionsunderMissouri 446law,providedthatthepossessorproducesondemandtotheappropriateauthorityavalid 447qualifyingpatientidentificationcard;avalidqualifyingpatientcultivationidentificationcard; 448avalidphysiciancertificationwhilemakingapplicationforanidentificationcard;oravalid 449primarycaregiveridentificationcard.Productionoftherespectiveequivalentidentification 450cardorauthorizationissuedbyanotherstateorpoliticalsubdivisionofanotherstateshallalso 451meettherequirementsofthissubdivision. HCSHJR142 13 452 (2)Nopatientshallbedeniedaccesstoorpriorityforanorgantransplantbecause 453theyholdaqualifyingpatientidentificationcardorusemarijuanaformedicaluse. 454 (3)Aphysicianshallnotbesubjecttocriminalorcivilliabilityorsanctionsunder 455MissourilawordisciplinebytheMissouristateboardofregistrationforthehealingarts,or 456itssuccessoragency,forowning,operating,investingin,beingemployedby,orcontracting 457withanyentitylicensedorcertifiedpursuanttothissectionorissuingaphysiciancertification 458toapatientdiagnosedwithaqualifyingmedicalconditioninamannerconsistentwiththis 459sectionandlegalstandardsofprofessionalconduct. 460 (4)Ahealthcareprovidershallnotbesubjecttocivilorcriminalprosecutionunder 461Missourilaw,denialofanyrightorprivilege,civiloradministrativepenaltyorsanction,or 462disciplinaryactionbyanyaccreditationorlicensingboardorcommissionforowning, 463operating,investingin,beingemployedby,orcontractingwithanyentitylicensedorcertified 464pursuanttothissectionorprovidinghealthcareservicesthatinvolvethemedicaluseof 465marijuanaconsistentwiththissectionandlegalstandardsofprofessionalconduct. 466 (5)Amedicalmarijuanatestingfacilityshallnotbesubjecttocivilorcriminal 467prosecutionunderMissourilaw,denialofanyrightorprivilege,civiloradministrative 468penaltyorsanction,ordisciplinaryactionbyanyaccreditationorlicensingboardor 469commissionforprovidinglaboratorytestingservicesthatrelatetothemedicaluseof 470marijuanaconsistentwiththissectionandotherwisemeetinglegalstandardsofprofessional 471conduct. 472 (6)Ahealthcareprovidershallnotbesubjecttomandatoryreportingrequirements 473forthemedicaluseofmarijuanabynonemancipatedqualifyingpatientsundereighteenyears 474ofageinamannerconsistentwiththissectionandwithconsentofaparentorguardian. 475 (7)Aprimarycaregivershallnotbesubjecttocriminalorcivilliabilityorsanctions 476underMissourilawforpurchasing,transporting,oradministeringmarijuanaformedicaluse 477toaqualifyingpatientorparticipatinginthepatientcultivationofuptosixflowering 478marijuanaplantsperpatientinamannerconsistentwiththissectionandgenerallyestablished 479legalstandardsofpersonalorprofessionalconduct. 480 (8)Anattorneyshallnotbesubjecttodisciplinaryactionbythestatebarassociation 481orotherprofessionallicensingbodyforowning,operating,investingin,beingemployedby, 482contractingwith,orprovidinglegalassistancetoprospectiveorlicensedmedicalmarijuana 483testingfacilities,medicalmarijuanacultivationfacilities,medicalmarijuanadispensary 484facilities,medicalmarijuana-infusedproductsmanufacturingfacilities,qualifyingpatients, 485primarycaregivers,physicians,healthcareprovidersorothersrelatedtoactivitythatisno 486longersubjecttocriminalpenaltiesunderstatelawpursuanttothissection. 