1010 To repeal sections 50.327 and 57.317, RSMo, and to enact in lieu thereof two new sections relating

1313 Be it enacted by the General Assembly of the State of Missouri, as follows:
1414 Section A. Sections 50.327 and 57.317, RSMo, are repealed 1
1515 and two new sections enacted in lieu thereof, to be known as 2
1616 sections 50.327 and 57.317, to read as follows:3
1717 50.327. 1. Notwithstanding any other provisions of 1
1818 law to the contrary, the salary schedules contained in 2
1919 sections 49.082, 50.334, 50.343, 51.281, 51.282, 52.269, 3
2020 53.082, 53.083, 54.261, 54.320, 55.091, 56.265, 57.317, 4
2121 58.095, and 473.742 shall be set as a base schedule for 5
2222 those county officials. Except when it is necessary to 6
2323 increase newly elected or reelected county officials' 7
2424 salaries, in accordance with Section 13, Article VII, 8
2525 Constitution of Missouri, to comply w ith the requirements of 9
2626 this section, the salary commission in all counties except 10
2727 charter counties in this state shall be responsible for the 11
2828 computation of salaries of all county officials; provided, 12
2929 however, that any percentage salary adjustments in a county 13
3030 shall be equal for all such officials in that county. 14
3131 2. Upon majority approval of the salary commission, 15
3232 the annual compensation of part -time prosecutors contained 16
3333 in section 56.265 and the county offices contained in 17
3434 sections 49.082, 50.334, 50.343, 51.281, 51.282, 52.269, 18 SB 1036 2
3535 53.082, 53.083, 54.261, 54.320, 55.091, 58.095, and 473.742 19
3636 may be increased by up to two thousand dollars greater than 20
3737 the compensation provided by the salary schedules; provided, 21
3838 however, that any vote to incre ase compensation be effective 22
3939 for all county offices in that county [subject to the salary 23
4040 commission]. 24
4141 3. Upon the majority approval of the salary commission, 25
4242 the annual compensation of a county coroner of any county of 26
4343 the second classification as provided in section 58.095 may 27
4444 be increased up to fourteen thousand dollars greater than 28
4545 the compensation provided by the salary schedule of such 29
4646 section. 30
4747 4. Upon majority approval of the salary commission, 31
4848 the annual compensation of a county sheriff as provided in 32
4949 section 57.317 may be increased by up to six thousand 33
5050 dollars greater than the compensation provided by the salary 34
5151 schedule of such section. 35
5252 5. The salary commission of any county of the third 36
5353 classification may amend the b ase schedules for the 37
5454 computation of salaries for county officials referenced in 38
5555 subsection 1 of this section to include assessed valuation 39
5656 factors in excess of three hundred million dollars; provided 40
5757 that the percentage of any adjustments in assessed valuation 41
5858 factors shall be equal for all such officials in that county. 42
5959 57.317. 1. [(1)] The county sheriff in any county 1
6060 [of the first or second classification ], other than in a 2
6161 chartered county, shall receive an annual salary [equal to 3
6262 eighty percent of the compensation of an associate circuit 4
6363 judge of the county. 5
6464 (2) The county sheriff in any county of the third or 6
6565 fourth classification shall receive an annual salary ] 7
6666 computed as set forth in the following [percentages of the 8 SB 1036 3
6767 compensation of an associate circuit judge of the county. 9
6868 If there is an increase in salary of less than ten thousand 10
6969 dollars, the increase shall take effect on January 1, 2022. 11
7070 If there is an increase of ten thousand dollars or more, the 12
7171 increase shall be paid over a period of five years in twenty 13
7272 percent increments per year ] schedule. The assessed 14
7373 valuation factor shall be the amount thereof as shown for 15
7474 the year next preceding the computation. The provisions of 16
7575 this section shall not permit or require a reduction in the 17
7676 amount of compensation being paid for the office of sheriff 18
7777 [from the prior year] on January 1, 1997. 19

106106 2. Two thousand dollars of the salary authorized in 45
107107 this section shall be payable to the sheriff only if the 46
108108 sheriff has completed at least twenty hours of classroom 47
109109 instruction each calendar year relating to the operations of 48
110110 the sheriff's office when approved by a professional 49
111111 association of the county sheriffs of Missouri unless 50
112112 exempted from the training by the professional a ssociation. 51
113113 The professional association approving the program shall 52
114114 provide a certificate of completion to each sheriff who 53
115115 completes the training program and shall send a list of 54
116116 certified sheriffs to the treasurer of each county. 55
117117 Expenses incurred for attending the training session may be 56
118118 reimbursed to the county sheriff in the same manner as other 57
119119 expenses as may be appropriated for that purpose. 58
120120 3. The county sheriff in any county , other than a 59
121121 first classification charter county, shall not, except upon 60
122122 two-thirds vote of all the members of the salary commission, 61
123123 receive an annual compensation less than the total 62
124124 compensation [described under this section ] being received 63
