10 | 10 | | To repeal sections 50.327 and 57.317, RSMo, and to enact in lieu thereof two new sections relating |

13 | 13 | | Be it enacted by the General Assembly of the State of Missouri, as follows: |
---|
14 | 14 | | Section A. Sections 50.327 and 57.317, RSMo, are repealed 1 |
---|
15 | 15 | | and two new sections enacted in lieu thereof, to be known as 2 |
---|
16 | 16 | | sections 50.327 and 57.317, to read as follows:3 |
---|
17 | 17 | | 50.327. 1. Notwithstanding any other provisions of 1 |
---|
18 | 18 | | law to the contrary, the salary schedules contained in 2 |
---|
19 | 19 | | sections 49.082, 50.334, 50.343, 51.281, 51.282, 52.269, 3 |
---|
20 | 20 | | 53.082, 53.083, 54.261, 54.320, 55.091, 56.265, 57.317, 4 |
---|
21 | 21 | | 58.095, and 473.742 shall be set as a base schedule for 5 |
---|
22 | 22 | | those county officials. Except when it is necessary to 6 |
---|
23 | 23 | | increase newly elected or reelected county officials' 7 |
---|
24 | 24 | | salaries, in accordance with Section 13, Article VII, 8 |
---|
25 | 25 | | Constitution of Missouri, to comply w ith the requirements of 9 |
---|
26 | 26 | | this section, the salary commission in all counties except 10 |
---|
27 | 27 | | charter counties in this state shall be responsible for the 11 |
---|
28 | 28 | | computation of salaries of all county officials; provided, 12 |
---|
29 | 29 | | however, that any percentage salary adjustments in a county 13 |
---|
30 | 30 | | shall be equal for all such officials in that county. 14 |
---|
31 | 31 | | 2. Upon majority approval of the salary commission, 15 |
---|
32 | 32 | | the annual compensation of part -time prosecutors contained 16 |
---|
33 | 33 | | in section 56.265 and the county offices contained in 17 |
---|
34 | 34 | | sections 49.082, 50.334, 50.343, 51.281, 51.282, 52.269, 18 SB 1036 2 |
---|
35 | 35 | | 53.082, 53.083, 54.261, 54.320, 55.091, 58.095, and 473.742 19 |
---|
36 | 36 | | may be increased by up to two thousand dollars greater than 20 |
---|
37 | 37 | | the compensation provided by the salary schedules; provided, 21 |
---|
38 | 38 | | however, that any vote to incre ase compensation be effective 22 |
---|
39 | 39 | | for all county offices in that county [subject to the salary 23 |
---|
40 | 40 | | commission]. 24 |
---|
41 | 41 | | 3. Upon the majority approval of the salary commission, 25 |
---|
42 | 42 | | the annual compensation of a county coroner of any county of 26 |
---|
43 | 43 | | the second classification as provided in section 58.095 may 27 |
---|
44 | 44 | | be increased up to fourteen thousand dollars greater than 28 |
---|
45 | 45 | | the compensation provided by the salary schedule of such 29 |
---|
46 | 46 | | section. 30 |
---|
47 | 47 | | 4. Upon majority approval of the salary commission, 31 |
---|
48 | 48 | | the annual compensation of a county sheriff as provided in 32 |
---|
49 | 49 | | section 57.317 may be increased by up to six thousand 33 |
---|
50 | 50 | | dollars greater than the compensation provided by the salary 34 |
---|
51 | 51 | | schedule of such section. 35 |
---|
52 | 52 | | 5. The salary commission of any county of the third 36 |
---|
53 | 53 | | classification may amend the b ase schedules for the 37 |
---|
54 | 54 | | computation of salaries for county officials referenced in 38 |
---|
55 | 55 | | subsection 1 of this section to include assessed valuation 39 |
---|
56 | 56 | | factors in excess of three hundred million dollars; provided 40 |
---|
57 | 57 | | that the percentage of any adjustments in assessed valuation 41 |
---|
58 | 58 | | factors shall be equal for all such officials in that county. 42 |
---|
59 | 59 | | 57.317. 1. [(1)] The county sheriff in any county 1 |
---|
60 | 60 | | [of the first or second classification ], other than in a 2 |
---|
61 | 61 | | chartered county, shall receive an annual salary [equal to 3 |
---|
62 | 62 | | eighty percent of the compensation of an associate circuit 4 |
---|
63 | 63 | | judge of the county. 5 |
---|
64 | 64 | | (2) The county sheriff in any county of the third or 6 |
---|
65 | 65 | | fourth classification shall receive an annual salary ] 7 |
---|
66 | 66 | | computed as set forth in the following [percentages of the 8 SB 1036 3 |

67 | 67 | | compensation of an associate circuit judge of the county. 9 |
---|
68 | 68 | | If there is an increase in salary of less than ten thousand 10 |
---|
69 | 69 | | dollars, the increase shall take effect on January 1, 2022. 11 |
---|
70 | 70 | | If there is an increase of ten thousand dollars or more, the 12 |
---|
71 | 71 | | increase shall be paid over a period of five years in twenty 13 |
---|
72 | 72 | | percent increments per year ] schedule. The assessed 14 |