487 (9)Actionsandconductbyqualifyingpatients,primarycaregivers,medical 488marijuanatestingfacilities,medicalmarijuanacultivationfacilities,medicalmarijuana- HCSHJR142 14 489infusedproductsmanufacturingfacilities,ormedicalmarijuanadispensaryfacilitieslicensed 490orregisteredwiththedepartment,ortheiremployeesoragents,aspermittedbythissection 491andincompliancewithdepartmentregulationsandotherstandardsoflegalconduct,shallnot 492besubjecttocriminalorcivilliabilityorsanctionsunderMissourilaw,exceptasprovidedfor 493bythissection. 494 (10)Nothinginthissectionshallprovideimmunityfornegligence,eithercommon 495laworstatutorilycreated,norcriminalimmunitiesforoperatingavehicle,aircraft,dangerous 496device,ornavigatingaboatundertheinfluenceofmarijuana. 497 (11)ItisthepublicpolicyofthestateofMissourithatcontractsrelatedtomarijuana 498formedicalusethatareenteredintobyqualifyingpatients,primarycaregivers,medical 499marijuanatestingfacilities,medicalmarijuanacultivationfacilities,medicalmarijuana- 500infusedproductsmanufacturingfacilities,ormedicalmarijuanadispensaryfacilitiesand 501thosewhoallowpropertytobeusedbythoseentities,shouldbeenforceable.Itisthepublic 502policyofthestateofMissourithatnocontractenteredintobyqualifyingpatients,primary 503caregivers,medicalmarijuanatestingfacilities,medicalmarijuanacultivationfacilities, 504medicalmarijuana-infusedproductsmanufacturingfacilities,ormedicalmarijuana 505dispensaryfacilities,orbyapersonwhoallowspropertytobeusedforactivitiesthatare 506exemptfromstatecriminalpenaltiesbythissection,shallbeunenforceableonthebasisthat 507activitiesrelatedtomedicalmarijuanamaybeprohibitedbyfederallaw. 508 6.Legislation. 509 Nothinginthissectionshalllimitthegeneralassemblyfromenactinglawsconsistent 510withthissection,orotherwiseeffectuatingthepatientrightsofthissection.Thelegislature 511shallnotenactlawsthathindertherightofqualifyingpatientstoaccessmarijuanaformedical 512useasgrantedbythissection. 513 7.AdditionalProvisions. 514 (1)Nothinginthissectionpermitsapersonto: 515 (a)Consumemarijuanaformedicaluseinajailorcorrectionalfacility; 516 (b)Undertakeanytaskundertheinfluenceofmarijuanawhendoingsowould 517constitutenegligenceorprofessionalmalpractice;or 518 (c)Operate,navigate,orbeinactualphysicalcontrolofanydangerousdeviceor 519motorvehicle,aircraftormotorboatwhileundertheinfluenceofmarijuana;or 520 (d)Bringaclaimagainstanyemployer,formeremployer,orprospectiveemployer 521forwrongfuldischarge,discrimination,oranysimilarcauseofactionorremedy,basedonthe 522employer,formeremployer,orprospectiveemployerprohibitingtheemployee,former 523employee,orprospectiveemployeefrombeingundertheinfluenceofmarijuanawhileat 524workordiscipliningtheemployeeorformeremployee,uptoandincludingterminationfrom 525employment,forworkingorattemptingtoworkwhileundertheinfluenceofmarijuana. HCSHJR142 15 526 (2)Nomedicalmarijuanacultivationfacility,medicalmarijuanatestingfacility, 527medicalmarijuanadispensaryfacility,ormedicalmarijuana-infusedproductsmanufacturing 528facility,orentitywithatransportationcertificationshallbeowned,inwholeorinpart,or 529haveasanofficer,director,boardmember,manager,oremployee,anyindividualwitha 530disqualifyingfelonyoffense.A"disqualifyingfelonyoffense"isaviolationof,and 531convictionorguiltypleato,stateorfederallawthatis,orwouldhavebeen,afelonyunder 532Missourilaw,regardlessofthesentenceimposed,unlessthedepartmentdeterminesthat: 533 (a)Theperson'sconvictionwasforthemedicaluseofmarijuanaorassistinginthe 534medicaluseofmarijuana;or 535 (b)Theperson'sconvictionwasforanonviolentcrimeforwhichheorshewasnot 536incarceratedandthatismorethanfiveyearsold;or 537 (c)Morethanfiveyearshavepassedsincethepersonwasreleasedfromparoleor 538probation,andheorshehasnotbeenconvictedofanysubsequentcriminaloffenses. 