1113 Be it enacted by the General Assembly of the State of Missouri, as follows:
12- Section A. Sections 50.327 and 58.095, RSMo, are repealed
13-and two new sections enacted in lieu thereof, to be known as
14-sections 50.327 and 58.095, to read as follows:
15- 50.327. 1. Notwithstanding any other provisions of
16-law to the contrary, th e salary schedules contained in
17-sections 49.082, 50.334, 50.343, 51.281, 51.282, 52.269,
18-53.082, 53.083, 54.261, 54.320, 55.091, 56.265, 58.095, and
19-473.742 shall be set as a base schedule for those county
20-officials. Except when it is necessary to inc rease newly
21-elected or reelected county officials' salaries, in
22-accordance with Section 13, Article VII, Constitution of
23-Missouri, to comply with the requirements of this section,
24-the salary commission in all counties except charter
25-counties in this state shall be responsible for the
26-computation of salaries of all county officials; provided,
27-however, that any percentage salary adjustments in a county
28-shall be equal for all such officials in that county.
29- 2. Upon majority approval of the salary commission,
30-the annual compensation of part -time prosecutors contained
31-in section 56.265 and the county offices contained in
32-sections 49.082, 50.334, 50.343, 51.281, 51.282, 52.269,
33-53.082, 53.083, 54.261, 54.320, 55.091, 58.095, and 473.742
34-may be increased by up to two thousand dollars greater than
35-the compensation provided by the salary schedules; provided,
36- 2
37-however, that any vote to increase compensation be effective
38-for all county offices in that county subject to the salary
39-commission.
40- 3. Upon the majority approval of the salary commission,
41-the annual compensation of a county coroner of any county
42-[of the second classification ] not having a charter form of
43-government as provided in section 58.095 may be increased up
44-to fourteen thousand dollars greater than the compensation
45-provided by the salary schedule of such section.
46- 58.095. 1. The county coroner in any county not
47-having a charter form of government shall receive an annual
48-salary computed on a basis as set fort h in the following
49-schedule as well as any adjustment authorized under
50-subsection 3 of section 50.327 . The provisions of this
51-section shall not permit or require a reduction in the
52-amount of compensation being paid for the office of coroner
53-on January 1, 1997:

66- 2. One thousand dollars of the salary authorized in
67-this section shall be payable to the coroner only if the
68-coroner has completed at least twenty hours of classroom
69-instruction each calendar year as established by the coroner
70-standards and training commission unless exempted from the
71-training by the Missouri Coroners' and Medical Examiners'
72-Association for good cause. The Missouri Coroners' and
73-Medical Examiners' Association shall provide a certificate
74-of completion to each coroner who completes the training
75-program and shall send a list of certified coroners to the
76-treasurer of each county and the department of health and
77-senior services. The coroner standards and training
78-commission may certify training programs th at satisfy the
79-requirements of this section in lieu of the training
80-provided by the Missouri Coroners' and Medical Examiners'
81-Association. Certified training completion shall be
82-submitted to the Missouri Coroners' and Medical Examiners'
83-Association which, upon validating the certified training,
84-shall submit the individual's name to the county treasurer
85-and department of health and senior services indicating the
86-individual is compliant with the training requirements.
87-Expenses incurred for attendin g the training session may be
88-reimbursed to the county coroner in the same manner as other
89-expenses as may be appropriated for that purpose. All
90-elected or appointed coroners, deputy coroners, and
91-assistants to the coroner shall complete the annual tr aining
92-described in this subsection within six months of election
93-or appointment.
94- 3. The county coroner in any county not having a
95-charter form of government shall not, except upon two -thirds
96-vote of all the members of the salary commission, rece ive an

99-annual compensation in an amount less than the total
100-compensation being received for the office of county coroner
101-in the particular county for services rendered or performed
102-on the date the salary commission votes.
103- 4. For the term beginnin g in 1997, the compensation of
104-the coroner, in counties in which the salary commission has
105-not voted to pay one hundred percent of the maximum
106-allowable salary, shall be a percentage of the maximum
107-allowable salary established by this section. The
108-percentage applied shall be the same percentage of the
109-maximum allowable salary received or allowed, whichever is
110-greater, to the presiding commissioner or sheriff, whichever
111-is greater, of that county for the year beginning January 1,
112-1997. In those counties in which the salary commission has
113-voted to pay one hundred percent of the maximum allowable
114-salary, the compensation of the coroner shall be based on
115-the maximum allowable salary in effect at each time a
116-coroner's term of office commences follo wing the vote to pay
117-one hundred percent of the maximum allowable compensation.
118-Subsequent compensation shall be determined as provided in
119-section 50.333.
120- 5. Effective January 1, 1997, the county coroner in
121-any county not having a charter form o f government may, upon
122-the approval of the county commission, receive additional
123-compensation for any month during which investigations or
124-other services are performed for three or more decedents in
125-the same incident during such month. The additional
126-compensation shall be an amount that when added to the
127-regular compensation the sum shall equal the monthly
128-compensation of the county sheriff.

107+ 4. For the term beginning in 1997, the compensation of 58
108+the coroner, in counties in which the salary commission has 59
109+not voted to pay one hundred percent of the maximum 60
110+allowable salary, shall be a per centage of the maximum 61
111+allowable salary established by this section. The 62
112+percentage applied shall be the same percentage of the 63
113+maximum allowable salary received or allowed, whichever is 64
114+greater, to the presiding commissioner or sheriff, whichever 65
115+is greater, of that county for the year beginning January 1, 66
116+1997. In those counties in which the salary commission has 67
117+voted to pay one hundred percent of the maximum allowable 68
118+salary, the compensation of the coroner shall be based on 69
119+the maximum allowable salary in effect at each time a 70
120+coroner's term of office commences following the vote to pay 71
121+one hundred percent of the maximum allowable compensation. 72 SB 1128 5