539 Thedepartmentmayconsultwithandrelyontherecords,adviceand 540recommendationsoftheattorneygeneralandthedepartmentofpublicsafety,ortheir 541successorentities,inapplyingthissubdivision. 542 (3)Allmedicalmarijuanacultivationfacility,medicalmarijuanadispensaryfacility, 543andmedicalmarijuana-infusedproductsmanufacturingfacilitylicenses,entitieswithmedical 544marijuanatestingfacilitycertifications,andentitieswithtransportationcertificationsshallbe 545heldbyentitiesthataremajorityownedbynaturalpersonswhohavebeencitizensofthestate 546ofMissouriforatleastoneyearpriortotheapplicationforsuchlicenseorcertification. 547Notwithstandingtheforegoing,entitiesoutsidethestateofMissourimayownaminority 548stakeinsuchentities. 549 (4)Nomedicalmarijuanacultivationfacility,medicalmarijuanadispensaryfacility, 550ormedicalmarijuana-infusedproductsmanufacturingfacilityshallmanufacture,packageor 551labelmarijuanaormarijuana-infusedproductsinafalseormisleadingmanner.Noperson 552shallsellanyproductinamannerdesignedtocauseconfusionbetweenamarijuanaor 553marijuana-infusedproductandanyproductnotcontainingmarijuana.Aviolationofthis 554subdivisionshallbepunishablebyanappropriateandproportionaldepartmentsanction,upto 555andincludinglossoflicense. 556 (5)Allediblemarijuana-infusedproductsshallbesoldinindividual,child-resistant 557containersthatarelabeledwithdosageamounts,instructionsforuse,andestimatedlengthof 558effectiveness.Allmarijuanaandmarijuana-infusedproductsshallbesoldincontainers 559clearlyandconspicuouslylabeled,inafontsizeatleastaslargeasthelargestotherfontsize 560usedonthepackage,ascontaining"Marijuana",ora"Marijuana-InfusedProduct".Violation 561ofthisprohibitionshallsubjecttheviolatortodepartmentsanctions,includingan 562administrativepenalty. HCSHJR142 16 563 (6)Noindividualshallserveastheprimarycaregiverformorethanthreequalifying 564patients. 565 (7)Noqualifyingpatientshallconsumemarijuanaformedicaluseinapublicplace, 566unlessprovidedbylaw.Violationofthisprohibitionshallsubjecttheviolatortosanctionsas 567providedbygenerallaw. 568 (8)Nopersonshallextractresinsfrommarijuanausingdangerousmaterialsor 569combustiblegaseswithoutamedicalmarijuana-infusedproductsmanufacturingfacility 570license.Violationofthisprohibitionshallsubjecttheviolatortodepartmentsanctions, 571includinganadministrativepenaltyand,ifapplicable,lossoftheiridentificationcard, 572certificate,orlicenseforuptooneyear. 573 (9)Allqualifyingpatientcultivationshalltakeplaceinanenclosed,lockedfacility 574thatisequippedwithsecuritydevicesthatpermitaccessonlybythequalifyingpatientorby 575suchpatient'sprimarycaregiver.Twoqualifyingpatients,whobothholdvalidqualifying 576patientcultivationidentificationcards,mayshareoneenclosed,lockedfacility.Nomorethan 577twelvequalifyingpatientorprimarycaregivercultivatedfloweringmarijuanaplantsmaybe 578cultivatedinasingle,enclosedlockedfacility,exceptwhenaprimarycaregiveralsoholdsa 579qualifyingpatientcultivationidentificationcard,inwhichcasenomorethaneighteen 580floweringmarijuanaplantsmaybecultivatedinasingle,enclosed,lockedfacility. 581 (10)Nomedicalmarijuanacultivationfacility,medicalmarijuanadispensaryfacility, 582medicalmarijuana-infusedproductsmanufacturingfacility,medicalmarijuanatestingfacility, 583orentitywithatransportationcertificationshallassign,sell,give,lease,sublicense,or 584otherwisetransferitslicenseorcertificatetoanyotherentitywithouttheexpressconsentof 585thedepartment,nottobeunreasonablywithheld. 586 (11)Unlessallowedbythelocalgovernment,nonewmedicalmarijuanacultivation 587facility,medicalmarijuanatestingfacility,medicalmarijuanadispensaryfacility,ormedical 588marijuana-infusedproductsmanufacturingfacilityshallbeinitiallysitedwithinonethousand 589feetofanythen-existingelementaryorsecondaryschool,childday-carecenter,orchurch. 590Nolocalgovernmentshallprohibitmedicalmarijuanacultivationfacilities,medical 591marijuanatestingfacilities,medicalmarijuana-infusedproductsmanufacturingfacilities,or 592medicalmarijuanadispensaryfacilities,orentitieswithatransportationcertificationeither 593expresslyorthroughtheenactmentofordinancesorregulationsthatmaketheiroperation 594undulyburdensomeinthejurisdiction.However,localgovernmentsmayenactordinancesor 595regulationsnotinconflictwiththissection,orwithregulationsenactedpursuanttothis 596section,governingthetime,place,andmannerofoperationofsuchfacilitiesinthelocality. 597Alocalgovernmentmayestablishcivilpenaltiesforviolationofanordinanceorregulations 598governingthetime,place,andmannerofoperationofamedicalmarijuanacultivationfacility, 599medicalmarijuanatestingfacility,medicalmarijuana-infusedproductsmanufacturingfacility, HCSHJR142 17 600medicalmarijuanadispensaryfacility,orentityholdingatransportationcertificationthatmay 601operateinsuchlocality. 602 (12)UnlesssupersededbyfederallaworanamendmenttothisConstitution,a 603physicianshallnotcertifyaqualifyingconditionforapatientbyanymeansotherthan 604providingaphysiciancertificationforthepatient,whetherhandwritten,electronic,orin 605anothercommonlyusedformat.Aqualifyingpatientmustobtainanewphysician 606certificationatleastannually. 607 (13)Aphysicianshallnotissueacertificationforthemedicaluseofmarijuanafora 608nonemancipatedqualifyingpatientundertheageofeighteenwithoutthewrittenconsentof 609thequalifyingpatient'sparentorlegalguardian.Thedepartmentshallnotissueaqualifying 610patientidentificationcardonbehalfofanonemancipatedqualifyingpatientundertheageof 611eighteenwithoutthewrittenconsentofthequalifyingpatient'sparentorlegalguardian.Such 612cardshallbeissuedtooneoftheparentsorguardiansandnotdirectlytothepatient.Onlya 613parentorguardianmayserveasaprimarycaregiverforanonemancipatedqualifyingpatient 614undertheageofeighteen.Onlythequalifyingpatient'sparentorguardianshallpurchaseor 615possessmedicalmarijuanaforanonemancipatedqualifyingpatientundertheageofeighteen. 616Aparentorguardianshallsupervisetheadministrationofmedicalmarijuanatoa 617nonemancipatedqualifyingpatientundertheageofeighteen. 618 (14)Nothinginthissectionshallbeconstruedasmandatinghealthinsurance 619coverageofmedicalmarijuanaforqualifyingpatientuse. 620 (15)Realandpersonalpropertyusedinthecultivation,manufacture,transport, 621testing,distribution,sale,andadministrationofmarijuanaformedicaluseorforactivities 622otherwiseincompliancewiththissectionshallnotbesubjecttoassetforfeituresolely 623becauseofthatuse. 624 8.Severability. 625 Theprovisionsofthissectionareseverable,andifanyclause,sentence,paragraphor 626sectionofthismeasure,oranapplicationthereof,isadjudgedinvalidbyanycourtof 627competentjurisdiction,theotherprovisionsshallcontinuetobeineffecttothefullestextent 628possible. 629 9.EffectiveDate. 630 TheprovisionsofthissectionshallbecomeeffectiveonDecember6,2018. ✔ HCSHJR142 18
